우리나라 퇴직금제도의 변천에 관한 연구

Abstract

법률상으로 강제적용이 보장되어 있는 특이한 형태를 띤 우리나라의 퇴직금제도는 산업화이래 퇴직한 노동자들의 유일한 소득보장정책으로서 존재해왔다. 본 논문은 퇴직금제도의 바로 이러한 특수성에 대한 관심에서 출발한다. 선행연구들에서 나타나는 기능적 분석에서 벗어나 퇴직금제도를 형성시키고 변천시킨 구조적 요인들을 분석하기 위하여 본 논문에서는 마르크스주의자들의 이론들을 도입하였다. 따라서 사회보장정책의 발달을 1) 계급투쟁의 관점 2) 자본논리적 관점 3) 통합주의적 관점에서 보는 학자들의 견해를 먼저 이해한 다음 퇴직금제도에 이론적으로 시사하는 바를 정리하였다. 퇴직금제도 분석에 들어가기에 앞서 시기구분은 근로기준법 개정을 중심으로 하여 사회적 관행 단계, 법제화 단계, 강제적용 단계, 적용대상 확대단계로 각각 구분하였다. 그런 다음 통합주의자인 I.Gough 의 이론에 기본적으로 동의하는 입장에서 자본논리적 측면을 파악하기 위해서는 당시 정치.경제적 배경을 중심으로한 시대적 배경을 살펴보았고, 노동계급의 투쟁이 퇴직금제도에 미친 영향을 분석하기 위해 노동조합조직을 중심으로한 노동운동상황을 살펴보았다. 그 결과 우리나라 퇴직금제도는 노동운동을 통제하면서 경제적 궁핍화로 인한 노동자들의 불만을 완화하기 위한 무마책으로서 그 존립근거를 가지고 있음이 나타났다. 노동자 계급 자체 내에서의 퇴직금에 대한 요구는 임금인상 요구에 비해 상대적으로 낮았지만, 일반적인 노동계급의 양적 증대와 더불어 고양되어가는 노동운동은 국가와 자본으로 하여금 퇴직금제도의 지급보장 및 지급조건의 개선등을 수행하게끔 자극한 요인이 되었다. 자본측 입장에서는 비록 지급은 강제적이지만 충당금 설정에 대해서는 강제규정이 없으므로 기업운용자금으로 활용할 수 있는데다가 노동자에 대해 은혜를 베푼다는 이데올로기적 효과까지 거둘 수 있으므로 다른 사회보장제도에 비해 부담이 덜한 만큼 그 시행에 대해 커다란 반발이 없었다. 해방 이후 정부수립 당시부터 국가권력과 자본은 밀착된 상태로 존재했고, 정부 주도적 경제개발계획을 추진하게 되면서 자본에 대한 국가의 주도성은 더욱 심화되었다. 따라서 Gough가 전제로 하는 국가의 상대적 자율성에 의해 국가는 자본분파의 이해를 초월하여 퇴직금제도와 같은 사회정책을 통해 전체 자본에 이바지하는 역할을 수행해 낼 수 있게 되었다. 결론적으로 우리나라의 퇴직금제도는 자본과 유착되어 있되 상대적으로 강한 주도력을 가진 국가가 자본의 장기 총 이익 유지를 위해 노동계급에 대하여 그들의 투쟁을 억압하는 대신 반대급부로 제공한 제도라고 볼 수 있다.;Korean Retirement Benefit System is legally guaranteed and has exi stedas a single income security policy of the retired labours since industrializations. This study is starting from the interest of this particularity of the Retirement Benefit System. This study avoided the functional analysis of preceding studies and introduced the Maixist's theories in order to analyse the structural factors which had formed and changed the Retirement Benefit System. Therefore, this study previously looked into following aspects : 1) The aspect of class struggle 2 ) The aspect of capital logic 3 ) The aspect of combination and described what suggest theoretically as to the Retirement Benefit System. Before the analysis of the Retirement Benefit System is set out, the period classfication was classified into four stafes : social custom stage, legislation stage, cumpulsory application stage. appicable object expansion stage on the basis of the labour standard law revision. Subsequently, this study considered the background of the times which centered the political and economic background so as to understand the capital logical side, and considered the conditions of the labour movement which centered the orgaization of the labour union in other to analyse how the struggle of the labour class influenced the Retirement Benefit System. In consequence, at the same time that the Retirement Benefit System controls the labour monement, it has shown that it's existence base exists in a soothing policy which appeases the labourers' discontent as a result of the economic destitution. Although the demand of a Retirement Benefit within the labour class itself was relatively low compared with the demand of the wage increase, with the quantitative increase of the general labour class, the enhancing labour menement became a factor which stimulate a state and capital to carry out the payment security of the Retirement Benef
