교원의 권리·의무에 관한 일 조사 연구

Abstract

The special education of our country is situated in the attemption of qualitative development along with the quantitative improvement, and so as to do it is thought that the professional improvement of special education teachers was most important. Therefore this study tries to search the reformation for the professional development of teaching profession among every feature of teaching profession. For this, the following contents are investigated. 1. The investigation on precedent studies about the feature of the teaching profession. 2. The analysis of the legitimate right and obligation of the teachers of special school. 3. The investigation of consciousness toward the right and obligation of the teachers of special school. 4. The discovery of necessary factor of the professional improvement among the law and the consciousness of teachers. As a method of study, the legitimate right and obligation-analysis was made through the studies of literature, and the consciousness of teachers was surveyed by using the method of a questionnaire. The results of study are summarized as followings. 1. In the positive law, the right of professionality of teaching profession, or the self-regulation in the process of education, the freedom of scholarship and the neotiating right of professionality didn't be allowed. And the restriction on the obligation was weak, so the certificate of teacher qualification in the special schools was very open to the public, furthermore, and the obligation of study and training have the low effectiveness for the lacking of provoking cause-system. The teacher in likely to support for the right and obligation of the professionality or teaching profession. 2. In the positive law, the public-rights of teaching profession, or the guarantee of their status and the fight of property was well established, and the obligation, or the sincerity, the uprightness, the maintenance of dignity, the command-obdience, and the prohibition of collective action were very controlled. The teacher is likely to support for the public-fights and obligation of teaching profession. 3. In the positive law, the basic right that the teacher can enjoy in the aspect of labor right of teaching profession was limited according to the need, and the obligation to labor was applied to only the person of special education-major in the national and public university. The teachers tend to support the obligation to take a job in the special school as the qualified person with a certificate of teacher-qualification. In the positive law, as the results, the teaching profession of special school was recognized as the charging job of public task, while the teachers has understood the complex nature of professionality. public task-assignment, and labor-profession.;우리나라의 특수교육은 이제 양적인 발전과 더불어 질적인 발전을 도모해야 하는데, 그러기 위해서는 특수교육담당교원의 전문성 향상이 가장 중요하다. 따라서 본 연구에서는 교직의 제특성 중에서 교직전문성 향상을 위한 개선점을 찾고자 하였다. 이를 위하여 다음과 같은 내용을 연구하였다. 1. 교직특성에 대한 선행연구 고찰 2. 특수학교 교원의 법적인 권리·의무 분석 3. 특수학교 교원의 권리·의무에 대한 의식조사 4. 법과 교원의식 중에서 전문성 향상에 필요한 요인 발견 연구방법으로 법적인 권리·의무 분석은 문헌연구를 통하였으며, 교원들의 의식은 설문조사 방법을 사용하였다. 연구결과는 다음과 같이 요약될 수 있다. 1. 실정법에서는 교직전문인으로서의 권리 즉, 교육과정상의 자율성과 학문의 자유, 전문직교섭권이 인정되지 않고 있으며 의무에 대한 규제력이 약하여 특수학교교사자격증이 지나치게 개방되어 있고 연수 의무는 유인체제가 없어서 실효성이 낮다. 교원들은 교직전문인으로서 가져야 할 권리와 의무에 대하여 찬성하는 편이다. 2. 실정법에서는 공직자로서의 권리 즉, 신분보장과 재산상권리에 대한 보장이 매우 잘 되어 있으며, 의무 즉, 성실, 청렴·품위유지, 명령복종, 집단행위금지 등에 대해 매우 강력하게 규정하고 있다. 교원들은 공직자로서의 권리와 의무에 대하여 찬성하는 편이다. 3. 실정법에서는 교직근로자로서의 권리측면에서 교원이 향유할 수 있는 기본권을 교육법 제78조, 국가공무원법 제65, 66조와 사립학교법 제55조에서 제한하고 있다. 교원들은 국민의 기본권을 전부 향유하는데 찬성하는 편이며 특수학교교사자격증 소지자로서 특수학교에 취업할 의무에 찬성하는 편이다. 결론적으로 실정법에서는 특수학교 교직을 공공업무담당직으로 인정하고 있는 것에 반하여 교원들은 전문직, 공공업무담당직, 근로직의 복합적 성격임을 인정하고 있다. 따라서 특수학교 교직의 전문성을 향상시키기 위해서는 실정법에서 전문직으로서의 권리를 최대한 보장하고 전문직으로서 갖추어야 할 의무를 강력히 규정해야 한다.
