콜먼의 실용주의 법이론에 대한 연구

Abstract

우리는 법이론을 통해 법의 체계와 내용을 명확하게 이해할 수 있으며, 빠르게 변화하는 법실무에 대응할 수 있다. 그러므로 다양한 법이론을 효과적으로 이해하고, 새로운 법이론을 정립하는 방법론을 고안해내는 것은 법이론의 발전과 더불어 법학 발전에 큰 도움이 된다. 이러한 발전에 기여한 미국의 법철학자 콜먼(J. L. Coleman)은 실용주의 방법론(pragmatic method)을 통해 자신만의 독창적인 법이론을 창시하였다. 본 연구는 콜먼의 실용주의 방법론을 소개함으로써 법에 대한 실용주의적 접근의 중요성을 강조하고자 한다. 실용주의 방법론은 프래그머티즘(pragmatism)과 하트 (H. L. A. Hart)의 분석법학(analytic jurisprudence)을 토대로 발전해 왔다. 콜먼의 실용주의 방법론은 고전적 프래그머티즘에 기초한 기존의 법실용주의(legal pragmatism)와 달리 의미론을 중시하는 현대적 프래그머티즘을 기반으로 한다. 그러므로 본 연구에서는 콜먼에게 결정적인 영향을 미친 현대적 프래그머티스트 콰인(W. V. O. Quine), 셀라스(W. S. Sellars), 퍼트남(H. W. Putnam)의 이론을 중심으로 실용주의 방법론의 철학적 기초를 탐구한다. 이를 바탕으로 콜먼의 법이론을 기존의 법실용주의자 홈즈(O. W. Holmes)와 포스너(R. A. Posner)의 법이론과 비교함으로써 콜먼식의 독창적인 실용주의 방법론을 부각시키고자 한다. 또한 콜먼이 하트의 분석법학에 어떠한 측면을 계승하여 발전시켰는지 탐구해 본다. 콜먼은 하트의 규칙으로서의 법개념을 계승하고, 드워킨(R. Dworkin)의 규범법학에 대항하여 분석법학을 옹호한다. 콜먼은 하트와 같이 언어철학적 방법을 중심으로 법개념을 설명하였으며, 자신만의 실용주의적 관점을 통해 실용주의적 개념분석(conceptual analysis)을 강조하였다. 한편 콜먼의 실용주의 방법론은 실정법의 해석과 적용에서 유용한 역할을 수행한다. 실용주의 방법론의 다섯 가지 특징은 법개념의 의미를 획득하고, 새로운 법이론을 정립할 수 있게 도와준다. 실용주의 방법론에 의하면, 우리는 개념들 간의 관계를 통해 개념의 의미를 확정하고(의미론적 비원자론), 실천에서 개념이 하는 역할을 추론하며(추론적 역할 의미론), 개념으로 구성된 실천이 구현한 원리를 포착함으로써 법개념의 의미를 알 수 있다(구현에 의한 설명). 또한 다른 법이나 영역에서 사용되는 개념의 내용을 고려하고(전체론), 법체계와 특수한 사회적 환경에 맞게 개념의 의미를 수정하여 확정할 수 있다(수정 가능성). 본 연구에서는 실용주의 방법론을 국내 형법이론인 신뢰의 원칙이론에 직접 적용하여 그 의의와 한계를 파악해 보고자 한다. 마지막으로, 실용주의 방법론에 기초하여 콜먼의 실용주의적 법실증주의를 분석할 것이다. 콜먼의 법실증주의는 관행테제(conventionality)와 포용적 법실증주의(inclusive positivism)의 입장으로 이루어져 있다. 콜먼은 승인의 규칙은 오직 공무원의 관행이 실천되었을 때에만 존재한다고 주장하는 '관행테제'를 창시한다. 하트의 법이론은 승인의 규칙의 의미가 불명확하고 법의 규범성을 설명하지 못한다는 비판에 직면해 왔다. 이러한 비판을 극복하기 위해 콜먼은 승인의 규칙의 존재조건으로서 실천을 강조하고 내적관점을 다시 고찰함으로써 사법 공무원들의 실천을 설명한다. 콜먼은 프래그머티즘의 실천과 전체론적 관점을 통하여 모호한 하트의 승인의 규칙을 명료하게 하고, 법의 가능성뿐만 아니라 법의 규범성에 대한 설명을 제공한다. 또한 콜먼은 포용적 법실증주의자로서 도덕적인 가치가 내재된 현실의 법실무를 인정하여, 합법성의 기준이 도덕적이라도 권위이론과 양립할 수 있다고 주장한다. 콜먼은 법실무를 고려한 전체론적 관점에서 포용적 승인의 규칙 하에서 유효한 일차규칙이 인식론적으로 행동을 지도할 수 있음을 근거로 포용적 법실증주의가 실질적 차이이론(practical difference thesis)과 양립할 수 있다고 주장한다. 콜먼은 법개념을 실천과 원리를 통해 파악하는 실용주의 방법론을 개발하고, 실용주의적 관점을 통해 하트의 법이론을 보완하여 법실증주의의 논리를 강화하였다. 따라서 법이론에 대한 콜먼의 실용주의적 접근법은 실정법의 해석과 적용에 도움을 줄 뿐만 아니라, 법철학적 탐구에 기여했다는 점에서 의의가 있다.;Legal theories enables us to understand the system and the content of law, and to deal with legal practice. A methodology helps us understand diverse legal theories and establish a new theory, so to design a methodology is essential to develop jurisprudence as well as legal theories. Jules L. Coleman, American legal philosopher, contributed greatly to jurisprudence through his original legal theory called 'pragmatic method.' This study is to emphasize pragmatist approach to law by introducing Coleman's method. Pragmatic method has developed on the basis of the pragmatism and H. L. A. Hart's analytic jurisprudence. In contrast with established legal pragmatism based on classical pragmatism, Coleman's method builds on contemporary pragmatism. First of all, this study is to review the methods of contemporary pragmatists ― W. V. O. Quine, W. S. Sellars, and H. W. Putnam. Based on the review, Coleman's original pragmatic method is to be highlighted, compared with the legal theories of previous legal pragmatists Holmes and Posner. This study proves that Coleman has further developed Hart's analytic jurisprudence. Coleman succeeds Hart's conception of law as the system of rules, and defends analytic jurisprudence against Dworkin's normative one. The same as Hart, Coleman explicates concept of law through linguistic philosophy and highlights the conceptual analysis from his own pragmatic point of view. Coleman's pragmatism analyzes concept through legal practice, so his concept analysis naturally premises the normative conception of law. Coleman's method plays a useful role in interpreting and applying the positive law. Five features of pragmatic method enable us to understand the meaning of the law and to establish a new theory of law. Pragmatic method helps to confirm the meaning of a concept through relationships among concepts (semantic-non atomism), to infer the concept's role in practice (inferential role semantics), and to know the contents of law by capturing the principle embodied in practice consisting of concepts (explanation by embodiment). In addition, the contents of a concept in other law and domain is to be considered (explanation by embodiment), and the meaning of a concept is to be revised and established in accordance with social circumstances (revisability). This study confirms the importance and the limits of pragmatic method by appling the method directly to the domestic criminal law theory, the principle of trust. Finally, on the basis of Coleman's method, his pragmatic legal positivism is to be analyzed. Coleman's legal positivism is on the conventionality and inclusive positivism. He defends conventionality thesis that the possibility of legal authority is explained by conventional social practice. Coleman's conventionality thesis makes clear Hart's rule of recognition through the emphasis on practice and explicates the possibility of legal authority as well as the normativity of legal authority. Coleman, as an inclusive positivist, claims that criteria of legality, which is moral, can be compatible with legal authority. He also suggests that inclusive positivism is compatible with the practical difference thesis by emphasizing the primary rules which can epistemically guide action under inclusive rule of recognition. Coleman grasps the concept of law through practice and principle and strengthens the positivism by supplementing Hart's legal theory. It can be concluded that Coleman's pragmatist approach to theory of law helps interpret and apply law and contributes to the philosophy of law.
