Abstract
본 논문은 국제환경규범이 한국 내 수용되기까지 미치는 요인들을 분석하는 연구이다. 그 사례로서 지구환경보호를 위해 유해폐기물의 국가 간 교역을 규제하는 국제협약에 대해 집중하여 탐구하고, 미치는 요인으로는 해당 국가 내 규범에 대한 인식, 국가에 미치는 경제적 유인, 그리고 주변 국가들과 국제환경으로 구분하여 분석하였다. 환경레짐은 기존에는 그다지 중요하게 생각되지 않았지만 환경이 오염에 따라 국제정치적 문제점이 나타나기 시작하면서 형성되게 되었다. 이 중에서도 바젤협약은 개발도상국에 의해 주 된 환경협약이라는 점에서 매우 큰 의미를 갖는다. 기존의 환경협약들은 대부분 강대국에 의해서 레짐이 형성되어 왔다. 개발도상국은 선진국들과 같이 적극적으로 환경레짐 형성을 주도적 입장을 갖기에는 해당 국가들의 여건과 국제적 상황이 어려웠기에 환경레짐의 형성에 있어 개발도상국들은 어디까지 소극적인 수용자의 입장이었다. 그 당시 한국은 개도국의 입장으로서 바젤협약이 발효되고 이에 가입하기 전까지 한국의 입장과 태도는 그 당시 환경문제에 대한 인식이 어떠했는지를 보여줄 수 있기에 중요하다. 국제레짐의 국내 수용이 위의 세 가지 요인이 종합적으로 맞물려 유인이 있을 때 이루어진다고 가정한다면 국제 환경레짐의 한국 내 수용과정에서는 이 요인들이 확실한 유인으로 적용되었다고 볼 수 없다. 첫째, 한국 내 환경규범에 대한 인식은 90년대에 이르러 확산되기 시작했다. 바젤협약이 준비되기부터 채택, 가입하는 시점인 80년대 후반부터 90년대 초반까지의 한국 내 전반적인 인식은 산업 성장을 우선으로 하고 있었다. 바젤협약에 참여함으로써 미치는 영향에 대한 기반을 다지기 이전에 가입이 이루어 졌기에 시기적으로 문화적 요인이 국제 환경레짐 수용에 대한 주요 유인이라 할 수 없다. 둘째, 바젤협약은 환경규제 협약이기 때문에 한국 내 산업 활동에 직∙간접적으로 모두 영향을 미친다. 뿐만 아니라 한국은 선진국들과 비교했을 때 환경기술이 우위에 있지도 않다. 바젤협약에 가입함으로써 감수해야 하는 경제적 손해와 위험은 다른 국가들에 비교하여 매우 컸다. 따라서 물질적 유인 역시 한국의 환경레짐 수용에 직접적 유인이라 볼 수 없다. 이와 같은 점들로 미루어 보아 한국의 바젤협약에 대한 자발적 참여는 환경레짐 수용에 대한 국내적 수용과정을 통해 이루어졌다고 보기 보다는 국제체제 속에서 정당성을 확보하기 위해 보편적 규범을 받아드린 것으로 설명할 수 있다. 본 논문의 연구결과 국제환경규범이 한국 내 수용되는데 미치는 가장 핵심 요인은 국제환경이라는 결론에 도달하였다. 특히 한국은 바젤협약 참여에 대한 거부권 행위자가 있을 수 있는 국내산업적 환경이었음에도 불구하고 국내정치과정에서 바젤협약을 통한 국제환경규범 수용에 있어 국가 내 큰 갈등과정이 나타나고 있지 않다. 이는 한국이 환경레짐에 있어서 정당성 확보를 우선으로 하였으며, 자발적으로 참여했음에도 불구하고 수동적인 입장을 취한 것이라 할 수 있다.;This paper is a study that analyzes the factors which play a role in the process of international environmental standards being accepted within Korea. As a case study, we focused on international treaties that regulate hazardous waste trading between countries to protect the Earth’s environment, and analyzed by categorizing factors into awareness about the standard within the corresponding country, economical factors that influence the country, and international environment with surrounding countries. Environmental regimes were previously not considered as very important, but they were formed as international political problems emerged due to environmental pollution. Among these, the Basel Convention has a very huge significance in that it is an environmental treaty that was led by developing countries. Most previous environmental treaties had powerhouses form the regimes. Developing countries have not actively assumed a leading stance in forming environmental regimes with advanced countries because of their difficult conditions and international situations. Consequently, developing countries were always on the passive receiving side when it came to forming environmental regimes. At the time, South Korea was also considered a developing country when the Basel Convention became effective and its position and attitude before joining is important in understanding the country’s perception of environmental problems at the time. If we assume that the domestic accommodation of an international regime occurs when the three factors above synthetically engage and causes attraction, it is hard to say that these factors were a definitive cause in the process of accepting an international environmental regime within Korea. First, awareness about environmental standards within Korea began to spread in the 1990s. From the late 1980s to the early 1990s, during which the Basel Convention was prepared, chosen, and eventually joined, the general perception within Korea prioritized industrial growth. Because the country joined before laying the foundation for the impact that would result from participating in the Basel Convention, it is periodically difficult to say that a cultural factor was a major cause for accommodating an international environmental regime. Second, because the Basel Convention is a environmental regulative treaty, it impacts industrial activities in Korea both directly and indirectly. Moreover, Korea is not ahead in environmental technologies when compared to advanced countries. The economical damage and risk that it needed to endure by joining the Basel Convention was very large compared to other countries. Therefore, a material cause cannot be viewed as a direct reason for Korea’s accommodation of an environmental regime. Based on the above observations, Korea’s voluntary participation in the Basel Convention can be explained as to obtain legitimacy within an international system by accepting universal standards rather than having occurred through a domestic accommodation process for accepting an environmental regime. As a result of the study, this paper reached a conclusion that the most essential factor for international environmental standards to have been accepted in Korea was the international environment. Especially, even though Korea has a domestic industrial environment in which some may have refused to join the Basel Convention, there has not been a big conflict in accommodating international environmental standards through the Basel Convention within the country. This is because Korea prioritized obtaining legitimacy through the environmental regime, and shows why it assumed a passive stance despite participating voluntarily.
