Abstract
Since the collapse of the Cold War in 1990s, there has been global refugee crisis caused by several civil wars in Africa and Asia. Generally asylum-seekers have fled from their unstable countries and attempted to enter the industrialized countries for safety. Especially Western and Northern Europe states as traditional destinations for refugees have been suffering from a large influx of asylum claims due to their asymmetric preferences. So they made several efforts to distribute evenly the responsibility for hosting unwanted populations. One of the most typical instruments for burden-sharing is readmission agreements. This agreement has been widely adopted by the European states and other neighbor states for returning the third country nationals as well as their own nationals. It is interesting that this agreement imposes an obligation of receiving asylum-seekers on transit countries that they have crossed before. It gives destination states a legitimacy of deporting asylum-seekers including illegal migrants without violating the principle of non-refoulement and leads to the repatriation of immigrants to their countries in the end. In this dissertation, I examine certain aspects of relations among the EU member states and the third countries and discuss the nature of interdependence in the context of intergovernmental cooperation in receiving asylum-seekers. In interstate interaction, 'interdependence' has been a key concept to analyze the complexity of cooperative and conflictual issues. According to Robert O. Keohane and Joseph S. Nye, interdependence refers mutual dependence which creates costs when a certain actor changes its relations within the existing framework. In addition, 'sensitivity' and 'vulnerability' concepts from Keohane and Nye's interdependence theory provide the conceptual framework for this refugee crisis issue. Based on this, it is possible to conclude that destination states shift its sensitivity onto transit states by concluding readmission agreements and reduce their vulnerability by diversifying partnership to shift hosting burden outwards from the Europe. For example, Since more and more asylum-seekers are lodged at the border of Greece and they are also returned involuntarily to Greece under the Dublin Convention or Eurodac System, Greece concluded readmission agreements with Turkey to reject asylum claims and deport them to Turkey. Likewise, due to the political stability and economic growth in Turkey, illegal migrants and refugees are concentrated within its region. With the concern about becoming the second destination for asylum-seekers, Turkish government has actively concluded agreements and secured readmission obligation from their neighbor states including Syria, Romania and Ukraine etc. In other words, a country with diverse members of partnership has many options to repatriate refugees, and thus it is less vulnerable to the external influence. Under this readmission system, destination states limit the illegal migration flow effectively and shift the responsibilities to others. Instead, they provide economic and technical assistance to periphery states in Europe. On the other hand, Central and Eastern European Countries changed their transit role into safe buffer zones by readmitting asylum-seekers from destination. In return, they gained guarantees for joining the EU and relevant funds from the EU. Recently, North-African transit countries are also concluding informal bilateral agreements to improve flexibility in response to sudden change in interstate relations. In this sense, transnational interdependence relations are getting widened and deepened through readmission agreements with mutual costs and interests involved.;냉전 이후 공산주의 국가의 몰락과 그 이후 정치 · 경제적으로 불안정한 아프리카 및 아시아 지역에서 각종 내전이 발생하면서 범세계적으로 난민위기가 심화되었다. 국제사회의 보호가 필요한 난민들은 인근 지역으로 피신하였지만 2차적으로 최종 목적지인 선진산업 국가로 이동하여 왔다. 대표적인 목적지 국가인 서유럽과 북유럽 국가는 난민들의 비대칭적 선호 때문에 상대적으로 난민수용에 대한 막중한 책임을 떠안게 되었다. 어느 국가도 난민을 수용하거나 재정착시키는 책임을 지려고 하지 않는 상황에서 주요 목적지 국가들은 유럽 변방국가와 역외 국가들과의 협력 메커니즘을 마련하여 원치 않는 부담을 분배하려고 시도해 왔다. 대표적으로 유럽 국가들은 지난 수십 년간 인접 국가와 지리적으로 멀리 떨어진 제3국과 재입국협정을 체결하여 난민 재수용 의무를 확대시켰다. 재입국협정의 대상은 자국민뿐만 아니라 제3국민까지 포함하는데, 흥미로운 점은 난민발생 국가는 물론이고 난민이 잠시 거쳤던 경유 국가에게도 재수용 의무를 부과한다는 점이다. 이때 목적지 국가들은 협정 체결 시 ‘안전한 제3국가 원칙’을 결합하여, 유럽 국가가 안전하다고 판단되는 국가를 경유해 들어온 난민의 요청을 거절하는 등 정당성을 확보하였다. 이에 따라 기존 경유 국가인 남유럽과 중동부유럽 국가는 협정 체결로 인해 목적지 국가로부터의 난민 재수용에 대한 압박을 받는 동시에 난민들이 차선책으로 이들 국가에 머무는 경우가 증가하면서 외국인에 대한 민감성이 높아졌다. 따라서 이들도 자신의 지역 ‘밖’인 지중해 연안과 발칸 지역, 지브롤터 해협 등지의 제3국가와 자체적으로 재입국협정을 체결함으로써 민감성을 외부로 이전시키고 취약성을 감소시켰다. 이 연구는 위와 같이 어느 국가도 난민수용의 부담을 떠안고 싶어하지 않는 상황에서, 목적지 국가뿐만 아니라 경유 국가, 그리고 난민발생지 인접 국가들이 어떻게 난민수용의 부담을 분배하게 되었는지를 문제의식으로 삼아 시작하였다. 연구의 목적은 난민보호 책임을 분배함에 있어서 난민유입에 민감성이 높은 국가가 재입국협정을 통해 난민수용 책임을 전가할 파트너십을 다각화함으로써 취약성을 감소시키고 궁극적으로 상호의존적 협력 관계를 발전시켰다고 주장하고자 한다. 이를 위해 난민이 불법이주자와 함께 목적지에서 경유지로, 나아가 난민발생지역으로까지 연쇄적으로 추방되는 현상을 코헤인 · 나이의 상호의존이론을 적용하여 살펴본다. 코헤인 · 나이에 따르면 상호의존이란 “어떤 일정한 거래와 관련하여 거래 당사자가 상대방과의 관계를 변화시킬 때 행위자들 모두에게 비용이 발생하는 상태”를 의미한다. 이 분석틀을 위 사례에 적용시키면 거미줄처럼 얽힌 재입국협정 파트너십은 EU 선진국들이 정치 · 경제 · 군사적 우위를 사용하여 제3국가에게 강제적으로 부담을 떠넘긴 것이 아니라, 두 상대국가가 서로에게 의무를 부과하는 대신 각자의 이익을 얻는다는 점에서 상호의존적 관계에 있음을 알 수 있다. 이때 목적지 국가들의 비용과 혜택은 분명하다. 우선 목적지 국가들은 재입국협정을 통해 불법이민자들의 유입을 통제하고 난민수용에 대한 책임을 외부로 전가하는 혜택을 얻은 반면, 외부국경을 통제하는 데 발생하는 비용과 협정 체결국가에게 제공하는 경제 · 기술적 지원 등의 의무가 뒤따른다. 한편 재입국협정을 체결하여 목적지 국가로부터 난민을 재수용하게 된 유럽 변방국가들은 유럽 역외 제3국과와도 또 다시 협정을 체결하여 난민과 불법이민자들을 돌려보낼 파트너십을 다각화 하였다. 최근에는 유럽 국가들이 북아프리카 국가들과 공식적 재입국협정보다는 비공식적 협정을 체결하여 급변하는 국제상황에 대처할 수 있도록 유연성을 높이고 상대방의 의무 불이행에 따른 비용을 최소화하려는 시도를 하고 있다. 이처럼 난민수용을 기피하는 국가들이 다양한 국가들과 재입국협정을 체결하여 대안적 파트너십을 확보함으로써 난민유입에 대한 민감성과 취약성을 낮추었다. 이와 같은 현상이 잘 드러나는 국가는 그리스와 터키이다. 그리스는 지중해와 맞닿은 연안 국가로 더블린협정과 Eurodac 시스템 내에서 불리한 위치에 있었다. 지리적 특징 때문에 외부로부터 난민유입이 증가하고 국내 경제가 악화되면서 난민을 사회적 안정을 해치는 위협으로 인식하게 되었다. 이로써 그리스는 2002년 내륙 국경을 맞대고 있는 터키와 재입국협정을 체결하여 난민수용에 대한 책임을 부분적으로 분배하였다. 마찬가지로 난민발생지이면서 경유지였던 터키도 최근 정치적 안정과 꾸준한 경제성장으로 주변지역으로부터 이주자들을 끌어들이고 있다. 터키 정부는 자국이 난민과 불법이민자들의 목적지가 되는 것을 우려하여 그리스, 시리아, 루마니아, 우크라이나 등 더 넓은 범위의 주변국가와 협정을 맺어 이들로부터 재입국 의무를 확보하였다. 이는 자국으로 집중되는 난민에 대한 책임을 바깥 지역을 분산시킴으로써 외부로부터의 난민유입에 대한 취약성을 감소시키는 전략으로 파악된다. 이처럼 목적지 국가에서 난민발생지 국가로까지 추방된 난민들은 다시 자신이 선호하는 국가로 들어가려고 재시도를 해도 결국엔 변방국가에서 차단되거나 재수용 됨으로써 유럽으로 들어가지 못한 채 돌고 돌아 자신이 도피했던 본국으로 되돌아가게 된다. 따라서 난민보호 책임을 국가 간 고르게 분배함으로써 효율성을 높이고자 했던 국가 간 협력은, 결국 난민을 유럽 밖으로 밀어내 버리는 비극적 결과를 초래하는 한계를 갖는다.
