Abstract

경제적 효율성에 중점을 두며 GATT와 WTO를 움직이는 비교 우위의 개념이 문화 상품에도 적용이 가능한가? 문화 상품은 상품으로서의 성질과 서비스로의 성질을 동시에 갖는 '이중적 본질'을 가진다. 그러므로 그러한 문화 상품의 취급은 그러한 문화 상품의 특성을 잘 고려한 것이어야 한다. GATT가 존재하던 시기에는 문화 상품에 대한 고려가 미미하였는데 그 이유는 문화 상품의 교역량이 작았기 때문이다. 그러나 WTO의 출현과 맞물려 증가된 문화 상품의 교역량과 거대 문화 오락산업들의 존재에 의해 교역에 관계되는 문화 상품에 대한 적절한 취급의 필요성이 대두되었다. 캐나다-정기 간행물에 대한 특정 조치 사건은 WTO에서 처음으로 교역에 관련된 문화 상품의 처리 문제를 고찰한 사례이며 또한 GATT와 GATS의 관계와 문화 산업에 관한 정부 보조금의 허용 가능한 범위와 종류를 세밀히 조사한 사례이기도 하다. 비록 이 사건의 판결이 문화 상품의 처리에 대한 정확한 답변을 회피하였으나 GATT와 CATS의 관계와 문화 산업에 관한 정부 보조금의 허용 가능한 범위와 종류에 대해서는 분명한 해답을 제시해 주었다. 이 판결로 인해 자국의 문화 보호를 위해 부양 조치를 취하려는 각국 정부들의 노력은 상당한 어려움에 봉착하게 되었으며 그러므로 잠재적인 충돌을 피하기 위해 새로운 조치들의 필요성이 대두되었다. WTO의 기준에 맞는 투명하고 적절한 정부 보조금과 WTO가 허용하는 Cultural Waiver는 자국 문화 부양 조치를 모색하는 정부들에게 타당한 해답이 될 수 있으나 정부 보조금과 Cultural Waiver 는 둘 다 모두 다른 나라들과의 협력을 통해서만 가능하므로 긴밀한 협력의 중요성이 더욱 강조된다.;Can the comparative advantage, which focuses on the economic efficiency and drives GATT and WTO, apply to the cultural products? A cultural product has 'dual nature,' i.e. it encompasses a character of a good as well as a character of a service; thus, the treatment of such a product has to consider that characteristic. Under the GATT, there was not much consideration on culture products because at times of the GATT, relatively small portion of cultural products actually engaged in trade. However, with the advent of the WTO; with far increased volume of cultural products in trade and; with the presence of huge culture and entertainment businesses, the need to establish proper treatments of cultural products in relation to trade emerged. The Canada-Certain Measures Concerning Periodicals case is the first case in the WTO to examine the treatment of cultural products that engage in trade. Also, this case scrutinizes the relationship between GATT and GATS and the limit of allowable government subsidy and its types on cultural industries. Although the rulings of this case sidestepped the treatment of the cultural products, it provides clear answer to GATT-GATS relationship and the limit of permissible government subsidy and its types. This ruling gives little latitude for governments that want to provide supportive measures to preserve their own cultures; therefore new measures have to be considered to avoid or prevent possible conflicts. Subsidies with transparency and appropriate under the norms and standard of the WTO and the cultural waiver under the WTO can be plausible answers to those government, but both of them has to be sought and achieved with the cooperation of other nations; therefore, the need to pursue close cooperation among nations becomes more and more crucial.
