노인 주거·의료복지시설에 관한 판례 분석

Abstract

The purpose of this study is to discuss the improvement plan for the welfare system for the elderly, which becomes increasingly significant in the context of Korea as the aged society. In spite of the rapid increase in the elderly population, the traditional values of respecting the elderly ​​and the informal support system have weakened. Therefore, the studies on the elderly welfare policy as an official support network, especially the legal institution of the elderly welfare policy is considered to be necessary. Moreover, case analysis is a research method for various social welfare law systems to explore abundant literature materials presenting the interpretation conflicts among each party and the problems that need improvement beyond the superficial studies of legal system and to apply the system in our reality, thereby having a participatory implications that can reflect the social welfare viewpoint for the legal research. This study conducts a case study on elderly housing and medical welfare facilities in the elderly welfare law system, in particular, the elderly welfare law and the elderly long-term care insurance law, considering the significance of the necessity of the studies on the elderly welfare legal system and its relevant case analysis. The purpose of this study is to identify the legislative direction of the elderly welfare law system which reflects the need to examine the blind spot in the application of the elderly welfare law system and its supplement based on actual cases. In particular, this study is to propose a policy implication and direction that reflects the reality from the perspective of the party who is applied to the welfare system of the elderly by carrying out a study that combines social welfare viewpoint and legal viewpoint. Therefore, in order to reflect the legal point of view, Cannon's framework is used to analyze the degree of involvement of decision makers in forming social welfare policy. In order to analyze welfare perspective, the framework is organized with the three following analysis items: (1) fact check (2) Social welfare issues, (3) Problems and improvement plans in precedents. The analyzed precedents are obtained by purchasing the copyright of the legal case database ‘Beopgoeul LX 2016’ of the court library to collect the original data. The facts from the lower instances are also collected from the LAWnB, the Supreme Court Portal, and the Legislative Office Homepage when necessary. The literature review is conducted in terms of the current status and problems of the elderly welfare legislation, review of the elderly welfare law, review of long-term care insurance for the elderly, and policy formation function of judgments based on judicial activism. Two final decisions of the Constitutional Court, two Supreme Court decisions, and a local court decision are analyzed based on the analysis from Canon's framework and the analysis from social welfare perspective, and the two-track analysis. The results are presented for each analysis case. Then, the comprehensive conclusions and suggestions are presented. On a basis of the legal perspective and the implications of the welfare perspective derived from the analysis of each case, this study tried to present various problems and improvement plans for the current welfare law of the elderly in a macroscopic perspective. In other words, the study attempts to examine the implications for the improvement plans by analyzing the cases, the opinion of the judiciary which can affect the change of the welfare law of the elderly in terms of the study of the welfare policy of the elderly to propose problems and the improvement plans. This study has an implication for social welfare policy in that it tries to apply the case study analysis to elderly welfare in addition to the field of social security basic law, child welfare and employment welfare.;본 연구는 고령사회의 현실을 목도하고 있는 우리나라의 상황에서, 그 중요성이 커지고 있는 노인복지법제의 개선방안에 관하여 논하는 것을 목적으로 한다. 노인 인구는 급격하게 증가하고 있음에도 불구하고 노인 공경 의식 등 전통적인 가치관과 비공식적인 지지망은 약화되고 있는 현실 속에서 공식적인 지지망으로서 노인복지정책, 특히 노인복지정책을 실질적으로 제도화한 형태인 노인복지법제에 관한 연구가 반드시 필요한 시점이라고 판단한 것이 본 연구의 배경이다. 또한 판례 분석 연구는 각종 사회복지법제 관련 연구를 수행하는 연구 방법으로서, 법제의 피상적인 연구에서 탈피하여 우리가 처한 현실 속에서 제도를 적용함에 있어서 이해당사자 간의 해석에 다툼이 되고 개선이 필요한 부분을 생생하게 보여주는 문헌 자료를 연구하는 것이기 때문에 법제 연구 중 사회복지적 관점을 반영할 수 있는 현실참여적 의미를 가지는 연구방법이다. 따라서 본 연구는 노인복지법제 연구의 필요성과 판례 분석 연구의 유의미성을 바탕으로 노인복지법제, 특히 노인복지법제 중 주요법인 노인복지법과 노인장기요양보험법의 노인주거·의료복지시설 관련 판례 분석 연구를 수행하였다. 이에 따라 노인복지법제 적용에 있어서의 사각지대를 발견하고 보완해야 부분 및 복지적 관점을 반영한 노인복지법제의 입법 방향을 실제 사례인 판례를 통해서 도출하는 것을 목표로 하였다. 특히 본 연구는 사회복지적 관점과 법적 관점을 융합한 연구를 수행하여 노인복지법제의 적용을 받는 당사자의 입장에서 필요한 현실을 반영하는 정책적 함의 및 방향을 제시하고자 함을 특징으로 한다. 그러므로 법적 관점을 반영하기 위하여 판결기관의 사회복지정책 형성 참여 정도를 분석하기 위하여 개발된 캐논(Cannon)의 분석틀을 이용하여 1차 내용 분석을 수행하였고, 복지적 관점을 반영한 분석을 위하여 ① 사실관계의 검토, ② 사회복지적 쟁점 사항, ③ 판례 도출 문제점 및 개선방안 세 가지의 분석유목으로 분석틀을 구성하여 2차 내용 분석을 수행하였다. 분석 판례는 법원도서관의 판례 데이터베이스 ‘법고을 LX 2016’의 저작권을 구매하여 원문 자료를 우선 수집하였고, 부차적으로 하급심 판례의 사실관계 파악이 필요할 경우 LAWnB, 대법원 종합법률정보 홈페이지, 법제처 홈페이지를 통하여 자료를 수집하였다. 연구에 앞서 선행 연구 검토는 노인복지법제의 현황 및 과제, 노인복지법의 검토, 노인장기요양보험법의 검토, 사법적극주의에 의한 판결의 정책형성기능으로 나누어 수행하였다. 최종적으로 수집한 헌법재판소 결정 2건, 대법원 판결 2건, 지방법원 판결 1건을 캐논(Cannon)의 분석틀에 의한 분석, 사회복지적 관점 분석틀에 의한 분석, 2가지 경로를 거치는 흐름에 따라 수행한 결과를 각 분석 판례별로 제시하였다. 그리고 이에 따른 종합적 결론과 제언을 제시하였다. 각 판례의 내용 분석에서 도출된 법적 관점과 복지적 관점의 시사점을 통해 현 노인복지법제가 가지고 있는 문제점과 개선방안을 거시적인 시각으로 다양하게 제시하고자 하였다. 즉 노인복지정책 연구에 있어 노인복지법제의 변화에 영향을 미칠 수 있는 사법부의 견해인 판례를 분석함으로써 개선방안에 대해 어떠한 함의를 가지는지 도출하고자 하였고, 이를 바탕으로 노인복지법제의 사회복지적 관점의 쟁점사항을 도출하고 문제점 및 개선방안을 제시하고자 하였다. 본 연구는 사회보장기본법, 아동복지, 고용복지 영역에서 시도되었던 판례 분석 연구를 노인복지분야에도 시도하고자 하였으며, 이에 따른 개선방안을 제시하였다는데 사회복지정책적 의의가 있다.
