Abstract
The internal conflict in the relationship between the state and the individual is the essential issue of political thought. The dynamic arguments on this tension existed in Greece during the late fifth century B.C. Those arguments form the controversy on the antithesis of Nomos-Physis. Nomos is a Greek word which means law and custom and Physis is the word for nature. The Greek society in the late fifth century B.C. realized the diversity and flexibility of civilizations and customs through extensive contacts with foreign colonies. The highly developed democratic polity caused excessive alteration of legislation, thus the suspicion and abhorrence against the nomos of polis (the city-state) was embedded in the Greek consciousness. The Athenian defeat in the Peloponnesian War also contributed to the increase of the disbelief in both the present system and nomos. This suspicion of naturally into research on other alternatives. Physis rose as an eternal, absolute principle, while nomos was changeable, men-made. The arguments on the antithesis of nomos and physis varied from positions which denied the existing society to interpretations that conformed to nomos. The Sophists, who conducted the researches, were in the center of those arguments. The political decisions in the Athenian democratic system were influenced by the opinions of major citizens (demos) through the civil assembly and the civil court. Under these conditions, Sophistry was a required skill as the Sophists had the necessary knowledge of entering into political arena. The Sophists on more mere professional educators than intellectual circles both raised the issue on the present system and prepared alternative governing system. Thus, the argument on nomos and physis was started and developed by the Sophists. The support for conforming to the absolute dictates of nature instead of nature instead of invalid prescription of customs was opposed by the Protegra position that recognized customs (nomos) as the results of progress and understood them as a necessary mechanism of human society. Antiphon had a different perspective from Calicles and Hippies who both similarly advocated nature above customs. Antiphon s political though can be summarized in three definitions that can be estimated without the Plato s perspective as the Sophist having his own literature. They are human self-interest, biological equality, and non-aggression principle that made negative justice possible. This dissertation will conceptualize each definition as natural freedom, natural equality, and natural justice as Antiphon used nature to make definitions. Polis was the community governing all dimensions of citizens there was no true individual life free from polis, and humans existed as only Politico zoon (πολιτικον ζωον) . The nature, i.e., physis, in Antiphony s perspective was a new source of values that supplanted nomos, the embodiment of polis suppressing individuals. They could be changed into true individuals, behaving on the basis of their own nature, if he were divide from she true individuals, behaviors in the context of polis. In Antiphony s logical system, people can live by choosing on the basis of self-interest, freely choosing pleasure, enjoyment, and anything is good for them. Even though each individual without depending on the nomos, which prescribes positive justice, by respecting other s interest as long as they are not attacked. This is Antiphony s utopian vision. Antiphony understood humans as individual, autonomous actors, not as citizens. These individuals clan maintain the social condition by mutual non-aggression, and so this dissertation will interpret these points as Antiphony s individualistic and liberal perspective on human and society. Admitting human happiness as the highest value, Antiphony adopted the principle of increasing pleasure and decreasing pain. This rule can be interpreted as the beginning of utilitarianism. Though his support for physis over nomos, Antiphony criticized the suppression though in the democratic policy and advocated the interests of the individual over those of the state. ; 국가와 개인 사이에 놓인 내재적 긴장관계는 정치사상에 있어 본원적인 문제이다. 이 긴장에 대한 활발한 논의가 기원전 5세기 후반에 존재했었다. 그것이 관습과 자연의 대립(Nomos-Physis)논쟁이다. 노모스(Nomos)는 법과 관습을, 피시스(Physis)는 자연을 지칭하는 희랍어이다. 기원전 5세기 후반 희랍사회는 활발한 외래 접촉을 통해 문명과 관습의 다양성, 유동성을 인식하고 있었다. 또한 민주정체의 고도화는 입법의 과도한 변경을 야기해 폴리스의 관습에 대한 불신과 혐오가 잠재되어 있었으며, 펠레폰네소스 전쟁에서의 패배는 기존 체제, 관습에 대한 회의를 야기했다. 폴리스의 중추이자 시민의 일상을 지배하는 노모스(慣習)에 대한 불신은 자연히 다른 대안에 대한 탐구로 이어졌다. 피시스(自然)는 가변적, 인위적인 노모스와 달리 항구적, 절대적 원칙으로 대두되었다. 이 관습과 자연의 대립문제를 놓고 기존 사회를 완전히 부정하는 의견에서부터 관습에 대한 절대적 신뢰를 수호하는 해석까지 다양한 측면에서 논의가 활발했는데, 그 중심에는 소피스트 집단이 자리한다. 당시 아테네 민주주의 체제에서는 민회와 법정을 통해 ‘다수 시민(demos) 의 의사에 따라 정치적 결정이 이루어지고 있었다. 사회가 ’다수의 의견‘에 따라 작동되는 상황에서 ’설득술(sophistry) 은 정치체제로의 편입에 있어 필수적인 지식, 기술이 아닐 수 없었다. 그러한 정치지식, 정치기술의 공급자가 소피스트집단이었다. 직업적 교사 이상의 지식인 집단이었던 이들에게 관습과 자연의 논쟁은 기존 정치체제에 대한 문제제기이자 지배체제의 대안 마련이라는 측면에서 간과 될 수 없는 주제였다. 따라서 이 논쟁은 소피스트들에 의해 그 논의가 시작, 발전되었다. 관습을 진보의 결과로 인식하고 인간사회에 필수적 기제로 이해하는 프로타고라스적 입장의 반대편에는 무효한 관습의 규정이 아닌 절대적인 자연의 명령을 따르는 것을 지지하는 입장이 존재했다. 안티폰(Antiphon)은 자연에 대한 해석에 있어서 동일하게 관습에 반대해 자연을 옹호하는 칼리클레스, 히피아스와 또 다른 자세를 취하고 있다. 자기 저작을 소유한 소피스트로서 플라톤의 시각을 거치지 않고 평가될 수 있는 안티폰은 ‘인간에게 이로운 바’, ‘생물학적 동일성’, ‘소극적 정의를 가능하게 하는 불가침 원칙’ 이상의 세 개념을 내재하고 있다. 본 논문은 이를 안티폰이 자연을 근거로 규정하는 가치라는 점에 입각해 ‘자연적 자유’, ‘자연적 평등’, ‘자연적 정의’라고 개념화를 시도했다. 폴리스는 시민의 모든 생활 영역을 포괄하는 공동체였고 폴리스를 벗어난 진정한 개인생활은 없었던 상황에서 인간은 폴리스적 동물로만 존재했다. 안티폰이 이해하는 自然은 이와 같은 폴리스, 이 폴리스를 지배하는 관습을 대체할 새로운 가치의 원천이었다. 그 가치의 원천은 안티폰에게 있어 자연이자 곧 인간 본성이 된다. 인간의 행위를 폴리스의 도덕성에 입각해 세세하게 규정하는 관습에서 인간이 분리되면 인간은 자연, 곧 자신의 본성에 입각해 행위 하는 진정한 의미의 ‘개인’으로 전환될 수 있다. 자신에게 ‘좋은 것’, 쾌락과 기쁨을 自由롭게 선택함으로써 인간에게 이로운 방향으로 生을 유지할 수 있게 되고 각각의 平等한 개인들은 해를 당하지 않는 한 타인의 이로움을 존중함으로써 ‘적극적 정의’를 규정하는 관습에 의존하지 않고도 自然的 正義 상태를 실현할 수 있게 된다. 이것이 안티폰의 유토피아적 청사진이다. 안티폰의 사상체계 안에서 인간은 시민이 아닌 개인으로서 자율적 행위자로 존재한다. 그 개인들은 상호 불가침의 원칙에 입각해 사회상태를 유지할 수 있는데 이와 같은 안티폰의 인간관과 사회관은 개인주의적이며 동시에 자유주의적이다. 인간의 행복이 至高의 가치임을 인정하고 쾌락 증대, 고통 감소의 원칙을 채택하는 안티폰에게서 공리주의의 단초가 잠재되어 있음도 지적되어야 한다. 안티폰은 민주주의 정체의 ‘여론정치’가 야기하는 독재, 개별성의 억압에 대한 비판을 하고 있으며, 자연에대한 그의 지지입장은 국가의 통제에 맞서 個人의 自由를 선언하는 자유주의적인 것이었다.
