Abstract
본 논문은 국가가 국내외적으로 국제 인권 규범 준수를 위한 유리한 환경과 조건이 마련되었음에도 불구하고, 종종 국제 인권 규범을 준수하지 않는 현상을 기존의 연구에서 충분히 다뤄지지 않은 점에 주목하였다. 이를 통해, 본 연구는 규범을 수용하는 국가의 정체성과 특수한 국내 규범이 해당 국가의 국제 인권 규범에 부합하는 국내 제도 및 환경을 마련하였는지 등의 내재화 과정에 중요한 요소로 작용함을 밝히고자 하였다. 이러한 인식 아래, 본 연구에서는 가장 기본적인 기본권과 존엄성이 심각하게 위협을 받으면서도 자국으로부터는 적절한 보호를 받지 못하는 상황에 처하여 국제 사회의 보호와 지원을 절실히 필요로 하는 난민과 비호를 구하는 이들을 위해, 1951년 난민 지위에 관한 국제 협약의 가입한 한국이 체약국으로서의 의무 이행 사례를 들어, 한국 사회가 어느 정도 국제 인권 규범을 내재화를 이룩하였는지 밝히고자 하였다. 이를 위해 본 논문은, 우선 국제 인권 규범이 어떤 기제(매커니즘)를 통해 국가로 보편적인 가치로 전파, 나아가 국내 규범적 가치로 내재화되며, 국가로 하여금 국제 인권 규범의 실천으로 이끄는 요소들을 살펴본다. 한국의 국제 난민 보호 규범 실천 사례 연구를 통해, 비록 자문 및 감독 기능을 수행할 국제 기구 – 이 경우에는 유엔난민기구 (UNHCR) - 가 존재하고, 그 사회에 제도적으로 국제 인권 규범을 수용, 준수할 수 있는 정치 경제적 환경이 마련되었을지라도, 국제 사회로부터 도입된 인권 규범이 그 규범을 받아들이는 국가의 고유한 규범 가치 그리고 정체성과 충돌하거나 부합하지 않을 경우, 성공적으로 그 사회 규범으로 내재화 될 수 없음을 증명하였다. 특히, 이 과정에서 그 국가가 속한, 그리고 해당 국가와 전통적인 가치와 규범을 공유하는 지역 사회(혹은 국가)로부터의 압력도 해당 국가의 인권 규범 실천에 중요한 영향을 끼침을 증명한다. 기존의 규범 연구와 더불어, 본 연구로 도출한 결론을 토대로, 일본을 비롯한 동북아시아 지역의 국가들의 국제 인권 규범 실천이 미약한 현상을 이해하는데 기여할 수 있을 것이라 전망한다.;This thesis aims at addressing the continued inability of the existing literature to explain why states sometimes resist international human rights norms, even when the conditions for compliance appear propitious. This thesis argues that indigenous norms and national identity of the norm-invoking state are influential on the state's conformity to international human rights norms. To examine this argument, this study focuses on empirically on South Korea's response to international refugee protection norms as a signatory of the 1951 Refugee Convention. For this purpose, this thesis explores under what conditions states conform to international human rights norms and their diffusion mechanism at national level. Then, it analyzes the impacts of national identity and norms, and of regional context being influential in mobilizing interests of domestic civil advocacy groups and consequently in internalizing international human rights standards into domestic policies and government structure. By this empirical study, the thesis demonstrates that when domestic norms and identity of a state collide with or do not sufficiently match with the human rights norms of international society, international human rights pressure cannot be successfully diffused into states, even if they are seen ready to internalize international human rights norms into their domestic structure. It shows that, despite the presence of a strong supervisory role of international organization - in this case, UNHCR - the collision or mismatch between the norm taking state…s identity and international norms may impede the interaction between the state and international society and hence slow down the state's compliance and the socialization of the international norms. The study also found that the regional pressure affects the extent that states conform to international human rights norms. Incorporating this account into existing scholarship may help to understand the cross-national or cross cultural variations on state compliance to international human rights norms. In particular, it will also contribute to understand low compliance of other Northeast Asian countries such as Japan in the future study.
