법률비서 영문 이메일 연구

Abstract

EFL(English as a Foreign Language) 환경의 우리나라에서는 고객의 다양한 요구에 부응하기 위하여 국내외 로펌을 막론하고 영어에 능숙한 법률비서를 필요로 하고 있다. 특히 최근 법률시장의 급변하는 분위기 속에서 법률비서에게 상당한 수준의 영어 의사소통능력이 요구되고 있지만 기존에 로펌에서 사용하는 영어나 법률비서의 영어에 대해 연구된 바가 거의 없는 실정이다. 또 업무에 있어 인터넷과 이메일의 활용이 급격히 증가하면서 이메일을 정확하고 적절하게 쓸 수 있는 능력이 비서에게 요구되고 있어 법률비서 영문 이메일에 대한 체계적인 연구가 필요한 시점이다. 본 연구는 로펌에 근무하는 법률비서 영문 이메일 속에 빈번하게 사용되는 어휘와, 이메일의 대상, 주제, 장르 및 무브를 파악하고자, 다음과 같은 연구문제를 설정하였다. 연구문제1: 구축된 법률비서의 영문 이메일 코퍼스에서 워드리스트(word list) 및 엔그램(n-gram)를 선정한다면 어떠한 것들이 있는가? 연구문제2: 수집된 영문 이메일의 대상은 누구이며, 주제는 무엇인가? 연구문제3: 수집된 영문 이메일은 어떤 장르로 분류할 수 있으며, 장르별로 공통적으로 빈번하게 나타나는 무브는 무엇인가? 이를 위해 서울 소재 로펌에 근무 중인 법률비서 50인을 대상으로 이들이 업무상 실제 작성하는 영문 이메일 일주일 분량을 수집하고, 수집한 이메일 텍스트를 소규모 전문 코퍼스(small specialized corpus)로 코퍼스로 구축하였다. 연구 대상 이메일은 총 334편이었으며, 로펌 고객 정보와 관련된 기밀 사항이 유출되지 않도록 유의하여 자료를 전처리 하였다. 구축된 법률비서 영문 이메일 코퍼스를 기반으로 1단계 워드리스트 및 엔그램 분석연구에서는 코퍼스 소프트웨어 AntConc (버전 3.4.3)을 이용하여 워드 리스트와 엔그램 분석을 통해 각각 빈출 어휘 목록 50개 및 빈출 어휘구 목록 20개를 추출하였고, 추출된 어휘의 특징을 살펴보았다. 또 원어민 코퍼스인 Brown 코퍼스와 LOB 코퍼스 및 BLC(Business Letter Corpus)와 비교 분석한 결과, 최상위 빈출 어휘 20개 중, 12개가 일치하였으며, 특히 본 연구에서 구축된 법률비서 영문 이메일 코퍼스의 최상위 빈출 어휘 20개는, 비즈니스 영문 서적의 영문 편지를 모아 코퍼스를 구성한 BLC의 최상위 빈출 어휘 20개와 매우 유사함을 확인 할 수 있었다. 법률비서 영문 이메일 코퍼스에는 편지에서 자주 쓰이는 어휘가 많이 등장하였고, 로펌에서 실제 사용되는 영어 약어 및 존칭에 대해 살펴볼 수 있었다. 또 격식체 어휘가 많이 사용됨을 확인할 수 있었다. 2단계 이메일 장르분석 연구에서는 Ms Excel (버전 2010)을 사용하여 빈도분석 및 내용분석을 실시하여, 수집된 법률비서 영문 이메일이 누구를 대상으로, 어떠한 주제로 쓰여졌는지 그리고 장르를 구분하고, 장르별로 빈번하게 나타는 무브를 파악할 수 있었다. 수집된 법률비서 영문 이메일의 대상을 분석한 결과, 크게 회사 외부에 있는 대상과 내부에 있는 대상, 그리고 외부 대상과 내부 대상을 모두 수신인으로 하는 경우의 총 3가지 대상으로 분류할 수 있었고 각각 어떤 주제로 메일을 쓰는지 세부적인 내용을 알 수 있었다. 연구 결과, 42%의 이메일이 안내 장르에 속하여 가장 큰 비중을 차지하였고, 요청 장르 이메일은 전체의 18.2%였으며 답변 장르는 17.6%였다. 문의 장르는 전체의 10%로 가장 비중이 낮은 것으로 드러났다. 뿐만 아니라 두 가지 혹은 세 가지 장르가 동시에 나타나는 혼합된 유형을 기타 항목도 12.2%나 되어 하나의 이메일 내에 여러 장르가 혼재하는 양상을 볼 수 있었다. 이렇게 분류된 장르에서 각각 가장 빈번하게 나타난 무브를 분석한 결과, 법률비서 이메일은 장르별로 특정한 무브 패턴을 갖추고 있는 것을 볼 수 있었다. 본 연구를 통해 법률비서가 빈번하게 사용하는 어휘를 무엇이며 어떤 대상에게 어떤 주제로 업무 중 이메일을 작성하는지, 법률비서가 작성하는 이메일은 어떤 장르로 분류할 수 있는지, 그리고 장르별로 빈번하게 쓰인 무브를 살펴볼 수 있었다. 연구 결과는 법률비서의 영문 이메일을 이해하기 위한 기초적인 자료로 활용될 수 있을 것이며, 효과적인 영어업무를 하고자 하는 현직 법률비서와 법률비서 진출을 희망하는 학생들에게 본 연구에서 추출된 어휘 및 장르에 대한 지식이 유용하게 쓰일 수 있을 것이다. 분석에 사용된 샘플의 규모가 작아 법률비서가 작성하는 영문 이메일을 정확히 대표한다고 하기에 무리가 있지만, 법률비서가 일하는 현장에서 작성한 실제적 자료(authentic material)인 영어 이메일을 수집, 분석하여 로펌 비서의 영어 이메일 쓰기 사용이 반영된 텍스트를 통해 기초 자료를 제시함으로써 법률비서 영어연구에 대한 소중한 첫 발걸음을 떼었다는 점에서 의의가 있다. 이를 통해 법률비서의 영어 의사소통능력 향상을 위해 미약하게나마 기여할 수 있기를 바라며, 관련된 후속연구가 활발히 이루어지기를 기대한다.;In Korea, within the EFL (English as a Foreign Language) environment, law firms require legal assistants that are efficient in English in order to serve clients’ various needs. In the fast changing legal market, although high-level English communication skills are necessary for legal assistants, very few studies related to English used in law firms have been conducted. Furthermore, as usage of email and the internet are rapidly increasing, exact and appropriate usage of email is required for legal assistants and thus, a systematic study on the English emails of legal assistants is needed. This study set following research questions in order to comprehend vocabulary commonly used in English emails as well as topic, subject, genre and move of emails. Research question 1: What would be the word list and n-gram of established English emails corpus of legal assistants? Research question 2: Who is the intended recipient and what is the topic of collected Emails? Research question 3: What genre can the collected emails be sorted as and what is the common move? Working with 50 legal assistant currently based in Seoul law firms, real English emails written by them in a week have been collected and the collected emails have been established in corpus by small specialized corpus. The total number of emails used in the study was 334 and all emails were preprocessed to ensure there were no issues concerning confidentiality. Based on the established English email corpus, in the first stage of the word list and n-gram analysis, corpus software AntConc 3.4.3 ver. was used. Through an analysis of the word list and n-gram, a list of 50 frequently occurring vocabulary words and 20 frequently used phrases was extracted and analyzed. In addition, as a result of comparing native Brown corpus, LOB corpus and BLC (Business Letter Corpus), 12 out of the 20 most frequently used vocabulary words were matched. Twenty of the most frequently used vocabulary words identified in this study’s corpus turned out to be very similar to 20 of the most frequently used vocabulary in the BLC, which is a corpus established by gathering letters written in English taken from business English books. Vocabulary words frequently used in letters appeared in the English emails of the legal assistant corpus, while actual English abbreviations and titles were seen. Formal vocabulary words were also found to be frequently used. In the second stage of Email genre analysis study, MS Excel 2010 ver. was used for frequency and content analysis. This analysis found the target and subject of collected English emails of legal assistants, classified genre and recognized frequently used move in each genre. As a result of the analysis of collected English emails of legal assistants, targets were categorized into three. Outside and inside the firm and both outside and inside targets as recipients. Also, detailed contents of emails were recognized. According to the results of the study, information genre email accounted for the largest amount (42%), while request genre email and reply genre email accounted for 18.2% and 17.6%, respectively. Inquiry genre email accounted for only 10%. Furthermore, a mix of different genres accounted for 12.2%. From analyzing the most frequent move in the various genres, each genre of English emails written by legal assistants showed particular move patterns. This study identified the most frequently used vocabulary words by legal assistants, who the primary target is, the subject of the emails, which genre the emails of legal assistants belong to, and the most frequently used type of move. The results of this study can be used as a basis upon which to understand the English emails of legal assistants and how to train them. Knowledge extracted from this study’s vocabulary words and genres is expected to be useful for legal assistants currently working in the field and students who wish to become legal assistants. Although the number of samples used for the analysis is too small to accurately represent the English emails of legal assistants in Korea, this study is significant in that it collected and analyzed authentic English emails actually written by legal assistants and presented basic materials for the English language education of legal assistants based on texts reflecting English email usage by legal assistants. This study will hopefully contribute to the improvement of the English communication skills of legal assistants and active follow-up studies.
