법교육이 법의식 발달에 미치는 영향

Abstract

본 연구는 공식적이며 의도적인 학교 교육에서의 법교육이 청소년들의 법의식 발달에 미치는 영향을 분석하여, 청소년들의 법의식 함양을 제고할 수 있는 법 교육과정 및 교수법 개발 등에 중요한 시사점을 제공하고자 하는 것이다. 본 연구의 주요 연구문제는 다음과 같다. 첫째, 제7차 교육과정『법과 사회』교과 이수 여부, 사회과 교과 성적 및 법 지식습득경로에 따른 법의식 발달 수준에 차이가 있는가? 둘째, 『법과 사회』교과에 대한 자기이해도, 성적, 흥미도에 따른 법의식 발달 수준에 차이가 있는가? 본 연구는 서울시 소재의 인문계 고등학교 3학년 남·여학생 600명을 대상으로 설문조사를 한 뒤, 통계적 기법을 통하여 본 연구에서 설정한 독립변인들과 법의식 검사지를 통하여 측정된 학생들의 총 법의식 점수와의 관계를 분석하였다. 본 연구의 분석결과를 요약하면 다음과 같다. 첫째, 학생들의 인구통계학적 특성이 법의식 발달에 미치는 영향을 분석하여 본 결과, 성별 변인 외에는 각 변인에 따른 법의식 발달수준 차이가 통계적으로 유의미하게 나타나지 않았다. 이를 통하여 기존의 논의들과 달리 개인의 사회경제적 배경이 법의식 발달에 미치는 영향이 미미함을 알 수 있다. 둘째, 학생들의 집단 특성에 따른 법의식 발달수준을 분석하였다. 먼저,『법과 사회』교과 학습 유무에 따른 법의식 발달 수준 분석 결과, 학습집단의 법의식 발달 수준이 비학습집단보다 높게 나타나서 학교 교육을 통하여 법교육의 교육목표가 실현될 수 있음을 알 수 있었다. 다음으로 조사 대상자들을 법 지식습득경로에 따른 법의식 점수 차이를 분석한 결과, 또래 집단의 상호 작용이 법의식 발달에 유의미한 영향을 미친다고 나타나서 건전한 또래 집단 문화를 형성하는 것이 중요함을 알 수 있다. 마지막으로 사회과 성적에 따른 법의식 발달 수준을 분석한 결과, 사회과 성적이 법의식 발달 수준에 미치는 영향력은 미미하다고 판단되어 사회과 교육과정 구성 논의에 시사점을 제공하였다. 셋째, 『법과 사회』교과를 학습한 집단을 대상으로 『법과 사회』교과에 대한 자기이해도, 성적, 흥미도가 법의식 발달수준에 영향을 미치는지를 분석한 결과, 세 변인 모두 법의식 발달에 유의미한 영향을 미친다고 나타났다. 이를 볼 때에 『법과 사회』교과에 대한 이해도 및 흥미도가 해당 교과의 교육목표를 실현시킨다는 것을 알 수 있다. 본 연구의 분석결과를 토대로 다음과 같은 제언을 하고자 한다. 첫째, 인구통계학적 특성이 법의식 발달 수준에 미치는 영향에 대한 체계적인 연구를 실시하여 모든 학습자에게 동일한 법교육이 아니라 개별 학습자의 인구통계학적 특성을 고려한 법교육 내용 및 교수법이 개발되어야 한다. 둘째, 학교 법교육에서는 학습자의 법 지식습득경로를 고려하여 학습자료 및 교수법을 개발하고, 이를 통하여 학습자의 법교육에 대한 흥미와 참여를 높이도록 해야 한다. 셋째, 『법과 사회』교과에 대한 이해도, 흥미도가 높을수록 법의식 점수가 높게 나왔다. 따라서 법교육을 통하여 법의식을 발달시키기 위하여서는 학습자의 수준에 적합한 법교육이 이루어져야 하고, 이를 위해서는 사전적으로 현재 학습자들의 법의식 수준에 대한 체계적 연구가 이루어져야 한다. 본 연구는 학교 교육에서의 법교육이 학습자의 수준에 맞는 교과 내용으로 구성되고, 학생들의 흥미를 유발할 수 있는 다양한 수업자료, 매체, 교수법 등을 이용하여야 학생들의 법의식 발달을 촉진할 수 있다는 점을 실증적으로 분석하였다는 점에서 의의를 지닌다. 본 연구의 분석 결과는 향후 학교 법교육과 관련한 정책 수립 방향에 중요한 시사점을 제공할 것으로 보인다.;This study aims to provide important implication on the curriculum of law and development of teaching method which improve consciousness of youth’s law-abiding spirit by analyzing the influence of the law education in official and purposeful schooling on development of youth’s law consciousness. The main subject for inquiry of the study is followed. First, do completing the seventh curriculum, ‘Law and Society’, the grade of social science, and also the process for acquiring knowledge make development level for the legal consciousness differently? Second, is there a difference of development level for the legal consciousness based on students’ understanding, grade and interest range? This study was based on questionnaire and answered by 600 boys and girls academic high school students of third grade in Seoul. And then between surveyed students’ total scores for legal consciousness on questionnaire and the set independent variables on the study by statistic method, there is a relation and it is analyzed. This is the summarized results from the survey. First, the development level of legal consciousness depending on each variable did not appear significantly except gender variables as a result of influence of students’ demographic characteristics on the development level for the legal consciousness. It indicates that individual’s socioeconomic backgrounds affect little contrary to existing discussions. Second, the development level of legal consciousness depending on collective characteristics of the students was analyzed. First of all, the result of survey which measured the development level of consciousness based on whether complete ‘Law and Society’ or not shows that objectives of education for law education can be realized because the learning group has higher development level of legal consciousness than non-learning group does. And then, the interaction of peer group is appeared that it influences on the development level of legal consciousness significantly by the result of score gap of legal consciousness depending on the route how the students attain law knowledge. Therefore it is important to create wholesome culture. Lastly, the development level of legal consciousness based on the grade of social science was analyzed and the result implies that the grade of social science affects little on it and also gives implication on composition elements for curriculum of social science. Third, self-understanding, grade and interest range for ‘Law and Society’ of the students who studied it are analyzed. And the result appears that three variables influence on the development level of legal consciousness significantly. It implies that the comprehension and interest range for ‘Law and Society’ accomplish its objectives of education. Several suggestions are made on the basis of the survey. First, methodical study for the influence of demographical features on the development level of legal consciousness should be carried out. Therefore law education and teaching method which concern the demographical feature of individual’s should not be equal to everyone and need to be developed Second, law education in school should consider the route for attaining knowledge of learners and improve teaching methods and learning materials. It makes learners have more interests and participate more in law education. Third, the higher comprehension and interest range for ‘Law and Society’ learners have, the better scores of legal consciousness appear. Thus, the suitable law education for the level of the learner should be implemented to enhance the legal consciousness through the law education and for that, methodical study about the level of legal consciousness of current learners has to be done in advance. This study acquires significance positively for analyzing two methods that can stimulate the development of legal consciousness of students. They show that the law education in school should be composed with the suitable subject contents for learner’s levels and variable and causing interest teaching materials, medium and teaching methods also need to be used well. The result of this study will provide important suggestions to establish policies related to the law education in school.
