선도 조건부 기소유예제도에 대한 실증적 연구

Abstract

본 연구는 선도유예제도의 개선방안을 찾기 위하여 선도위원과 선도유예제도 운영실태 및 지원체계에 대해 검토해 보았다. 본 연구의 목적은 제도 운영상의 문제점을 파악하고 적절한 선도위원의 선정 및 위원과 소년의 연결방법에 도움을 줄 수 있는 기초자료를 제공하며 제도를 보다 효율적으로 운영하기 위한 지원체계의 활성화 방안을 찾으므로써 제도를 더욱 발전시켜 더 많은 비행소년들이 혜택을 입고 적절한 서비스를 받도록 도와 재범율을 낮추고 비행을 예방하려는 것이다. 이러한 연구목적을 달성하기 위해서 본 연구에서는 문헌연구와 실태조사를 병행하였다. 문헌연구에서는 교정의 개념 및 시설의 교정사업의 종류와 선도유예제도 전반에 관하여 검토하였다. 그리고 실태조사에서는 인천지방검찰청 관할구역내에서 활동하는 선도위원들을 대상으로 그들의 개인적 특성 및 경험, 선도유예제도의 운영실태 및 지원체계, 선도를 경험했던 소년들의 특성과 선도하기 원하는 소년들의 특성에 대해 살피고, 선도 성공률에 직접적인 영향을 주는 요인을 파악하는데 역점을 두었다. 이를 위해 본 연구는 인천지방검찰청 관할구역내에서 활동하고 있는 선도위원 260명중 107명을 대상으로 설문조사를 실시했다. 위의 사항을 측정하기 위해서는 연구자가 작성한 설문지를 사용하였고 분석방법으로는 단순 백분율, 빈도교차표를 활용하였다. 본 연구를 통해 밝혀진 조사결과를 요약하면 다음과 같다. 1. 선도위원의 개인적 특성과 선도 성공률과의 관계 (1) 연령에 있어서는 40대가 성공률이 가장 높게 나타났다. (2) 월평균 수입에 있어서는 100∼150만원 정도가 성공률이 가장 높게 나타났다. (3) 종교에 있어서는 무종교 및 기타가 성공률이 가장 높게 나타났다. (4) 교육정도에 있어서는 대학원 이상이 성공률이 가장 높게 나타났다. (5) 전공에 있어서는 사회과학이 성공률이 가장 높게 나타났다. (6) 직업에 있어서는 성직자가 성공률이 가장 높게 나타났다. 2. 경험했던 소년의 특성과 선도 성공률과의 관계 (1) 나이에 있어서는 고등학생 정도의 나이가 성공률이 가장 높게 나타났다. (2) 범죄유형에 있어서는 비행이 성공률이 가장 높게 나타났다. (3) 종사하는 일에 있어서는 학생이 성공률이 가장 높게 나타났다. (4) 종교에 있어서는 종교가 없는 경우가 성공률이 가장 높게 나타났다. (5) 가족상황에 있어서는 양부모가 계신 경우가 성공률이 가장 높게 나타났다. (6) 가정형편에 있어서는 보통 정도가 성공률이 가장 높게 나타났다. (7) 가족상황에 있어서는 양부모가 계신 경우가 성공률이 가장 높게 나타났다. 3. 경험했던 소년들의 특성과 선도하고 싶은 소년의 특성 비교 (1) 나이에 있어서는 과거에 위원들이 맡았던 나이 또래를 원하는 경향이 두드려 졌다. (2) 범죄유형에 있어서는 과거에 어느 범죄유형을 맡았던 다루기 쉬운 가벼운 비행을 많이 원했다. (3) 종사하는 일에 있어서는 과거에 어느 일을 하는 소년을 맡았던 학생을 선호하는 경향이 강하게 나타났다. (4) 학력에 있어서는 위원들이 과거에 많이 맡았던 학력의 소년을 원했다. (5) 가정형편에 있어서는 과거에 어떤 형편의 소년을 맡았던 보통 정도를 많이 원했다. (6) 가족상황에 있어서는 과거에 어떤 가정의 소년을 맡았던 양부모가 다 있는 가정을 원했다. 4. 제도의 지원체계에 대한 사항 지역사회 주민의 대다수가 이 제도 및 운영취지를 모르고 있고 선도위원들이 선도활동을 하면서 전문적인 도움을 얻고자 할 때 수시로 도움을 줄 수 있는 전문기구가 없어 제도의 지원체계가 거의 전무한 상태이다. 또한 선도위원의 형식적인 지위 때문에 선도를 효과적으로 수행하는데 어려움이 있고 위원의 사정을 고려하지 않은 소년의 일방적인 연결에 대해 불만이 많아 검찰측의 정책적 배려 및 개선이 시급한 것으로 나타났다.;In this study, to search a developing devices of the system of indictment for guidance, the guidian, the situation of the system management and support system were examined. The aims of this study are to provide a fundamental. data for the grasp the problems in the system management and for the help in the proper selection of guidians and in the matching method of boys and guidians and therefore with the further development of this system to help the more criminal boys to receive the advantages and services, to prevent the delinquency and to lower the second offense rate. To carry out this aims, documentary studies and investigation of situation were paralled. In the documentary studies, the concept of correction, the kind of community-based treatment and the overall of the system of indictment are examined and in the investigation of situation, against the guidians who are serving at the Ministry of Justice and public procurator's office in Incheon, their own characters and experiences, the situation of system management, support system, the characters of boys who have experienced the guide and the characters of boys who were wanted for guide by guidians were examined and it was underlined to insure the factor that effect on the rate of success of guide directly. The inquiry investigation was carried out against the 107 guidians who are serving at the Ministry of Justice and public procurator's office To measure the contents above, the inquiry which was made by researcher was used and the simple percentages, cross tabulations were used as an analytical methods. From this study, the results are summarized as follows. 1. The relation between the personal character of guidian and, the success rate of guide. (1) In the age, the age of 40s' showed the highest success rate. (2) In the income, 1 million-1.5 million won showed the highest rate of success. (3) In the religion, having no religion or miscellineous showed the highest rate of success. (4) In the degree of education, higher degree of the post graduation showed the highest rate of success. (5) In the major, social science showed the highest rate of success. (6) In the job, the clergyman gave the highest rate of success. 2. The relation between the boys who have experienced and the rate of success for guide. (1) In the age, the high school age showed the highest rate of success. (2) In the style of crime, the delinquencies showed the highest rate of success. (3) In the engaging work, the students showed the highest rate of success. (4) In the religion, having no religion showed the highest rate of success. (5) In the degree of education, the graduation of high school showed the highest rate of success. (6) In the condition of home, the average condition showed the highest rate of success. (7) In the condition of family, the existance of both parents showed the highest rate of success. 3. The comparison of the characters of the boys experienced with the characters of the boys to be wanted to guide. (1) In the age, the age of whom guildians have charged. (2) In the style of crime, the guidians wanted the light delinquency which is easy to deal at any style. (3) In the esgaging work, they preferred to students in spite of work of whom they have charged in the past. (4) In the degree of education, they wanted the dogree of whom they have charged. (5) In the condition of home, they wanted the average boys whomever they have may charged. (6) In the condition of family, they wanted the boys who have both parents, whomever they have may charged in the past. 4. About the support system. Most of the residents in the local community didn't know about this system and the intention of management and there is no special institution which may help for the guidians at any time. Therefore, the consideration of Ministry of Justice is urgent because, there is no support system at all, it is difficult to carry out the guide effectively for the formal position of guidian and the boys are jointed to the guidian without the condideration of situation of guidian.
