우리나라의 사회교육행정기구 변천과 사회교육관계법에 관한 연구

Abstract

The purpose of this research is to analyze the social education administration and law which are the basic elements of the social education system to examinine their appropriateness and to discuss problems for building learning society through life-long education. The researcher, emphasizing study of literature, used related literature, educational code, and materials of the Nonformal and Vocational Education Bureau. This research intended to establish the theoretical background by clarifying concepts of the social education and by analyzing forms of the social education, on which it prescribed the characteristics of the social education administration and analyzed the transition course, current institutions, and services of the social education administration. And the researcher investigated important laws of each period until the social education law which is the base of the social education administration was established, explained the current social education law and its regulations, and analyzed laws related to the social education in the Ministry of Education. The result of this research shows that roles of the institution of the social education administration are poor, that it has weak relation with the school education administration, poor financial investment, and small number of professionals. Also, the social education law does not allow the positive role of the Adjustment Committee of the Social Education Policy, does not contain regulations about financial source and articles about benefit for donations, and does not have regulations about the establishment and management of the social education house by government. And it is found that in the curriculum of the social education does not have autonomy and positive incentive system, and have small range of application. Considering these problems. Strengthening the system of the social education administration and rearrangement of the social education law -- which can be applied to all institutions and facilities of the social education -- are requited. For this, the study about the administrations and regulations related to the social education, according to each Ministry - not contained in this research -- should be followed, and before that, comparison with the system of the social education in the developed countries should be proceeded.;본 연구의 목적은 평생교육을 통한 학습사회의 건설을 위하여 사회교육체제의 근본적인 요소인 사회교육행정과 법을 분석함으로써 그 타당성을 검토하고 문제점을 진술하는 데 있다. 연구의 방법은 문헌연구를 중심으로 하며 관계서적 및 문교법전과 사회직업교육국의 설명 자료를 활용하고 있다. 연구의 내용은 우선 사회교육의 개념을 명확히 하고, 우리나라에서 전개되고 있는 사회교육의 형태를 살펴봄으로써 본 연구의 이론적 배경을 세우고 있다. 이 이론적 배경을 토대로 사회교육행정의 성격을 규정하고 사회교육행정기구의 변천과정과 현행 기구 및 업무를 분석하고 있다. 또한 사회교육행정의 근거를 마련해 주는 사회교육법이 제정되기까지의 시대별 주요 법안을 연구하고, 현행 사회교육법 및 동시행령을 현황과 더불어 설명하며 문교부내의 사회교육관련법규를 분석해내고 있다. 연구의 결과, 사회교육행정기구는 역할이 미약하고, 학교교육행정과의 연계성이 결여되어 있으며 제정투자가 영세하고, 전문요원이 크게 부족한 실정이다. 또한 사회교육법은 사회교육정책조정위원회의 적극적인 활동보장이 되어있지 않고, 재원에 대한 규정 및 기부금에 대한 혜택 조항이 마련되어 있지 않으며, 국가 주도형의 시범적인 사회교육관설치 운영에 관한 규정이 없다. 그리고 사회교육과정운영에 자율성이 배제되어 있고 적극적인 유인체제가 미약하며 그 적용범위가 소극적임을 알 수 있다. 이상의 문제점을 고려할 때 사회교육행정체제의 강화와 사회교육제반시설과 기관에 적용될 수 있도록 사회교육법의 재정비가 요구되어진다. 이를 위해서는 본 연구에서 제외된 정부 각 부처별 사회교육관련행정과 관계법규에 대한 연구가 이루워져야겠고 선진외국의 사회교육제도와의 비교고찰이 선행되어야 한다.
