정상회담을 통한 문화재 반환

Abstract

본 연구는 식민지 시기와 전쟁 당시에 약탈당한 문화재가 피해국으로 돌아오는 법적인 절차를 정리하고 어떠한 방식으로 돌아오는지 살펴보았다. 특히 문화재 이동의 여러 가지 방식 중 정상회담에서의 문화재 인도식에 주목하였다. 여기에서 말하는 정상회담이란 정상 간의 문화재 협상이 벌어지는 과정이 아니라 문화재 약탈국과 문화재 피해국의 최고 수장이 만나는 상징적인 장면을 의미한다. 이를 살펴보기 위해 문화재 이동에 대한 관점으로 존 헨리 메리만(J. H. Merryman. 이하 메리만)이 정리한 문화 국제주의와 문화 민족주의에 관해 살펴보고 이를 비판적으로 적용하였다. 메리만의 경우, 문화 국제주의의 입장에서 식민지 시기와 전쟁 당시에 약탈당한 문화재뿐만 아니라 경매장 등에서 적법하게 거래되고 있는 문화재 이동에 관해 말하고 있다. 그러나 합법적으로 반출된 문화재와 약탈당한 문화재는 이동 절차가 매우 다르므로 본 논문에서는 특정 시기, 정치 권력에 의해 약탈당한 문화재는 따로 분류하여 문화재 제국주의와 문화재 민족주의로 나누어 논점을 정리하였다. 약탈당한 문화재는 형법에 저촉되는 사건과 법률을 위반하지 않았더라도 정치 권력의 직간접적 폭력이 있었다면 분석 대상으로 정했다. 본 연구는 문화재를 가치 있는 것으로만 보던 기존의 관점에 더해 메리만이 강조한 재산상의 의미를 정리하여 문화재가 이동하기 위한 법적 절차인 협정 후 의회 비준이나 검찰의 압수 및 사법부의 몰수 절차에 관해 살펴보았다. 그 뒤, 정상회담으로 문화재가 인도될 수 있는 조건에 관해 분석하였는데 이는 시민단체의 의제설정 여부와 법적 절차 완료 이후에 이루어진다고 정리하였다. 본 연구에서는 정상회담을 통한 문화재 반환을 사과를 수반한 문화재 반환으로 보고 이를 상징적으로 보여주는 장면이 정상회담을 통한 문화재 인도식이라고 보았다. 이에 국내에서 발생한 정상회담을 통한 문화재 인도 5건과 해외에서 발생한 2건의 사례를 분석하여 사과를 수반한 문화재 반환과 그렇지 않은 경우에는 어떠한 차이점이 있는지 정리했다.;This study organized the legal procedure in which the cultural properties plundered during the colonial era and war time were returned to the victimized countries, and the methods of return. Especially, this study paid attention to the cultural property handing-over ceremony at summit meetings of many methods for the movement of cultural properties. Here, the summit does not mean the process of having a negotiation for cultural property between leaders, but a symbolic scene in which the top leaders of predatory country and victimized country meet with each other. In order to examine this, this study examined the cultural internationalism and cultural nationalism organized by John Henry Merryman in the perspective of cultural property movement, and then critically applied them. Merryman is not only talking about the cultural properties plundered during the colonial era and war time in the position of cultural internationalism, but also the movement of cultural properties legally traded in places like auction house. However, the cultural properties legally taken out have very different procedures from the movement of the plundered cultural properties. Thus, this thesis organized the points by separately classifying the cultural properties plundered by specific period and political power, and then dividing them into cultural property imperialism and cultural property nationalism. If there were direct/indirect violences of political power, the plundered cultural properties were selected as analysis subjects even though the events and law did not violate the criminal law. By organizing the meanings in the aspect of property emphasized by Merryman on top of the existing perspective viewing the cultural properties just as something valuable, this study examined the National Assembly ratification, seizure by the prosecution, and the confiscation procedure of the judiciary after the agreement as the legal procedure to move cultural properties. After analyzing the conditions for handing over cultural properties through summit meetings, this study organized that it would be done with the matter of setting up agenda by civic groups and after completing the legal procedure. This study regarded the return of cultural properties through summit meetings as the return of cultural properties accompanied by apologies and also regarded this symbolic scene as the cultural property handing-over ceremony through summits. Thus, this study organized differences between the return of cultural properties accompanied by apologies and other cases, by analyzing five domestic cases and two foreign cases of cultural property handing-over through summit meetings.
