Abstract
노동하는 청소년은 점증하고 있는 반면, 이들의 노동인권은 사각지대에 머물러 있다. 다수의 청소년들은 노동 현장에서 근로계약서 미작성, 폭언과 폭행, 성희롱에 노출되어 있으며, 일방적 해고를 당하거나 정당한 노동의 대가를 받지 못하고 있다(송태수·이원희, 2018a). 특성화고 현장실습생의 노동인권 침해 문제는 근절되지 못한 지 오래이다(국가인권위원회, 2017). 그러나 학생들은 대부분 일을 그만두거나 참는 등의 소극적 방식을 취하고 있다. 이러한 상황에서 특성화고 현장실습생 사망 및 사고 사건이 재조명되고, 청소년 노동권 침해의 현실을 ‘티슈 노동자’로 고발하는(서울신문, 2019.05.28.) 등의 사회적 움직임이 보이고 있다. 청소년 노동 현실에 대한 문제 제기와 관심이 확대되고 있는 점은 고무적이다. 그러나 이는 문제가 불거지기 전까지는 청소년 노동에 대해 사회적 의제로 충분히 논의하지 못하였다는 것을 반증하기도 한다. 청소년은 사회적, 경제적, 신체적 약자로 노동 환경에서도 제도적인 보장과 보호를 받아야 할 필요가 있다. 한편, 학생들이 노동 피해 상황에서 ‘어떻게 해야할지 몰라’당하고만 있다는 다수의 실태조사 결과(여성가족부, 2016, 2018; 송태수·이원희, 2018a; 유형근, 2018)는 청소년 노동인권교육의 부족함을 여실히 보여주고 있다. 청소년의 노동 현실 개선과 노동인권 보호를 위한 논의가 확대되는 가운데 무엇보다 ‘학교’라는 제도 안에서 노동인권교육이 다루어져야 한다는 주장이 일반적인 공감을 얻고 있다. 학생들 또한 노동인권교육에 대한 필요를 직접적으로 요구하고 있다(송태수·이원희, 2018a). 그러나 현재까지 우리 교육에서는 노동 청소년과 노동인권교육을 필요로 하는 학생들을 직접 마주하면서도 형식적이고 사후 처방적인 노동인권교육에서 벗어나지 못했던 것은 사실이다. 이에 따라 학교 노동인권교육의 정착을 위한 노력이 학교 안팎에서 전개되고 있다. 각 시도교육청과 유관 기관에서는 노동인권교육 지원 및 활성화 조례를 정책적 근거로 노동인권교육 자료와 프로그램 개발 및 배포, 교사 연수, 노동인권교육 연구보고 등 관련 논의와 사업을 펼쳐 나가고 있다. 학교 현장에서는 청소년 노동 현실의 심각성과 노동인권교육의 필요성을 인식한 교사들을 중심으로 노동인권교육이 교과 또는 비교과 시간을 통해 이루어지고 있다. 연구자는 노동인권교육에 대한 신념과 열정으로 각자의 분야에서 노동인권교육을 실현하고 있는 학교 안팎 전문가들의 노동인권교육 인식과 실천을 이해하고자 하였다. 노동인권교육이 학교 현장에 안정적으로 자리잡기 위해서는 ‘학교 밖’에서 논의되고 있는 노동인권교육 관련 이론적 담론 내지는 추진 중인 정책들이 ‘학교 현장 안’에서는 어떻게 이해되고 실천되는지를 비교 및 분석하는 과정이 필요하다고 보았기 때문이다. 이를 위해 설정된 연구 목적은 다음과 같다. 학교 안팎 전문가들의 노동인권교육 인식 및 실천에 대한 질적 사례연구를 통해 인식과 실천을 형성하는 맥락을 이해하고 유형화해봄으로써 학교 안팎에서 이루어지는 노동인권교육에 대한 시사점과 함의를 도출하고자 한다. 연구 목적에 따라 학교 노동인권교육을 적극적으로 실천하는 동시에 노동인권교육의 활성화를 위해 노력하는 현장 교사와 정책 담당자 또는 이론가를 연구 참여자로 선정하고자 하였다. 이에 따라 노동인권교육 교육자료 개발에 참여하거나 노동인권교육을 실천의 우수 사례로 추천을 받은 중등 사회과 교사 즉, 학교 안 전문가 6명과 청소년 노동인권 또는 노동교육 유관 기관 및 연구원에서 노동인권교육 관련 정책과 연구를 담당하고 있는 학교 밖 전문가 5명, 총 11명을 대상으로 심층 면담을 실시하였다. 본 연구는 면담이 주요한 자료수집 방법으로 사용되었으나, 노동인권교육 경험의 심층적인 이해를 도모하기 위해 공식적(노동인권교육 관련 정책 보도자료, 정책 연구 보고서, 실태조사 및 연구 보고서, 사업 계획서, 노동인권교육 지원 및 활성화 조례, 교육청 교사연수 자료집, 노동인권 교육자료, 상담사례집) 또는 비공식적 문서(교수학습지도안, 수업 ppt 자료, 학습활동지, 학생들이 작성한 학습 활동지 결과물, 학생 작성 보고서 등) 등 다양한 정보의 원천을 수집 및 분석하였다. 또한, 자료 분석 과정에서 학교 안팎 전문가들의 인식과 실천에 영향을 미치는 맥락을 함께 제시하고자 하였다. 노동인권교육에 관한 학교 안팎 전문가들의 “인식”은 크게 두 가지로 분류될 수 있었다. 현재와 미래의 노동자인 학생에게 실질적이고, 직접적인 도움을 주고자 하는 ‘실용’적 인식과 노동을 통해 사회를 바라보는 관점을 심어주고자 하는 ‘관념’적 인식이다. 실용적 관점에서의 노동인권교육은 학교 노동인권교육의 목표를 학생들이 노동 현장에서 스스로의 권리를 보호하는 데 도움을 주는 것에 두고 있다. 교육의 핵심 내용과 주제도 노동자의 권리, 부당 노동 피해 사례, 노동 현장에서의 구제 방법과 수단 등으로 제시하고 있다. 한편, 관념적 인식의 전문가들은 학교 노동인권교육을 통해 우리 사회에 만연해 있는 노동에 대한 부정적 인식을 개선하고, 노동 존중 사회로 나아가는 데 교육 목표를 두었다. 이에 따라 학교 노동인권교육의 핵심 내용이나 주제는 노동의 의미와 가치, 노동 존중 의식, 노동의 관점 등이 중요하다고 보았다. 학교 노동인권교육의 “실천” 모습은 소속 기관, 소속 기관의 문화, 업무 및 교직 경력, 고용 형태 등 개인의 실천에 영향을 주는 외부적 배경에 따라 크게 ‘종속’, ‘갈등’, ‘이상’으로 분류해 볼 수 있었다. ‘종속’은 학교 노동인권교육에 관한 개인적 신념을 가지고 실천에 옮기고자 하나 소속 기관의 구속력, 고용 형태, 경력 등에 의해 실천 과정에서 제약에 부딪히며 현실에 순응하거나 타협하는 모습을 보인다. ‘갈등’은 학교 노동인권교육에 관한 이념을 능동적으로 실행하지만, 소속 기관 내의 문화 또는 분위기에 영향을 받아 실천 과정에서 여전히 주체적이지 못하고 방황하고 있다. ‘이상’은 외부 환경적 제약으로부터 자유롭기 때문에 자신의 노동인권교육 이념과 이상을 실천으로 옮기고 있다. 학교 노동인권교육의 “인식 범주 – 실용, 관념 – 에 따른 실천”의 양상은 네 가지 유형으로 도출되었다. 연구자는 (1) 순응형, (2) 타협형, (3) 갈등형, (4) 이상형으로 명명하였다. (1) 순응형은 실용적 관점에서 노동인권교육을 실천하고자 하나 소속 기관의 문화, 업무 및 교직 경력, 고용 형태 등의 외부 요인의 영향과 노동인권교육의 교수학습의 어려움으로 혼란 속에서 노동인권교육을 실천하고 있는 유형이다. (2) 타협형은 관념적 관점에서 노동인권교육을 접근하고 실천하려 하지만 소속 기관의 구속력과 교육 현장에 대한 이해 부족으로 현실에 절충하면서 노동인권교육을 실천하는 유형이다. (3) 갈등형은 본 연구에서 실용적 관점에서만 나타났으며, 소속 기관의 문화 또는 분위기에 영향을 받고 실용 그 이상의 노동인권교육에 대한 고민을 해결하지 못한 채, 실천 과정에서 표류(floating)하고 있는 유형이다. (4) 이상형은 본 연구에서는 관념적 인식에서만 나타났으며, 외부 제약으로부터 자유로워 노동인권교육의 인식과 이상을 현실에서 실현하고 있다. 또한, 다른 유형이 호소하는 실천 상의 어려움을 오히려 학교 노동인권교육 정착의 과정으로 보며, 낙관적으로 조망하고 있는 유형이다. 본 연구는 전문가들의 인식과 실천 모습과 이에 따른 유형화 결과를 토대로 학교 노동인권교육에 관한 인식과 실천이 학교 안에서, 학교 밖에서 각각 ‘어떠한’ 양상으로 ‘왜’나타나는지 맥락에 따라 살펴본 후, 이를 비교하여 어떠한 차이가 있는지 분석하고자 하였다. 이를 통해 향후 지속 가능한 노동인권교육에 관한 가능성과 실천 과제에 대한 함의를 얻고자 하였다. 학교 안 전문가의 경우, 노동인권교육에 관한 인식이 ‘실용’에 집중되어 있음을 확인할 수 있다. 이는 학교 안 전문가들이 교육의 필요성을 학생으로부터 찾고 있기 때문이다. 대부분의 학교 안 전문가들은 개인적 경험으로부터 학생들이 현재의 노동자임을 깨닫고, 노동인권교육의 중요성을 인식하게 된 것이다. 한편, 학교 안 전문가들의 실천은 ‘종속’, ‘갈등’, ‘이상’에 고르게 배치되어 있었다. 주목할 만한 점은‘종속’에서 ‘이상’으로 갈수록 학교 분위기가 자유롭고 수평적이며, 입시에 대한 부담이 덜한 편이며, 고용 형태가 안정적이고, 교직 경력이 높으며, 교사의 수업권과 자율성이 보장되고 있다는 것이다. 학교 안 전문가의 노동인권교육의 인식에 따른 실천은, ‘실용’적 인식을 가질수록 인식과 실천의 간극을 많이 경험하고 있다. 이는 앞서 논의된 바와 같이, 노동을 실질적인 의미에서만 다루다보니 노동과 관련된 사회적 쟁점이나 노동관에 대한 내용, 혹은 노동 관련 심화된 내용을 학생 흥미에 맞게 교수하는 것에 대해 교사들이 부담을 갖고 있음을 알 수 있었다. 한편, 학교 밖 노동인권교육의 경우, ‘관념’적 인식에서의 노동인권교육이 지배적이었다. 노동과 관련된 오랜 경험이 노동인권교육에서 노동의 사회적 의미와 가치, 노동관을 강조하는 데 영향을 미치고 있는 것임을 확인할 수 있었다. 그러나 실천만 보면, ‘종속’과 ‘이상’으로 이분화되었다. 행정 기관에 소속되어 있는 전문가일수록 실천이 ‘종속’적이었는데, 이는 소속 기관의 구속력이 전문가들의 실천에 있어 영향을 미치고 있음을 보여주는 것이다. 한편, 인식에 따른 실천 유형은, ‘관념’적 인식을 가졌을 때, 현실에 타협하고 있는 유형이 나타남을 확인할 수 있다. 이는 학교 노동인권교육에 관한 업무를 하면서 학교 현장에 대한 이해의 어려움이 한계로 작용하는 것이다. 학교 안과 밖에서의 두드러진 차이는 노동인권교육에 대한 ‘인식’이었다. 학교 안팎의 이상형을 제외하고는 학교 안 전문가들은 ‘실용’적 관점에서의 실천의 지점에, 학교 밖 전문가들은 ‘관념’적 인식에서의 실천에 위치하고 있다. 학교 안에서는 노동인권교육 교수의 어려움으로, 학교 밖에서는 교육 현장에 대한 이해 부족으로 인식과 실천 상의 간극을 느끼고 있는 것이다. 학교 안과 밖에서 각자 열의를 가지고 노동인권교육을 실천하였지만, 정작 학교 안 전문가들은 학교 밖을 넘어서지 못하고, 학교 밖 전문가들은 학교 안을 들여다보지 못하고 있었던 것이다. 본 연구의 결과를 통해 학교 현장에서의 노동인권교육에 대한 인식, 실천, 학교 노동인권교육의 성공적 안착의 시사점을 얻을 수 있었다. 첫째, 노동인권교육에 관심을 갖고 실천하고자 하는 교사들이 중학교 자유학기제 및 고등학교 통합사회와 자율활동 시간에 활용할 수 있는 내용과 방법이 구체화된 교수학습 자료나 프로그램이 요구된다. 이는 학교 현장에서의 어려움에도 불구하고 소신 있게 노동인권교육을 실천하는 교사들뿐만 아니라 노동인권교육을 도전하고자 하는 교사들이 안정적인 교육적 실천을 하도록 도움을 줄 것이다. 둘째, 학교 안과 밖의 노동인권교육 소통의 장(場)을 통해 노동인권교육에 관한 이론적 담론의 실효성을 마련할 필요가 있다. 학교 안과 밖의 활발한 상호작용은 이론과 실천의 연계 가능성을 도모하고, 학교 노동인권교육의 성공적 정착을 위한 담론을 풍부하고, 안정적으로 형성하는 토대가 될 것이다. 셋째, 학교 안팎에서 노동인권교육을 하고 있는 전문가들의 신념, 노력 그리고 헌신이 개인의 노동 상황으로 무산되지 않도록 제도적인 보장과 학교 노동인권교육에 관한 구체화된 역할 분배가 요구된다. 본 연구의 결과가 조화롭고 균형있는 학교 노동인권교육을 위한 통찰을 제공할 수 있기를 간절히 기대한다.;While the working teenagers are increasing, their labor rights remain in a blind spot. Many teenagers are not required to sign employment contract and are exposed to verbal abuse, assault and sexual harassment at their working places and are either unilaterally fired or are not paid for their legitimate labor (Song Tae-soo and Lee Won-hee, 2018a). The issue of labor rights violations by field trainees at specialized high schools has long been not eradicated (National Human Rights Commission, 2017). However, most of the students are passive, such as quitting their jobs or holding up. Under these circumstances, the death and accident cases of specialized high schools have been brought to light again, and there are social movements such as accusing teenagers of violating their labor rights as 'tissue workers' (Seoul Shinmun, 2019.05.28). It is encouraging in that there is a growing concern and interest in youth labor realities. However, this also means that youth labor was not fully discussed as a social agenda until the problem arose. Youths are socially, economically and physically weak, and they need to receive institutional guarantees and protection even in the working environment. Meanwhile, a number of survey results (Ministry of Gender Equality and Family, 2016 and 2018; Song Tae-soo and Lee Won-hee, 2018a; Yoo Hyung-keun, 2018) clearly show a lack of youth Labor Rights Education. While the widening debate on improving the working reality of youths and protecting Labor Rights, the general consensus is that Labor Rights Education should be dealt with within the "school" system, among other things. Students also directly demand the need for Labor Rights Education (Song Tae-soo and Lee Won-hee, 2018a). It is true, however, that so far in our education, we have faced direct labor youth and students in need of Labor Rights Education, but have not been able to break away from post-prescription Labor Rights Education. Accordingly, interest in school Labor Rights Education and efforts to settle in school education are being developed inside and outside of the school. The education offices and related agencies actively discuss and report on Labor Rights Education materials and programs, training teachers, and research reports on Labor Rights Education based on the basis of policy. On the other hand, at the school site, Labor Rights Education is being conducted either through the curriculum or through comparison and time, with teachers recognizing the seriousness of the youth labor reality and the need for Labor Rights Education. As the researcher, I wanted to understand the perceptions and practice of Labor Rights Education by experts in and outside the school who are practicing it in their respective fields with their beliefs and passion for Labor Rights Education. This is because the process of comparing and analyzing how Labor Rights Education, which is discussed outside of school, is understood and implemented in the theoretical discourse or implementation of policies related to Labor Rights Education, was required for stable settlement at the school site. The study objectives set up for this are as follows. Through qualitative case studies of the perception and practice of Labor Rights Education by experts inside and outside the school, I will try to come up with implications for Labor Rights Education conducted inside and outside the school by understanding and categorizing the context in which perception and practice are formed. The purpose of this study was to select field teachers, policy personnel, or theorists who actively practice Labor Rights Education at schools and at the same time strive to revitalize Labor Rights Education as research participants. Accordingly, in-depth interviews were conducted with six social studies teachers, or teachers, who participated in the development of Labor Rights Education materials or were recommended as excellent examples of Labor Rights Education, and five outside-school experts in charge of policies and research on labor rights in youth or labor education related institutions and researchers. Although interviewing was used as a major method of data collection, the study included formal (policy press release on labor rights education, policy research report, status survey and research report, business plan, ordinance on support and activation of labor rights education, training materials for teachers at the education office, teaching materials on labor rights, teaching aids, counseling sessions, etc.) or informal documents (teaching aids, teaching activities, students’results) In addition, the purpose of the data analysis process was to present a context that affects the perception and practice of experts in and out of schools. The ‘recognition’ of experts in and out of schools on Labor Rights Education could be largely divided into two categories. It is a ‘practical’ perception to provide practical and direct help to students who are now and future workers, and an ‘conceptual’ perception to instill a view of society through labor. From a practical point of view, Labor Rights Education in schools is aimed at helping students protect their own rights in the workplace. The core contents and topics of education are also presented as workers' rights, cases of unfair labor damage, and methods and means of relief at the labor scene. Meanwhile, experts of conceptual perception set their educational goals on improving the negative perception of labor prevalent in our society through school Labor Rights Education, and moving toward a labor-respecting society. Accordingly, the core contents or topics of the school's Labor Rights Education were considered important, such as the meaning and value of labor, the consciousness of respect for labor, and the perspective of labor. The practice of the school's Labor Rights Education was largely categorized as ‘Subordinate’, ‘Conflict’ and ‘Ideal’, depending on external backgrounds affecting individual practice, such as the organization's culture, work and teaching experience, and the form of employment While ‘Subordinate’ was intended to put into practice with a personal belief in the school's Labor Rights Education, it was constrained by the constraints of its institutions, employment forms and careers, and appeared to conform or compromise to reality. Although ‘Conflict’ actively executes ideology on school Labor Rights Education, it was still unselfish, wandering and conflicted in the course of practice, influenced by the atmosphere within its institutions. Since ‘Ideal’ is free from external environmental constraints, it was moving its ideology and ideals of Labor rights Education into practice. The ‘pattern of practice under the recognition category of Labor Rights Education – practical, conceptual –’ has been derived into four types. The researchers were named (1) Conformity, (2) Compromise, (3) Conflict, and (4) Ideal. (1) Conformity type is the type of Labor Rights Education in confusion due to the influence of external factors such as the culture, work and teaching experience of the institution, and employment form of the institution in order to practice Labor Rights Education from a practical point of view. (2) Compromise type is a type of education intended to approach and practice Labor Rights Education from a conceptual point of view, but to compromise reality due to the constraints of its institutions and difficulties in understanding the educational site. (3) Conflict type appeared only from a practical point of view in this study, and it is a type that has been drifting in the course of practice, influenced by the culture and atmosphere of its institutions and has not solved its concerns about Labor Rights Education beyond practicality. (4) Ideal type is free from outside constraints, and realize the perception and ideal of Labor Rights education. In addition, they are optimistic about the future of Labor Rights Education. Based on the perception and practice of experts and the resulting tangible results, this study explored aspects of school Labor Rights Education in and outside the school, and compared them to analyze the difference. It was intended to derive implications for the feasibility and practical tasks of sustainable Labor Rights Education in the future. In the case of experts in schools, it can be confirmed that awareness of Labor Rights Education is focused on ‘practical'. This is because experts in schools are finding the need for education from students. Most school experts have come to realize from personal experience that students are current workers and recognize the importance of Labor Rights Education. On the other hand, if you look at the reality of experts in the school, they were evenly placed in ‘Subordinate', ‘Conflict’ and ‘Ideal’. What's noteworthy is that the increasingly ‘Subordinate’ to ‘Ideal’ school atmosphere is free and horizontal, less pressure on entrance exams, stable employment forms, high teaching experience, and guaranteed teachers' right and autonomy. Practice based on the perception of Labor Rights Education by experts in schools is experiencing many gaps between perception and practice as they have a ‘Practical’ perception. This, as discussed earlier, only in practical terms showed that teachers were burdened with labor-related social issues, labor-related content, or labor-related deepening. On the other hand, in the case of Labor Rights Education outside of school, Labor Right Education in ‘conceptual’ dominated. It could be confirmed that the long experience related to labor is affecting the social meaning, values and views of labor in Labor Rights Education. But in reality, it was divided into ‘Subordinate’ and ‘Ideal’. This could be seen as having an impact on the practice of the agency's binding experts. On the other hand, it can be found that the type of practice that is perceived by recognition, when it has an ‘conceptual’ perception, shows the type that is compromising on reality. The difficulty of understanding school sites is limited in their work on Labor Rights Education. The marked difference between inside and outside the school was the perception of Labor Rights Education. Except for the ideal type inside and outside the school, school experts are at a point of practice from a ‘Practical’point of view, while outside the school is at a point of practice from an ‘conceptual’ perception. Due to difficulties in the teaching method of Labor Rights Education, outside of schools, they feel a gap in perception and practice due to lack of understanding of the educational site. Through the results of this study, the researcher was able to obtain the implications of the successful settlement of Labor Rights Education at school sites. First, Teaching matarials or programs are required to generalized and specify contents and methods that can be used by teachers interested in or try to teach Labor Rights Education. This will help teachers who want to challenge Labor Rights Education, as well as those who practice Labor Rights Education with confidence, despite difficulties on the school scene. Second, it is necessary to prepare the efficacy of theoretical discourse on Labor Rights Education through the field of communication of Labor Rights Education in and out of schools. This will serve as the basis for the Labor Rights Education to promote the possibility of linking theory with practice through active interaction inside and outside the school, and for the rich and stable formation of discourse for the successful settlement of the Labor Rights education in schools. Third, the belief, efforts and commitment of experts in Labor Rights Education with conviction in and out of schools are required to ensure institutional guarantees and distribution of specific roles in school Labor Rights Education so as not to be thwarted by individual labor situations. I am very much looking forward to the results of this study to provide insight for a harmonious and balanced Labor Rights Education based on school.
