성인 장애여성의 성과 재생산권리에 대한 인식 분석

Abstract

본 연구의 목적은 장애여성 당사자 관점을 반영할 수 있는 질적 연구방법 중 심층 면접방법을 사용하여 성과 재생산권리에 대한 주관적 인식에 대해 분석하고 도출된 결과를 기반으로 향후 우리나라의 장애여성에 대한 사업 및 제도의 구체적인 방향을 제시하기 위한 것이다. 연구참여자는 생명윤리법상 성인 기준 만 18세 이상 성인 장애여성으로 장애인복지법에 따른 장애유형 15가지(지체, 뇌병변, 시각, 청각, 언어, 정신, 지적, 자폐성, 안면, 신장, 심장, 간, 호흡기, 뇌전증, 장루 요루)을 포함하여 중증 장애인 8명을 눈덩이 표집 방법을 통해 연구참여자로서 선정하였다. 우리나라 장애여성의 성과 재생산권리에 관한 연구가 전무하기에 이를 이해하는데 현상학적 연구방법론을 채택하여 장애여성 당사자의 관점에서 수집된 성과 재생산권리 자료를 심층적으로 분석하고 연구하고자 Giorgi 현상적 질적 연구방법을 선택하였다. 분석결과, 장애여성은 미디어 매체를 통해 재생산권리의 의미를 파악하는 경우가 많았으며 출산한 장애여성 대부분 양육에 대한 어려움이 있었다. 각 장애유형에 따라 재생산권리의 침해사례가 달랐으며 현재 재생산권리가 완전히 보장되지 못하는 사회에서 낙태죄, 모자보건법 제 14조항에 근거하여 장애여성이 받는 차별이 있었다. 연구결과를 통해 장애여성의 성과 재생산권리에 대한 장애여성당사자의 주관적인 인식을 분석할 수 있었고 장애여성의 권리가 제대로 보장받지 못하고 있는 상황을 확인할 수 있었던 계기가 되었다. 본 연구가 가지게 되는 시사점은 국가가 장애여성의 성과 재생산권리에 관해 관심을 가지고 성과 재생산권리 관련 법, 제도, 서비스를 구축할 필요가 있다는 점이다. 나아가 이러한 토대는 향우 장애여성의 건강, 고용 등에도 긍정적 영향을 미칠 것으로 보인다. 끝으로 기존 장애여성 관련 미약한 문헌을 연구하여 자료를 제시할 수 있다는 점에서 큰 성과라 본다. 연구자는 인간이라면 누구에게나 인정되는 보편적인 권리를 위해 이러한 연구들이 지속되길 기대한다.;The purpose of this study is based on the results derived by analyzing the subjective perception of the gender and reproduction rights using a deep interview method, which is one of the qualitative research methods that can reflect the perspective of women with disabilities. By proposing national policies, we will present the concrete future direction of public works and institutions for women with disabilities in korea. According to the study participants, the adult standard under the biothics law is that women with disabilities over the age of 18 have 15 types of disabilities based on the Act on Welfare of Persons with Disabilities were selected as study participants by the method of snowball sampling. Performance reproduction rights data collected from the perspective of women with disabilities, adopting phenomenological research methodologies to understand this, as there is no research on the sex of women with disabilities in South Korea. The Giorgi phenomenological and qualitative research method was selected in an attempt to study it. As a result of the analysis, first of all, the subjective perception of the gender of women with disabilities showed a negative position of the gender of women with disabilities from the non-disabled people. Second, women with disabilities often learned the meaning of reproduction rights through media, and most of the disabled women who gave birth had difficulty raising children. Each type of disability had different cases of infringement of reproduction rights, and in a society where reproduction rights are not fully guaranteed, abortion charges and discrimination against women with disabilities under Article 14 of the Maternal and Child Health Act there were. Through the research results, it was possible to analyze the subjective perceptions of women with disabilities regarding the rights of women with disabilities to gender and reproduction rights, and it was an opportunity to confirm the situation in which the rights of women with disabilities are not properly guaranteed. The implication of this study is that the state needs to be interested in the gender and reproduction rights of women with disabilities and establish laws, institutions, and services related to sexual and reproductive rights. Furthermore, this foundation is expected to have a positive impact on the health and employment of women with disabilities. Finally, it is a great achievement in that it can present data by researching not much literature related to women with disabilities. Researchers hope that these studies will continue for universal rights that are recognized by all human beings.
