Shakespeare의 The Merchant of Venice와 Measure for Measure 비교 연구

Abstract

Shakespeare는 The Merchant of Venice와 Measure for Measure에서 왜곡된 법이 야기 시키는 법적 갈등을 다루었다. 채권자 Shylock과 통치자 Angelo는 경제적 안정 및 질서를 위태롭게 한 Antonio와 Claudio의 범법행위를 법대로 엄하게 다스릴 것을 주장한다. 정의를 고집하는 나머지 법을 지나치게 문자대로 적용함으로써 그들은 해결하기 어려운 lawful injustice의 상황을 야기 시킨다. Shylock과 Angelo는 겉으로는 사회질서 및 정의를 내세우며 엄격한 처벌을 강요하고 있으나, Shylock의 경우 그가 증오해마지 않는 Antonio를 제거해 버리기 위해서, Angelo는 욕망에 치우쳐 저지른 죄과를 은폐시키고자 하는 욕망에서 단지 합법성을 내세우며 법을 악용하고 있다. Shakespeare는 두 작품에서 사리사욕을 위해 지나치게 법을 문자대로만 해석한 결과 초래된 lawful injustice의 문제를 제기하고 있으며 그 해결 과정을 통해 참다운 정의의 가능성을 모색하였다. 본 논문은 두 작품에서 제시된 lawful injustice의 문제가 재판을 통해 해결되는 과정을 살펴보고, 왜곡된 법을 퇴치시키고 그릇된 정의를 수정하는 과정에서 실현하게 되는 정의의 양상을 살펴보았다. Portia의 정의가 인간의 법에 입각하여 죄과를 일일이 벌하는 "computative justice"를 벗어나지 못하는 반면, Vienna의 공작은 죄인들을 법에 따라 단번에 처벌하지 않고 자비를 베풀어 재기의 기회를 부여하는 "recreative justice"를 시행한다. 이러한 변화는 Shakespeare가 법을 질서유지를 위한 "needful bits and curbs"로 보던 관점에서 벗어나 법이나 외적 규제보다 인간 내면의 변화에 의해 참다운 정의가 가능해진다고 보게 되었음을 반영한다. 인간의 법대로만 시행되는 불완전한 정의대신 자비와 정의가 조화를 이루는 참된 정의를 강조하는 가운데, 사랑과 용서의 중요성을 부각시키고 있다고 결론지었다.;The legal dilemma in Shakespeare's The Merchant of Venice and Measure for Measure presented through the conflict between justice and mercy, is dealt with in this paper. Shylock the creditor and Angelo the ruler insist to punish severely Antonio and Claudio who broke the economic and moral order. On the basis of the letter of law, Shylock and Angelo claim to put the offenders to death, though it is too severe and unjust. The absurd application of law adhering to the letter without the reasonable consideration of the situation leads to distortion of law and lawful injustice. In The Merchant of Venice and Measure for Measure, Shakes peare brought up the problems of lawful injustice and sought the possibilities of true justice in which justice and mercy are in harmony through the process of solving the problems. The purpose of this study is to investigate the process of solving the problem of lawful injustice through the trials and explore the justice which was realized in the process of eliminating the distorted, unjust law and modifying the injustice. The conclusion is that by comparing the computative justice carried out by Portia with the recreative justice realized by Duke of Vienna, Shakespeare emphasized the importance of true justice in which justice and mercy are in union.
