선거관리위원회의 정보공개 업무 개선방안에 관한 연구

Abstract

In democracy, elections reflect the needs of the people and allow them to participate directly and indirectly in state affairs, making the development of democracy an important means. However, political and social conflicts lead to disputes over the election process, and controversy over the election process and results is also raised. Therefore, the role of the Election Commission in ensuring election management is important. The Election Commission has been striving to secure public confidence in the election process. Among them, attention is paid to the information disclosure work of the Election Commission. The purpose of this study is to investigate the current status of information disclosure work of the Election Commission and to present improvement measures. This study summarized the role of the Election Commission through literature research and the significance and importance of the information disclosure system and examined the relationship between the information disclosure system and record management. Before analyzing the Election Commission's information disclosure work, it analyzed the information disclosure support work of the Election Commission, which is a state agency or federal agency in the United States, Australia, the United Kingdom, and Canada. In order to analyze the information disclosure work of the Election Commission in Korea, data on the information disclosure operation status of the Election Commission were examined from 2004 to 2020, and the operation status and trend were investigated compared to central administrative agencies. Next, in order to investigate the status of information disclosure work of the Election Commission, a survey was conducted on the perception of information disclosure personnel. Interviews were conducted with information disclosure officials of the Election Commission and based on the interview coding system presented in Appendix 1, the weight of work, information disclosure decision, information disclosure support request, and record management recognition were divided. As a result of the interview analysis, the Election Commission's plan to improve information disclosure work was summarized and proposed in terms of information disclosure work and awareness improvement. First, in terms of information disclosure work, regular access to political funds was proposed. Election Commission officials said that there are cases where the number of requests for information disclosure before and after the election period increases, making it difficult to handle business. To this end, it was suggested that a revision of the Political Fund Act for preemptive information disclosure of political funds, which accounts for a significant portion of requests for information disclosure, is required, and after the revision, a viewing function and a search function through the website are required. Next, it was suggested that education is necessary before being put into the information disclosure work. Most information disclosure managers were found to be receiving training after information disclosure work. Since non-disclosure decisions are sensitive issues, knowledge to make reasonable judgments is needed. In addition, as the importance of information disclosure work is increasing due to the recent political and social conflict problem, education to efficiently handle information disclosure work should be supported. In terms of awareness improvement, it was suggested that it was necessary to promote the information list to the public. The information list can be helped by checking the information held by the institution before the public makes a request for information disclosure. However, information disclosure officials saw that the public did not know the information list well and that the use of the information list was low. Therefore, it is necessary to add a procedure for checking the information list before requesting information disclosure and to enable a search function for the information list. Finally, it was suggested that there is a need to improve awareness of record management. It was found that the information disclosure officials of the Election Commission had low awareness of record management. This seems to be because there is no recognition of record management within the institution. Therefore, it is necessary to improve the perception of record management so that records that are the basis for information disclosure can be systematically managed. To this end, it is necessary to provide periodic record management-related education. This study noted that controversy over the election process is being raised due to political and social conflicts, and the disclosure of information by the Election Commission is becoming important. To this end, this study is meaningful in that it conducted interviews with information disclosure officials to analyze the current status and problems of the work and prepared improvement measures for efficient information disclosure work.;민주주의에서 선거는 국민들의 요구를 반영하며 국정에 직접적. 간접적으로 참여할 수 있게 하여 민주주의의 발전을 중요한 수단이 된다. 그러나 정치 사회적 갈등은 선거 과정에 대한 분쟁으로 이어지며 선거과정과 결과에 대한 논란이 제기되기도 한다. 따라서 선거관리를 보장하는 선거관리위원회의 역할이 중요하다. 선거관리위원회는 선거과정에 대한 국민의 신뢰를 확보하기 위해 노력해왔다. 그 중에서 선거관리위원회의 설명책임성을 뒷받침하는 정보공개 업무에 주목하였다. 본 연구에서는 선거관리위원회의 정보공개 업무 현황을 조사하고 개선방안을 제시하는 것을 목적으로 하였다. 본 연구는 문헌연구를 통해 선거관리위원회의 역할과 정보공개제도의 의의와 중요성을 정리하였으며 정보공개제도와 기록관리의 연관성을 고찰하였다. 또한 선거관리위원회의 정보공개 업무를 분석하기 전에 국외 사례로 미국, 호주, 영국, 캐나다의 국가기관 또는 연방기관인 선거관리위원회의 정보공개 지원 업무를 분석하였다. 국내 선거관리위원회의 정보공개 업무를 분석하기 위해서는 선거관리위원회 정보공개 운영실태 데이터를 2004년에서 2020년까지 살펴보고 중앙행정기관과 비교하여 운영현황 및 추이를 조사하였다. 다음으로 선거관리위원회 정보공개 업무 현황을 조사하기 위해 정보공개 담당자 인식조사를 하였다. 선거관리위원회 정보공개 업무 담당자를 대상으로 인터뷰를 수행하였으며 부록1에서 제시된 인터뷰 코딩체계를 바탕으로 정보공개 업무 담당자의 부서와 업무비중, 정보공개 결정, 정보공개 업무 지원요구, 기록관리 인식에 대한 영역으로 나누어 분석하였다. 인터뷰 분석결과 선거관리위원회의 정보공개 업무 개선방안으로 정보 공개 업무 측면과 인식개선으로 정리하여 제안하였다. 먼저 정보공개 업무 측면에서는 정치자금에 대한 상시열람을 제안하였다. 선거관리위원회 담당자들은 선거기간 전후 정보공개 청구 건수가 폭증하는 경우가 있어 업무 처리에 어려움이 있다고 하였다. 이를 위해 정보공개 청구의 상당한 부분을 차지하는 정치자금의 선제적인 정보공개를 위한 정치자금법 개정이 필요하며 개정 이후에 홈페이지를 통한 열람 기능과 검색기능이 필요함을 제안하였다. 다음으로 정보공개 업무에 투입되기 전 교육이 필요함을 제안하였다. 대부분의 정보공개 담당자들은 정보공개 업무 이후 교육을 받고 있는 것으로 나타났다. 공개/비공개 결정은 민감한 사안이기 때문에 합리적인 판단을 내릴 수 있는 지식이 필요하다. 또한 최근 정치사회적 갈등 문제로 정보공개 업무의 중요성이 더욱 커지고 있기 때문에 정보공개 업무를 효율적으로 처리하기 위한 교육이 뒷받침되어야 할 것이다. 인식개선 측면서에서는 국민들에게 정보목록에 대한 홍보가 필요함을 제안하였다. 정보목록은 국민들이 정보공개 청구를 하기 이전에 기관이 보유한 정보를 확인할 수 있어 도움을 받을 수 있다. 하지만 정보공개 담당자들은 국민들이 정보목록을 잘 알지 못하며 정보목록의 활용도가 낮다고 보았다. 따라서 정보공개 청구 전 정보목록을 확인하는 절차를 추가하고 정보목록에 대한 검색 기능이 가능하도록 해야 한다. 마지막으로 기록관리에 대한 인식 개선이 필요함을 제안하였다. 선거관리위원회 정보공개 담당자들은 기록관리에 대한 인식이 저조함을 알 수 있었다. 이는 기관내에서 기록관리에 대한 인식이 정립되어 있지 않기 때문으로 보인다. 따라서 정보공개의 기반이 되는 기록이 체계적으로 관리될 수 있도록 기록관리에 대한 인식을 개선해야 할 것이다. 이를 위해서 주기적인 기록관리 관련 교육을 제공할 필요가 있다. 본연구는 정치사회적 갈등으로 인해 선거과정의 논란이 제기되고 있으며 선거관리위원회의 정보공개가 중요해지고 있음을 주목하였다. 이를 위해 정보공개 업무 담당자를 대상으로 인터뷰를 수행하여 업무 현황과 문제점을 분석하고 효율적인 정보공개 업무를 위한 개선방안을 마련하였다는 점에서 본 연구의 의의가 있다.
