Abstract
It is not easy to decide which principle takes priority over other contradicting principles in the face of a concrete problem in biomedical ethics. In biomedical ethics, principles, which are normative declarations, only represent moral necessity. A principle does not have efficacy in virtue of being involved in a specific case. It can be excluded by other principles. Principles do have potential efficacy. It is, however, not clear to decide the purpose of a principle, the range of its possibility, and the limit of it. Principles are itself the standard of valuation and the forms and degree of their realization rely not only on a specific and concrete case but also on the range of normative and realistic possibility. As a result, there is a need to measure contradicting principles not only on their weight but also on their importance from a specific and concrete case. Balancing among contradicting principles is a useful concept because it deals with the importance of principles. It is a typical way of applying principles of forms of legal norms, which have potential efficacy. It is worth to consider balancing in biomedical ethics, since balancing among principles assumes the pluralism of values and is also a process of harmoniously realizing contradicting values or interests based on their importance. In this paper, I will introduce Robert Alexy’s balancing theory and then I will apply it to the two cases: one is a case of the Supreme Court Cases and the other is a reconstructed case from a view of biomedical ethics. According to Alexy, the most important thing in norms is the distinction between a principle and a rule. The distinction is a base of a normative argument and a key to solve a normative problem. It is also a steppingstone to show the limit and the possibility of rationality in normative domain. A rule is a determinate norm which includes the realistic possibility and what is determined in the normative possibility. An order is what is required by a rule. A principle is a potential norm which is an optimizing order in that it is a norm which orders to realize something relatively high in accordance with its realistic possibility and its normative possibility. A principle can have its efficacy as a determinate principle through the process of optimization argument. That is, a principle becomes a norm with its determinate efficacy through balancing. There are three types of balancing: the law of contradiction, the law of balancing 1, and the law of balancing 2. The first one is the law of contradiction, which considers the contradiction among rules as the conditional dominance relation. The second one is the law of balancing 1, which judges the restriction degree of principles, the importance of satisfaction and the abstract importance in the dimension of contents. The last one is the law of balancing 2, which judges the same three things in the dimension of determinacy from the cognition of empirical facts. The law of contradiction uses the conditional dominance relation and the two laws of balancing measure the importance of principles and present it as the weight formula. The weight formula can present the combinational relations among principles – the mutual ground relation, the materialization relation, the supplementation relation, et el. - as the expanded weight formula, As I have said, in this paper, I will use a case of the Supreme Court Cases: Supreme Court en banc Decision 2009Da17417 Decided May 21, 2009 “Withdrawal of Futile Life-Extending Medical Treatment Device, etc.” I will reconstruct the case to apply the law of balancing 2. In this case, there is a contradiction between the right to self-decision of a patient, who is in her state of irreversible coma, and the right to life. There, however, cannot be an evaluation between these two basic rights based on the rule of subsidiarity, since the right to self-decision and the right to life cannot be directly compared. There needs to be a contextual consideration. In this case, only required is the propriety of the restriction ground. The restriction ground is considered in conditions. Whether to allow the withdrawal of futile life-extending medical treatment device requires the follow conditions for balancing. First of all, there must be an analysis of the specific and concrete circumstance. Secondly, whether there is a decision of the patient herself to withdraw futile life-extending medical treatment device must be checked. Thirdly, there must be an analysis of the right to life of the patient. Fourthly, there must be an analysis of ways to protect the patient’s right – to maximize the right to self-decision which should realize and to minimize the damage of the right to life which is not realize. Fifthly, there must be an analysis of the restriction for the right to self-decision and the right to life. The contradicting rights are measured comparatively in the conditions. The result of measurement is again measured in determinacy of the cognition of empirical facts. The law of balancing 2 including the entire process, is a hypothetical deductive method which starts with a deductive argument but ends with an inductive argument. According to the applyment of the law of balancing 2, there is no difference between the major opinion and the dissenting opinion in the normative argument. There, however, is a difference between them in the argument of the cognition of empirical facts. The major opinion is a judgment from the cognition of empirical facts. The dissenting opinion is a judgment from the cognition of empirical facts in some points, but is not in many points. The other case I will observe is the case of a dementia patient, which includes her past decision. Her advanced medical directive was the denial of all medical treatment in the case of dementia. I will apply the law of balancing 2 to the two opinions. One is the ethical and individualistic coherence view of Dworkin, who is one of liberalists. The other is the variability view of Kant, which includes both liberalism and communalism. In the coherence view, the past decision should be respected because it represents the coherence of individual’s entire life, such as self-respect, authenticity and completeness. In contrast, the variability view says that the past decision can be respected in accordance with the circumstance life in the continuity of time. The circumstance life can be good or not. That is, the circumstance of life is variable, so the past decision can only be respected in the point optimizing it and the circumstance of life. As a result of applying the law of balancing 2, there is a huge difference not only on the normative judgment but also on the cognition of empirical facts. In the coherence view, the past decision is not justified because it has a problem on the normative judgment and the cognition of empirical facts is not definite. On the contrary, the variability view says that there is the mutual ground relation, the materialization relation, and the supplementation relation between the right to self-decision and the right to life in a united system and the past decision is restricted on the sound ground. The variability view is similar with the previous major opinion of the Supreme Court Case in that the normative judgment and the cognition of empirical facts are definite. Balancing among principles is a special form of legal argument but is not different from the structure of standard principle argument. I admit that the weight formula, which represent the entire process of balancing, is not familiar in normative argument. Still it can be very useful because it can pose an axiom or argue an hypothesis. I also admit that balancing among principles might not be applied to biomedical ethics in its raw form. It, however, has a powerful insight in its judgment form and structure.;생명의료윤리의 구체적인 문제에서 충돌하는 원리들 중 어떤 원리가 우선할 수 있는지 판단하여 실현되는 원리를 결정하기란 쉬운 일이 아니다. 생명의료윤리에서의 규범적 언명인 원리들은 도덕적 당위성을 나타낼 뿐 개별적인 사안에 관련되었다는 것만으로 효력을 갖는 것이 아니며 다른 원리들에 의해 배제될 수도 있는 것이기 때문이다. 원리들은 잠정적 효력을 지녔을 뿐 실현의 목적, 가능성 범위 그리고 한계가 포함되지 않은 것이다. 원리들은 그 자체 평가 기준으로서 실현 형태와 정도는 개별적인 사안이라는 조건과 규범적․사실적 가능성의 범위에 의존하기 때문에 개별적인 사안에서 충돌하는 원리들은 중요성뿐만 아니라 비중의 차원에서도 측정할 것을 요구한다. 이러할 때 고려해 볼 수 있는 것은 충돌하는 원리들 사이의 비중을 다루는 형량개념이다. 형량은 잠정적인 효력을 가지는 법규범 형태의 원리를 적용하는 전형적인 방식이다. 그러나 원리형량은 가치다원주의를 전제하면서 비중의 차원에서 서로 충돌하는 가치나 이익을 조화롭게 실현하게 하는 최적화 과정이므로 생명의료윤리에서 관심을 기울일만한 것이다. 따라서 이 논문에서는 먼저 알렉시의 원리형량의 구조를 살펴보고 이를 대법원의 판결과 생명의료윤리 측면에서 구성한 사례에 적용하고자 한다. 알렉시에 의하면 규범에서 가장 중요한 것은 규칙과 원리의 구분이다. 이러한 구분은 규범적 논증의 기초가 되고 규범적 문제를 해결하는 열쇠가 될 뿐만이 아니라 규범영역에서 합리성의 가능성과 한계에 답변하는 출발점이 된다. 확정적 규범인 규칙은 사실적 가능성과 규범적 가능성 안에서 확정된 것을 포함한다. 어떤 규칙이 있다면 그 규칙이 요구하는 바가 명령이다. 반면에 잠정적인 규범인 원리는 어떤 것을 사실적 가능성과 규범적 가능성에 따라 상대적으로 높은 정도로 실현하도록 명령하는 규범이라는 점에서 원리는 최적화 명령이다. 최적화 명령인 원리는 최적화 논증과정을 거쳐서 확정적 원리의 효력을 지닐 수 있는 것이다. 즉, 형량을 통해서 확정적 효력을 지닌 규범이 되는 것이다. 따라서 형량은 규칙들의 충돌을 조건부 우열관계로 판단하는 충돌법칙, 원리의 제한정도, 충족의 중요도, 추상적 중요도를 내용적 차원에서 판단하는 형량법칙 1 그리고 제한정도, 충족의 중요도, 추상적 중요도를 경험적 사실 인식의 확실성 차원에서 판단하는 형량법칙 2, 세 가지로 구분된다. 충돌법칙은 조건부 우열관계로 나타내지만, 형량법칙 1과 2는 비중의 정도를 측정하여 이를 일목요연하게 중요도 공식으로 나타낸다. 중요도 공식은 사안에 따라 원리들의 복합적 관계(상호 근거관계, 구체화 관계, 보완관계 등)를 확대된 중요도 공식으로 나타낼 수 있다. 이 논문에서는 대법원 2009다 17417 회복 불가능한 사망의 단계에 있는 환자의 연명치료중단 허용 판결에서의 다수의견과 반대의견을 재구성하여 형량법칙 2를 적용한다. 이 사건은 회복 불가능한 사망의 단계에 있는 환자(동일인)의 자기결정권과 생명권이 충돌(경합)하고 있기 때문에, 자기결정권과 생명권의 직접적인 비교가능성이 문제되는 것이 아니라 내용적 통찰을 필요로 하는 것이기 때문에 기본권심사의 문제는 두 기본권의 보충성 규칙에 근거하여 더 이상 심사할 수 없다. 이러한 경우에는 제한하는 근거의 적절성만 입증하면 된다. 제한하는 근거의 적절성은 요건에서 판단한다. 연명치료중단 허용 여부는 다음과 같이 요건을 구성하여 형량 한다. 요건은 첫째, 구체적인 상황에 대한 분석, 둘째, 연명치료중단을 원하는 환자 의사의 존재 여부, 셋째, 환자의 생명권에 대한 분석, 넷째, 환자의 권리를 어떻게 보호할 수 있는지, 즉 실현되어야 하는 자기결정권은 가능한 한 최대화 할 수 있으며, 실현되지 않는 생명권에 대해서는 가능한 한 피해를 최소화 할 수 있는 적합한 수단(규범)에 대한 분석, 다섯째, 생명권과 자기결정권의 제한에 대한 분석을 하여 구성한다. 이 요건 안에서 충돌하는 권리들을 비례적으로 판단하며, 판단한 결과는 경험적 사실 인식의 확실성 차원에서 다시 판단한다. 이와 같은 과정을 포함하는 형량법칙 2는 연역논증으로 시작하지만 연역의 결과는 귀납논증을 하는 가설연역법 구조이다. 대법원 판결을 재구성하여 형량법칙 2에 적용한 바에 의하면, 다수의견과 반대의견 간에 규범적 논증은 차이가 없지만 경험적 사실 인식의 확실성 논증에서는 차이를 보인다. 다수의견은 경험적 사실로 인식할 수 있는 판단을 한 반면, 반대의견은 일부 경험적 사실로 인식할 수 있지만 많은 부분에서는 경험적 사실로 인식을 할 수 있는 것은 아니다. 나아가 이 논문에서는 생명의료윤리에서 치매환자가 과거에 정신이 온전할 때 작성한 과거결정(사전의료지시: 자신이 치매환자가 되면 질병에 걸리더라도 일체의 의료개입을 거부하는)에 관한 사례를 구성하여 자유주의의 한 견해인 드워킨의 윤리적 개인주의적 정합성 관점과 자유주의 및 공동체주의를 포괄하는 칸트의 자율성에 기초하는 가변적 관점에 형량법칙 2를 적용한다. 정합적 관점에서 과거결정은 개인의 전체적인 삶의 정합성(자기자존, 진정성, 완전성)을 나타내는 것이므로 존중되어야 한다. 반면에 가변적 관점에서 과거결정은 시간 연속선상에 있는 자신의 생명현상에 따라 존중될 수 있다. 생명현상이 도울 수도 있고, 또는 방해할 수도 있다. 즉, 가변적이기 때문에 과거결정과 생명현상이 최적화되는 지점에서 존중될 수 있다. 두 관점에 형량법칙 2를 적용한 바에 의하면, 규범적 판단뿐만 아니라 경험적 사실 인식의 확실성 판단에서 큰 차이를 나타낸다. 정합성 관점에서 과거결정은 규범적 판단에서 문제점이 드러날 뿐만 아니라 경험적 사실 인식이 확실하지 않기 때문에 정당화 되지 못한다. 반면에 가변적 관점에서 과거결정은 통일된 체계 안에서 자기결정권과 생명권이 근거관계, 구체화 관계, 보완관계가 성립되며, 제한하는 근거도 적절하다. 그리고 규범적 판단 및 경험적 사실 인식이 확실하므로 정당화 되는 것으로서 대법원의 다수의견과 크게 다르지 않다. 원리형량은 법적논증의 특별한 형식이지만 일반적 규범 논증구조와 다르지 않다. 또한 형량의 전모를 나타낼 수 있는 중요도 공식은 규범적 논증에서 생소한 것이지만, 공리를 나타낼 때 가설을 논증할 때 사용하는 공식이므로 무리는 없는 것이다. 원리형량을 생명의료윤리에 그대로 적용할 수 있는 것은 아닐지라도 그 판단형식과 구조는 생명의료윤리 영역에 많은 시사점을 줄 수 있을 것이다.
