고등학생의 사회적 신뢰가 법의식에 미치는 영향

Abstract

법적인 생활은 사회적인 관계에서 이루어지는 것이기 때문에, 한 사회의 사회적인 관계가 어떻게 형성되고 작동하고 있느냐 또한 법생활에 있어서 중요한 문제로 볼 수 있다. 사회 구성원들 사이에 신뢰가 형성되어 있어서 내가 법을 지키면 다른 사람도 법을 지킬 것이라는 믿음이 있다면 강제나 제재, 불이익이 없어도 법규범을 지키는 것이 더욱 자발적일 것이다. 이렇듯 법의식이라는 것은 사회적 관계 속에서 형성되는 것이며, 연구자는 법의식이 사회적 관계 속에서 형성되는 신뢰, 즉 사회적 신뢰와 깊은 연관이 있을 것이라고 추측하였다. 이에 따라 고등학생의 사회적 신뢰가 높을수록 법의식이 높을 것이라는 연구가설을 세우고 이를 검증하였다. 이를 위해 수도권 고등학생을 대상으로 설문조사를 하였으며, 총 634명의 응답을 통해 사회적 신뢰와 법의식을 측정하였다. 사회적 신뢰는 대인신뢰, 제도신뢰, 학교신뢰로 구분하여 측정하였고, 대인신뢰는 다시 친밀한 관계를 대상으로 한 특수적 신뢰와 모르는 사람을 대상으로 한 일반적 신뢰로 구분하여 측정하였다. 법의식은 인지적 영역, 정서적 영역, 행동적 영역으로 구분하였고, 인지적 영역은 법적 추론, 법필요성 인식, 자아 존중감의 3개 구성요소로 구분하여 측정하였다. 정서적 영역은 법적 친밀감, 법적 신뢰감, 준법우호적 태도의 3개 구성요소로 구분하여 측정하였으며, 행동적 영역은 법 사용의사, 법적 효능감의 2개 구성요소로 구분하여 측정하였다. 수집된 자료는 SPSS win12 한글판을 사용하여 t검정, 일원분산분석, 카이제곱(χ2)검정 등의 방법으로 분석하였다. 그 결과, 사회적 신뢰는 법의식에 대체적으로 영향을 미치며 정(+)의 비례관계를 보이는 경향이 큰 것으로 나타났다. 이는 사회적 신뢰가 가지고 있는 호혜성의 성격이 규범의 호혜성과 관련된 법의식의 요소들에 영향을 미치기 때문인 것으로 보인다. 그러므로, 법의식을 함양하기 위해서는 법교육에 있어서 효과적인 교수·학습 방법과 더불어 법교육을 비롯한 학교 교육에 있어서 사회적 신뢰를 증대시킬 수 있는 방안을 마련해야 할 것이다. 사회적 신뢰는 단체활동 참여에 영향을 받는 것으로 나타났는데, 이는 단체활동 참여로 나타나는 협조, 사회적 관계성, 호혜성 등이 신뢰를 형성하기 때문인 것으로 보인다. 그러므로 학생들의 과외활동이나 동아리 활동 등을 통한 단체활동 참여 기회를 지원해 주어야 할 것이며, 교수학습 방법에 있어서도 타인과의 이해, 소통 능력을 높이고 협동이나 협조가 일어날 수 있는 실천적이고 참여적인 다양한 교수학습 방법이 고려되어야 할 것이다.;As the legal life is attained within the social relation, how its social relation of a society is formed and run also can be deemed as important issue in the legal life. If there is belief that I comply with law, as the same to others as well, as some trust among social constituent members is composed, then it would be more willing for them to obey legal paradigm, even though there are no enforcement, sanctions, and disadvantages to be imposed. Thus since the legal consciousness is composed in the social relation, the author of this paper presumed that legal consciousness is closely associated with social trust to be composed within the social relation. According to this assumption, research hypothesis "Higher is social trust of high school students, more enhanced is their legal consciousness." was raised and verified. In order to do this, the enquete style questionnaire survey objecting high school students residing in capital spheres was conducted, measuring social trust and legal consciousness through Q&A responses by 634 students. As a result, social trust influenced their legal consciousness by and large so as to show pretty proportional trend. However, law-compliance friendly attitude or legal deduction was little influenced by social trust. As it was shown that social trust affects legal consciousness, some provision to enhance social trust in life guidance and teaching lesson practice should be prepared in order to cultivate legal consciousness of high school students. Especially, as the trust to school has inter-relation with each constituent factor of social trust, environment which school constituent members can mutually rely on should be composed, and also opportunity which those students can form social trust relationship through their participation with group activity should be provided.
