미술품 경매거래에 관한 법률관계 연구

Abstract

본 논문의 목적은 미술품 경매거래에 관한 법률관계 및 이와 관련하여 발생하는 각종 법적 문제들에 대해 연구하는 것에 있다. 최근 미술품에 대한 관심이 높아지면서 일반대중들의 미술에 대한 접근이 용이해져 미술품 거래에 대한 관심과 수요가 꾸준히 증가함에 따라 미술품 거래가 급증하게 되었다. 여전히 화랑 등을 통한 직접거래가 상당한 비중을 차지하고 있지만 경매거래 또한 급증하고 있는 실정이다. 미술품 경매는 직접거래나 화랑을 통한 거래 보다 미술품의 미적 가치와 가격간의 상관관계를 예측하는데 있어 비교적 안정된 정보를 제공한다. 또한 그 가격은 투명하게 공개되기 때문에 미술품 경매를 통한 판매기록은 미술품 가격의 불확정성을 보다 감소시킨다. 경매거래의 이러한 특성은 미술품 시장의 안정화, 선진화에 기여하고 있다. 미술품 거래에 대한 보편화된 사회적 인식은 결과적으로 미술품 거래를 활성화시킴과 동시에 위작 거래의 문제 등 그에 따른 각종 법적 문제들을 파생시켰다. 이에 본 논문은 미술품 경매거래에 관한 법률관계를 살펴보고자 한다. 먼저 미술품 거래의 전반적인 법률관계의 특성을 살펴보고, 이에 기해 미술품 경매거래관계를 구체적으로 검토하고자 한다. 거래 목적물로서의 미술품은 일반 재화와 달리 가격 형성이나 가치 평가의 기준이 불확실하고 진본성의 문제, 희소성, 대체불가능성 등의 특성을 지니고 있다. 따라서 이에 대한 고려가 거래 뿐만 아니라 추후 법적 문제가 발생했을 경우에 책임여부를 판단할 때에도 요구될 수 밖에 없다. 그러나 현재 우리나라의 경우 이에 대한 체계적인 연구가 많지 않으므로 미국, 프랑스 등 외국의 사례를 비교법적으로 살펴보는 것이 필요하다. 특히 미술품 거래에서 위작의 시비는 끊이지 않고 계속 발생한다. 미술품 거래의 특성상 위작에 대한 위험성은 항상 존재하기 때문에 이에 대한 규율이 필요하며 미술품 거래에서 미술품에 대한 가치평가는 매우 중요한 위치에 있다. 최근 우리나라에서도 미술품 유통시장의 공정한 거래 관행을 확립하고 위작 범죄를 억제하고자 하는 노력의 일환으로 문화체육관광부는 ‘미술품 유통 거래 투명화 및 활성화 대책’을 발표했다. 이는 아직 시작단계로서 각각의 조항들이 현재 미술시장의 저항을 감안해 미진한 수준에 머물러 있어 구체적인 법률로써 제정되기에 부족한 부분이 많아 보완이 필요하다. 이러한 상황에서 본 논문은 경매거래를 포함한 미술품 거래와 관련하여 발생할 수 있는 각종 법적 문제들을 살펴보고, 그에 적절한 법적 대응에 대해 검토하여 미술시장에 투명성, 안정성, 예측가능성을 제공하는데 그 의의가 있다.;The purpose of this study is to look into legal problems that arise from art auctions and the legal issues involved. The recent increase of interest in artworks has made them more accessible to the general public, which, in turn, led to a steady rise of interest in, and demand for, buying and selling works of art. These changes resulted in the rapid expansion of the artwork market. Although majority of transactions still take place directly between sellers and buyers, often with the mediation of art galleries, an increasing number of artworks are being traded through auctions. Compared with one-on-one transactions, an art auction offers more stabilized information on the correlation between the artistic value of a work and its price. In addition, sales records from art auctions mitigate the indeterminacy of artwork prices by transparently disclosing the prices of auctioned artworks. These benefits contribute to the stabilization and advancement of the artwork market. The heightened interest in art transactions not only effectively revitalized the artwork market but also gave rise to a plethora of legal issues such as forgery. This study focuses on legal issues that arise from art auctions. It first analyzes the characteristics of legal issues involved in art transactions in general, and then moves to a more detailed review of legal issues specific to art auctions. As an object of transaction, an artwork is characterized by uncertainties in pricing and appraisal, the issue of authenticity, rarity, and irreplaceability. These characteristics should be considered in determining liabilities in legal disputes that arise from art transactions, as well as when conducting transactions. As systematic researches on these issues are relatively lacking in Korea, a review of related cases in the United States, France, and other countries is required. Most art transactions are exposed to risks of being implicated in forgery scandals. These ever-present risks need to be regulated, and putting a great emphasis on the importance of appraisal in art transactions should be considered. As a part of its efforts to ensure fair trade practices in the artwork market and to crack down on artwork forgeries, the Ministry of Culture, Sports and Tourism announced the “Plan for the Transparency and Revitalization of Art Transactions”. The plan is still nascent, and many of its provisions have been toned down to mitigate possible oppositions from the market, which means that the plan needs to be improved in many respects before it can be translated into a legislation. Against the backdrop described above, this study overviews a number of legal issues involved in art transactions, including art auctions, and proposes appropriate legal responses to those issues so as to ensure the transparency, stability, and predictability of the artwork market.
