A Study of Chhaupadi Pratha (Menstrual Discrimination) in Nepal

Abstract

‘Chhaupadi Pratha’ is a cultural practice that violates the rights of women and girls especially in the mid and far- western regions of Nepal. Women and girls during their menstruation periods are forced to live in a menstruation shed, cowshed or in tiny rooms until their periods are over. Besides the isolation from family and society, menstruating women and girls are also restricted from participating in day-to-day activities such as cooking, taking baths, using communal water resources, touching male members and engaging in any religious or social gathering. This paper attempts to study the causes and consequences of the practices and provide policy suggestions to remove the gender-based violence. Therefore, the paper analyzes the followings: First, it explores the impacts of Chhaupadi Pratha on the health of women and girls during their menstruation period. Second, it examines the root causes of the serious discriminatory practice against women and girls especially in the mid and far western regions. Third, it explains why Chhaupadi Pratha continues even if it has been declared illegal by the government of Nepal and it provides policy recommendations to eradicate the Chhaupadi Pratha. This paper argues that Chhaupadi Pratha is a serious form of discrimination against women and girls, which is deeply embedded, in the patriarchal Hindu culture and the caste-based hierarchy of Nepali society. Also, Chhaupadi Pratha is reinforced as the gender inequality interacts with poverty and low education of people. The paper addresses that much of the government’s efforts to eradicate Chhaupadi Pratha have been in vain mainly with the following reasons: (1) lack of programs targeting the elimination of root-causes of the practice, (2) insufficient budget to implement designed Chhaupadi eradication programs, (3) lack of participation of community members including women and girls, local community leaders, and religious leaders, (4) difficulty in monitoring the eradication projects/programs in affected areas due to the poor transportation situations in the country, and (5) deficiency of punishment for practicing Chhaupadi Pratha.;'Chhaupadi Pratha'는 특히 네팔의 중서부지역에서 여성과 소녀들의 권리를 침해하는 문화적 관습이다. Chhaupadi 의 관행으로 생리중인 여성과 소녀들은 허름한 오두막이나 외양간, 혹은 아주 좁은 방에서 생리가 끝날 때까지 거주해야 한다. 그 밖에도 그들은 생리기간 동안 가족과 사회로부터의 고립될 뿐 아니라 요리, 목욕, 공동 수자원 사용, 남성 접촉, 종교적 또는 사회적 모임 참여와 같은 일상 생활활동에 참여하는 것이 제한된다. 이 논문은 Chhaupadi Pratha 의 원인과 그것이 여성에게 미치는 영향에 대해 분석하고 그러한 성 차별적 관습을 없애기 위한 정책적 제안을 제시하고자 한다. 따라서 이 논문의 다음의 세가지를 다루고 있다. 첫째, Chhaupadi Pratha 가 생리중인 여성과 소녀의 건강에 미치는 무엇인가. 둘째, 네팔의 중서부 지역에서 행해지고 있는 이러한 심각한 차별적 관습의 근본적 원인은 무엇인가. 셋째, 네팔정부가 Chhaupadi Pratha 를 위법으로 선언했음에도 불구하고 지속적으로 행해지고 있는 이유는 무엇인가. 이 논문은 가부장적 힌두문화와 카스트제도에 기반한 네팔사회의 지배구조가 여성과 소녀에 대한 차별의 형태로 나타난 것이 Chhaupadi Pratha 라고 주장한다. 그밖에, 네팔의 빈곤과 낮은 교육수준이 사회내에 존재하는 성불평등과 연결되어 Chhaupadi Pratha 가 지속적으로 행해진다고 주장한다. 또한 Chhaupadi Pratha 를 철폐하기 위한 정부의 노력이 실패한 주요 원인은 다음과 같다: 이 관습의 근본적 원인을 제거하려는 프로그램의 부족 (2)정부의 예산 부족 (3)여성과 소녀, 지역 지도자들, 그리고 종교 지도자들을 참여시키는 프로그램의 결여 (4)네팔의 열악한 교통시설로 인해 각 지역에서 실시된 프로그램/프로젝트에 대한 모니터링의 어려움 (5)Chhaupadi Pratha 실시한 경우 그에 대한 처벌 미비 혹은 부재.
