Norms of Personal Information Protection for the Liberalization of Digital Trade

Abstract

최근 아시아를 중심으로 디지털 무역 협정과 디지털 무역 자유화를 위한 규범화 노력이 이루어지고 있다. 특히, 아세안은 높은 경제 성장률과 디지털화가 급속도로 발전하고 있는 추세이다. 때문에 아세안 국가와의 디지털 무역은 중요하다. 디지털 무역 활성화를 위해서는 개인정보보호를 위한 규범화된 제도가 필요하고, 아세안 국가에서의 규범화 논의에 보다 적극적으로 참여해야 한다. 때문에 본 논문에서는 최근 지역무역협정에서 도입된 디지털 무역 규범(USMCA,CPTPP 등)을 비교 분석하고 핵심 규범의 활용 방안을 연구하였다. 특히 디지털 무역 자유화를 위한 다자간 협의로 이루어진 APEC CBPR 규범에 주목하였다. 아세안 국가와의 디지털 무역 활성화를 위한 전반적으로 데이터무역 자유화를 지지하고 디지털 무역 활성화를 위해 확대하는 방향으로 협상이 되고 제도가 발전되고 있다. 하지만 아세안 국가들의 디지털 격차와 제도적 인식 차이로 인해 상호간의 협력을 통한 자체적인 제도 개선을 기대하기에는 많은 시간과 비용이 든다. 때문에 현재로서는 APEC CBPR을 원용하는 것이 가장 실용적인 방안이라고 생각한다. APEC CBPR은 아시아태평양지역의 회원국들의 협의 하에 이루어진 규칙이며, 가장 높은 수준의 자유화 규범인 미국의 제안으로 다자간 협상이 이루어진 규범체계이기 때문이다. 본 논문은 아세안 국가와의 디지털 무역 자유화를 위해 APEC CBPR이 실효성 있는 규범인지 검증하고자 하였다. 이를 위해 최근 지역무역협정의 문헌조사 외에 아세안 국가들의 정부기관 협조로 설문조사를 실시하였다. 설문조사 대상은 인도네시아, 베트남, 말레이시아, 태국, 필리핀이 참여하였다. 설문조사 결과 디지털 무역 활성화를 위해 협상에서 CBPR의무화에 대해 긍정적인 답변이 높았고, CBPR의 인지도도 높았으나, 국가들의 디지털 자유화에 대한 인식 차이로 제도적 균형점을 모색하는 데는 한계가 있었다. 마지막으로, 본 논문은 향후 디지털 무역 관련 다자규범 형성을 위한 아세안 국가와의 디지털 무역 협상 과정에서의 한국의 참여 방향 및 아세안 국가들의 디지털 무역협정 참여에 대한 정책 방향 등에 대한 제언을 제시하고자 한다. ;Recently, there are many ongoing efforts for implementing a norm for liberalized digital trade and digital trade agreements around Asian countries. Especially, ASEAN countries are facing high economic growth rates and suddenly accelerating digitalization. Thus, digital trades with ASEAN countries are very critical. For promoted digital trades, we need a system with norms for protecting personal information and must more aggressively participate in the discussion of norm implementation in ASEAN countries. Thus, in the paper, this study aims to comparatively analyze digital trade norms(USMCA,CPTPP and etc) that have been recently introduced in the regional trade agreements and study plans for utilizing the key norms. Particularly, this study concentrates on the APEC CBPR rules consisting of multidimensional discussions for liberalized digital trades. Overall, to promote digital trades with ASEAN countries, data trade liberalization is supported and the ongoing discussions tend to expand the scope of digital trade, thus implementing the system in this way. However, due to the digital divides and gap of recognition of system among ASEAN countries, it costs too much time and money to expect improvements on the system independently through mutual cooperation. Thus, at present, the most practical plan is to use the APEC CBPR as it is. The APEC CBPR is the rule implemented under consent among member countries in the Asia Pacific countries and it is the norm system enabling multi party discussions as the result of suggestions by the US, the country with the highest level of liberalized norm. In the paper, this study aims to investigate whether the APEC CBPR is an effective norm for digital trade liberalization among ASEAN countries. For this purpose, apart from the recent regional trade agreement literature studies, survey is conducted with cooperation from the government organizations of ASEAN countries. The survey participants include Indonesia, Vietnam, Malaysia, Thailand, and the Philippine. According to the result of survey, there are lots of positive replies to mandatory the APEC CBPR in the discussion of digital trade liberalization, and also the level of recognition of the APEC CBPR is also high, but due to the gap in recognition of digital trade liberalization among countries, there is a limit on seeking a balance of system. Finally, in the paper, the author wishes to suggest a proposal for political direction on digital trade agreement participation among ASEAN countries as well as the direction of participation by Korea in the course of discussion on digital trade among ASEAN countries to form the multidimensional nor related to digital trade in the future.
