Abstract
이 연구는 가정폭력 피해자의 자립에 대한 사회적 관심이 생겨나는 시점에서 자립(self-sufficiency)이라는 언어가 가정폭력 이후를 살아가는 여성들의 삶을 설명하는 용어로 적절한지에 대한 질문에서 출발하였다. 피해자 자립에 대한 관심은 가정폭력 문제를 ‘가정의 회복’으로 접근하던 오래된 관행이 점차 변화하고 있음을 보여준다는 점에서 주목할 필요가 있다. 하지만 신체적 폭력의 심각성을 강조하거나 가해자의 통제의도를 기준으로 가정폭력 여부를 가늠해온 담론은 피해경험을 맥락적으로 설명하기 어렵고, 이러한 구도에서 피해자 자립은 불쌍한 피해자이거나 용감한 생존자라는 분절적인 구도에서 설명되어야 하는 한계를 남긴다. 이러한 분절적인 피해 경험을 토대로 피해자의 자립을 기획할 때, 그것은 자칫 여성의 자립을 경제적 의미로 축소하고 인간의존의 사실을 간과한 채 개별 여성의 독립으로 오인될 위험을 내포하며, 이것은 다시 가정폭력문제를 개인화함으로써 젠더권력관계를 비가시화시키는 데에 기여할 수 있다. 이에 이 연구는 폭력관계를 중단한 여성의 경험을 통해 폭력관계 안팎에서 자기(self)를 지켜내고 되살려온(reclaiming) 여정을 탐색함으로써 이들이 무엇으로부터 벗어나고자 했고 어떻게 그것을 감행했으며, 어디를 향하고 있는지 탐구하고자 하였다. 연구결과는 다음과 같다. 첫째, 가해자가 통제하려는 내용은 아내의 자율성이었고, 가해자의 통제시도는 두 가지 측면에서 완벽하기 어려웠다. 자율성이 자신의 욕망(desire), 가치(value), 선호(preference), 신념(truth)과 관련된다고 할 때 아내가 자신의 의지를 품는 한 자율성을 완벽히 통제하는 것은 사실상 불가능했다. 여성들은 남편의 통제시도에 맞서서 책읽기와 공부, 진학, 소득활동 등을 통해서 자신을 들여다보고 폭력관계를 해석하고 대면할 수 있는 역량을 축적했으며, 이러한 행위들은 전적으로 아내의 욕망과 의지로 집행된다는 점에서 아내의 자율성 실천이자 가해자의 ‘통제 실패’의 맥락에 놓인다. 또한 가해자의 통제시도는 폭력관계를 둘러싼 사회적 관계망의 ‘완벽한’ 협조 없이 성공에 이르기 어려웠다. 공식적·비공식적 사회관계망은 정상가족 규범과 차별적 젠더규범을 수용할 때 강압적통제망으로 구성될 수 있지만, 여성의 고통에 공감하고 지지적 응답을 보낼 경우 여성이 폭력관계를 중단할 수 있는 역량을 구성하는 데에 영향을 미쳤다. 요컨대 여성들은 사회적 관계망의 지지적 응답을 통해서 자신에 대한 신뢰의 감각을 복원했고 이러한 자기신뢰는 아내 스스로 규범적 권한을 가진 존재로 여길 수 있는 자기권위(self-authorization) 생성을 도왔다. 자기권위를 생성하면서 여성들은 강압적 통제관계에서 남편이 집행하는 관계규범이 약자 위에 군림하고, 상대를 도구화하고 장악하는 부정의한 것이라고 평가했으며 이것을 거부하기로 결정하면서 폭력관계 종료의 과정을 밟는다. 둘째, 여성의 자기탈환 여정은 자신의 삶을 살고자 하는 ‘자율성 탈환’의 여정이었다. 가정폭력은 여성이 생애과정에서 경험했던 차별과 암암리에 종용받아온 자기상실의 압력과 직면하는 계기였으며, 폭력관계 종료결정은 이러한 억압적 지배규범에 정면으로 맞서는 생애사건에 가까웠다. 남편의 폭력으로 인해 상실할 위기에 처했던 것도 자기(self)였지만 가정폭력으로 인해 다시 살피게 된 것도 자기였다. 결혼을 통해 가부장적 가족에서 벗어나자 했지만, 차별적 젠더규범이 작동하는 결혼은 여성들이 기대했던 평등한 파트너십을 수행할 수 없는 장소였고 지배규범은 남편의 아내에 대한 강압적 통제를 정상화(normalize)했다. 때문에 여성들의 이혼 결정은 가부장적 통제규범에 대한 거부이면서 동시에 ‘벗어나는’ 삶이 아니라 스스로 ‘존재하는’ 삶으로의 이동을 의미했다. 셋째, 가해자의 통제규범이 부정의하다고 평가하고 그것을 거부한 여성들은 폭력관계를 종료하고 사회적 관계들과 재접속할 때, 상대를 도구화하지 않으면서 스스로도 상대에게 종속되지 않아야 한다는 관계맺기의 기준을 생성했다. 이러한 아내들의 관계맺기 기준은 평등한 관계에서 작동하는 대안적인 관계규범으로 구성될 수 있다는 점에서 중요한 의미를 갖는다. 하지만 여성들은 이러한 관계기준을 실천하는 데에 어려움을 겪었다. 그 이유는 세 가지로 구분해 볼 수 있다. 하나는 차별적 젠더규범과 가해자의 폭력이 아내의 자율성을 침해하면서 자기에 대한 감각을 변형시켜온 것과 관련된다. 강압적 통제망은 여성의 자기에 대한 신뢰와 타인에 대한 신뢰감 생성을 방해하거나 침해했으며, 폭력관계를 종료한 이후에도 여성은 이를 회복하는 데에 어려움을 겪었다. 둘째로 아무에게도 의존하지 않는 삶을 자율적인 삶으로 가정하는 고전적 자율성 담론의 영향에 기인한다. 이로 인해 폭력관계를 종료하고 ‘자율적인 삶’을 살기로 결정한 여성들은 자율적인 삶을 누구에게도 의존하지 않는 삶과 동일한 것으로 오인하기 쉬웠다. 때문에 상대를 도구화하지 않으면서 내가 종속되지 않는 관계맺기는 사회적 관계의 단절과 여성의 고립으로 이어지기도 했다. 마지막으로 가정폭력 피해를 충분히 고려하지 못하는 제도적 공백이 직·간접적으로 영향을 미쳤다. 가해자의 강압적 통제는 여성의 자율성에 대한 침해이기 때문에 여성의 전반적인 삶에 있어 중대한 침해를 결과한다. 그러나 현재의 피해자 지원정책은 중장기적 전망 속에서 계획되기 보다는 단기적인 보호와 위기지원에 집중되어 있어 여성들이 자신에 대한 감각을 회복하고 사회관계망을 재연결할 수 있는 역량을 생성하고 연습하기 위한 제도적 지원이 충분하지 않았다. 넷째, 여성들은 지배규범에 의존하지 않는 대안적인 관계규범을 생성하고 실천했다. 여성들에게 ‘자기탈환’은 홀로 잘사는 것을 의미하지 않았다. 여성들이 회복과정에서 다른 사람을 돕고자 한다는 기존 논의(Hou et al., 2013; Flasch, Murray & Crowe, 2015; Crann & Barata, 2019)는 다른 사람 돕기를 자기탈환과 분리하거나, 치유의 한 방법으로 소개하는데 그치고 있다. 하지만 이것은 여성의 자기탈환의 내용이자 본질이라고 할 수 있다. 여성들은 자신의 폭력경험을 토대로 상보적이고 순환적인 관계규범을 만들어 실천했으며 그것은 자신의 자율성을 실천하는 것이자 다른 사람의 자율성을 초대하는 것이기도 했다. 가해자와 가해자를 지지하는 강압적통제망은 폭력관계 종료 이후에도 ‘가족’의 이름으로 여성을 회유하고 통제를 시도하지만, 존재를 위한 투쟁 속에서 자기권위를 지키고, 자기규범의 생성과 사회적 관계 안에서의 발화(말하기, 거절하기, 요청하기, 반문하기, 수신하기)를 통해 나와 타자의 안위를 살피는 관계규범을 생성·변화·실천하는 여성들에게 있어서 강압적통제망은 고집스럽고 부정의하며. 곧 쇠퇴할 낡은 것일 뿐이었다. 다섯째, 여성의 자기탈환 여정은 ‘피해자’나 ‘생존자’라는 말로 표현될 수 없었다. 여성은 피해자이기도 하고 생존자이기도 하지만 그러한 정체성에 정박되지 않는 삶을 생성하고 확장해 갔으며, 억압적인 지배규범에 의해 장악될 수 없는 가치와 영역을 만들어가고 있었다. 또한 여성에게 있어서 ‘가족’은 정상가족 규범에 의해 규정되고 구동되는 것이 아니었다. 가족은 자신과 연루된 존재들의 느슨한 연결망이자 서로의 고통에 책임지려는 살핌의 관계였다. 이 관계는 서로를 온전히 자율성을 가진 존재로 초대한다는 점에서 독립적이지만 서로를 살피고 고통에 공감하며 자율적 존재로 살아가기를 조력한다는 점에서 상호의존적이었다. 여성들이 생성하는 삶의 방식은 피해자나 생존자라는 정체성의 언어가 아니라 서로에 대한 연결감을 포함하는 ‘스라이버십’으로 설명될 수 있었다. 더 이상 여성들은 어떤 경험(폭력피해)으로 정의되거나 무엇에 대항하는(against) 존재로 정의되지 않았고 사람들과 연결된 ‘자기’로 존재했다. 이렇게 볼 때 여성들은 자기탈환 여정에서 두 가지의 변화를 견인한다. 첫째는 구조적인 변화이고, 둘째는 지배규범과 관련된 내용적인 변화이다. 여성들은 강압적통제망에 결합하거나 결합할 수 있는 비공식적 사회적관계망을 자기탈환의 장으로 이동시켰다. 또한 가족, 친구, 직장동료는 여성의 말하기를 수신하면서 가정폭력에 대한 잘못된 통념을 조정했고, 이러한 시도가 항상 성공하는 것은 아니라 하더라도 강압적통제망을 약화시키는 데에 기여할 수 있다. 또한 경찰과 법원, 병원, 상담소 등의 공식적 지원망이 여성들의 목소리에 즉각적으로 지지적 응답을 보내는 것은 아니지만 여성들의 말하기는 잘못된 응답의 오류를 가시화하고 수정의 기회를 제공하였다. 동시에 여성들이 생산하는 상보적·순환적인 관계규범은 위계와 서열, 그리고 계약관계를 인간관계의 표준으로 가정해온 지배적 관계규범의 문제들을 드러내고 저지했다. 이렇게 볼 때 피해자 자립에 대한 국가의 제도적 기획은 사회구조적인 측면과 여성개인에 대한 두 개의 축으로 준비될 필요가 있다. 하나는 사회적연결망이 강압적통제망으로 작동하지 않도록 차별적 젠더규범과 정상가족이데올로기의 고착과 재생산을 예방하는 것이고, 두 번째는 상보적이고 순환적인 관계규범을 생성하는 여성들이 자신과 타자, 사회에 대한 신뢰를 회복하면서 ‘안전하게’ 대안규범을 실천할 수 있는 시간과 장소를 준비하는 것이다. 이 연구의 이론적 함의는 다음과 같다. 이 연구는 폭력 이후의 삶에서 폭력은 삭제되거나 극복해야하는 대상이 아니라 폭력 이후의 여정에서 통합(incorporation)된다는 사실을 밝히고 있다. 폭력관계를 종료한 여성의 경험을 다루는 기존 연구들이 ‘폭력 없는 새로운 삶’을 목표로 삼고 그러한 목표에 도달하는 과정을 단계를 구분하는 것은 여성의 목소리를 소외시킨다고 보았고, 이 연구는 폭력의 경험을 ‘통해서’ 대안적 관계규범을 생성하고 스라이버십을 실천하는 여성들의 삶을 드러냄으로서 피해경험을 분절시키는 극복의 서사를 반박하였다. 또한 젠더균형론과 젠더불균형론이 대립하고 그것을 중재하는 방안으로 가정폭력 유형론이 대두되는 상황에서 강압적 통제가 비단 가해자와 피해자 사이의 개별적인 문제가 아니라 차별적 젠더규범과 사회적관계망이 유기적으로 결합한 ‘강압적통제망’의 문제임을 논증함으로써 가정폭력 유형론이 대안적 담론이 될 수 없음을 보였다. 마지막으로 페미니스트 관계적 자율성 이론에서의 난제(Stolja, 2013/2018)인 가정폭력 피해자의 자율성 실천을 폭력관계를 종료하는 여성의 여정을 통해 설명함으로써 실질적 입장과 절차적 입장을 중재하였다. 이 연구의 실천적 함의는 이 연구가 가정폭력 이후에도 삶은 지속된다는 ‘당연한’ 사실을 전한다는 데에 있다. 폭력관계 종료는 가능할 뿐 아니라 폭력의 경험은 여성들에게 상처로만 각인되는 것이 아니라 자율성 역량과 결합하였다. 문제는 그것을 위해 사회가 무엇을 준비해야 하는가에 있었다. 친밀한 폭력관계 종료를 결정한 여성은 스라이버십의 여정을 생성하며 살아갈 수 있지만 누구나가 그러한 것은 아니었다. 또한 피해자나 생존자라는 이름을 통해서는 가정폭력 피해 이후의 여정을 설명할 수 없고 스라이버십이 자신의 삶을 풍요롭게 살아가는 여성들의 경험을 설명해주지만, 그렇다고 해서 여성이 피해자나 생존자가 아닌 것은 아니며, 가해자로부터의 침해위험이 사라지는 것이 아니었다. 때문에 여성의 자율성 탈환은 여성에 대한 폭력을 지지하는 지배규범에 응답해가는‘여정’일 수밖에 없고 사회적 책무와 분리될 수 없다. ;This study started from the question if ‘self-sufficiency’ could be proper word to describe lives of women after domestic violence when our society just began to discuss self-sufficiency of domestic violence victims. The concerns for victims' self-sufficiency need to be focused as an old practice to approach to domestic violence issue with 'domestic restoration' has been changing. However, it is difficult to explain contextually the discourses emphasizing severity of physical violence or figuring out domestic violence based on the control intention by offender, and in such a structure, there is limitation that self-sufficiency of victims can not help from being explained in the segmental perspectives such as either pathetic victim or brave survivor. When planning self-sufficiency of victims based on these segmental experiences of violence, it could risk that women's self sufficiency is reduced to economic context and misconceived as an individual woman's independence, overlooking the truth of human dependence. and then, it individualizes domestic violence, making gender power relations invisible. This study aimed to explore what the women who broke the relationship of domestic violence tried to escape from, how they did so, and where they are going to, discovering their journey of reclaiming-self in and out of those violent relationships through their own experiences. The results of the analysis are as follows: First, in intimate relationship of violence, coercive control on wife by offender could not be completed in two aspects. Offenders tried to control their wives' autonomy, and yet, if autonomy was related to one's desire, value, preference or truth, and wives had a kind of will, it was impossible to control completely autonomy. women were empowered to reflect themselves, and interpret and confront relationship of violence through reading books, studies, attending schools and paid work, against husbands' attempt to control them, and as these acts were conducted entirely by their desires and wills, they are situated in the contests of wives's practicing autonomy and offenders' failure to control. In addition. offenders' attempt to control could not succeed without 'perfect' cooperation of social networks surrounding the relationship of violence. Formal or informal social networks may consist of coercive controls, but if they empathized women's suffering and reacted to them supportively, they affected to empower women to stop that kind of relationships. In brief, women restored the sense of self-trust through supportive reactions of social networks and this self-trust helped to create self-authorization that wives could regard themselves as beings with normative authority. Creating self-authorization, they judged that relational norms executed by husbands are unjust to reign over the weak, and instrument and dominate the spouses and when they decided to refuse it, they engage to end the relationship of violence. Second, women's journey of self-reclaiming was that of reclaiming autonomy to live their own lives. Domestic violence was the accident that women faced discriminations in the life course and oppression of self-losing and their decision to end the relationship of violence was a kind of life event to confront such coercive norms of domination. They almost lost self because of husbands' violence while they could reclaim the self because of it. They tried to escape from patriarchal family through marriage. However, marriage operated with discriminating gender norms could not offer equal partnership which women expected, and the norms of domination normalized husbands' coercive control against their wives. Therefore, women's decision to divorce means refusal to patriarchal norms of control and moving to 'life to exist by themselves' not 'that to escape'. Third, women who judged that offenders' norms of control were unjust and refused it, ended the relationship of violence and created the criteria for relationship neither to instrument the other party nor to make themselves subordinate when reconnecting social relationships. Such criteria for relationship was important because it could consist of alternative norms for relationship in equal ones. However, women had troubles for practicing the criteria. There are three reasons. First, discriminating gender norms and offenders' violence hampered wives' autonomy, transforming sense of self-worth. Coercive control network interrupted or impeded women's self-trust and that on others. and even though they ended relationships of violence, there were difficulties to recover them. Secondly, the classic discourse of autonomy supposing life of depending on nobody as autonomous one affected it. Because of it, women who determined to live 'autonomously' after ending the relationships of violence, could be misunderstood to have lives without depending on anyone. Therefore, relationship neither to instrument other party nor to make oneself subordinate could lead to cut from social relations and women's isolation. Finally, blanks in the policies not to consider sufficiently damages from domestic violence had direct and indirect influences, as well. Offenders' coercive control is to damage against women's autonomy, resulting in serious infringement in women's lives at large. However, the current polices for supporting victims are centralized in short-term emergency protection or crisis relief rather than planning them with middle- and long-term perspectives, and it is not enough systematic supports for women to create and exercise empowerment to recover their own sense of self-worth and to reconnect social networks. Fourth, women created and practiced alternative relational norms not depending on the norms of domination. For them, 'self-reclaiming' did not mean living well alone. The existing discussions about that women would like to help others in their restoration process(Hou et al., 2013; Flasch, Murray & Crowe, 2015; Crann & Barata, 2019) just separate helping others and women's self-reclaiming or introduce it as one of healing methods. And yet, it could be the content and essence of women's self-reclaiming. Women practiced inter-dependent and circulatory norms of relations and it was to practice one's own autonomy and invite other's autonomy. Offenders and coercive control networks supporting them try to conciliate and control women in the name of 'family' but for women who keep self-authorization in struggles for existence and create, change, and practice relational norms caring themselves and others through locutionary acts(speaking, refusing, requesting, cross-questioning, and accepting) in social networks, coercive control network is just stubborn, unjust and too old to be deteriorated. Fifth, women's journey for self-reclaiming could not be expressed with 'victim' or 'survivor'. Though the women were both victims and survivors, they created and expanded lives not limited in these identities and were making values and areas not taken over by oppressive norms of domination. Moreover, 'family' for the women were not defined and operated by the norms of normal family. The meaning of family was the loose network among the beings related to oneself and the relation of care responsible for mutual suffering. This relationship was independent as it was to invite each other as beings with full autonomy, while it was inter-dependent as it was about caring each other, emphasizing suffering, and helping to live as autonomous beings. The way of life which women would like to create could be explained in 'thrivership' containing links for each other rather than the languages of identity including victim or survivor. The Women were not defined with some experiences(those of violences) or as beings against something, but exist as 'selves' connected (other) people. So women draw two changes in the process of self-reclaiming First, it is structural change, and second it is the change on the contents related to the norms of domination. Women converted informal social networks combined or to be combined with coercive control networks to space of self-reclaiming. In addition, families, friends or colleagues in work places adjusted the wrong myth about domestic violence, accepting women's speech, and even though these attempts did not always succeed, they can contribute to weaken coercive control network. And official supporting networks including police, court, hospitals or clinics did not show supportive reactions immediately to women's voices but women's speech visualized errors of wrong answers and offered chances for correction. At the same time, inter-dependent and circulatory norms of relationships created by women revealed and restrained the problems of the dominating norms of relationship supposed as the standard for human relations. Therefore, national plans in the system for victims' self-sufficiency should be prepared with both the axes of social structure and individual woman. One is to prevent fixing and recreating discriminating gender norms and ideology of normal family not to make social networks as coercive control. The other is that women who create inter-dependent and circulatory norms of relationships prepare for time and venue(place) for practicing alternative norms 'safely', recovering trusts for self, others, and society. This study's theoretical implications are as follows: The study reveals that violence in life after it is not thing to be deleted or overcome but it is incorporated into the journey after it. The previous literature about the experiences of women who ended the relationship of violence considers that to set the goal of 'new life without violence' and to categorize the phases to the goal excluded women's voices, and this study refutes to the narratives of overcoming to segment the experiences of violence by showing lives of women who created alternative norms of relationships and practiced thrivership 'through' the experiences of violence. In addition, the study evidences that coercive control is not an individual issue of 'coercive control network' combining discriminating gender norms and social networks closely in the situations that the theory of types of domestic violence is rising in order to mediate the opposition between gender symmetry and gender asymmetry, and that the theory of types of domestic violence cannot be an alternative discourse. The theory of types categorizing with offenders' will to control and violence acts only could not explain how the attempted control succeeded or failed to be combined with coercive control networks. Finally, explaining women's journey to end the relationship of violence, the feminist 'Hard Cases'(Stolja, 2013/2018) in the theory of feminist relational autonomy, the study mediates between both the substantive and procedural approaches. This study's practical implication is that it shows the truth life goes on after domestic violence. It is possible to end the relationship of violence and even the experiences of violence are not only recognized as hurts but also combined with empowerment of autonomy. Its problem is what society should prepare for. Some women who decides to end intimate relationship of violence can live, creating the journey of thrivership but everyone cannot do so. And the labels of victim or survivor cannot explain the journey after violence. Even though thrivership explains the experiences of the women who live their own lives richly, they are still victims or survivors and the risks of violences from offenders does not disappear. Therefore, self-reclaiming is a 'journey' and cannot be separated from social responsibilities.
