사회사업실천에서의 윤리적 딜레마에 관한 사례 연구

Abstract

사회사업 윤리에 관한 관심은 1950년대부터 본격적으로 시작되어, 1970년대이후부터는 임상적, 기술적 도구만으로 해결되지 않는 윤리적 딜레마를 사희사업 실무에서 인식하고 그 문제가 논쟁화 계속 되어왔다. 특히 인력, 자금, 시설, 기술 등 전 자원의 부족, 사회복지사에 대한 비현실적인 처우, 사회복지 관리체계의 관료제화 등 일련의 사실과 경향은 사회복지사가 복지대상자와 사회를 위한 윤리적 가치를 지켜 나가는데 커다란 지장을 초래하고 있다. 그러나, 사회복지사는 매 상황에서 윤리적 결정을 내려야 하며, 전문직으로서 갈등적인 의무 때문에 윤리적 딜레마를 직면하게 된다. 윤리적 딜레마에도 불구하고 돕는 전문직 ( helping profession ) 으로서 사회사업이 그 기능을 다하기 위해서는 사회복지사의 신중한 윤리적 선택이 요구된다. 왜냐하면, 사회사업은 물건이 아닌 도덕적 및 문화적 가치를 간직하는 '인간'을 대상으로 서비스를 제공하기 때문이다. 일선 사회복지사에게 윤리적인 토대가 없으면 진정한 전문직임을 주장하거나 복지 대상자와 사회로부터 진정한 재가 ( 裁可 )를 받을 수 없다. 사회사업실천과정에서 윤리적으로 책임질 부분이 많아질수록 전문직에 종사하는 사회복지사의 긴장이 증가되는 상황을 미루어보아, 윤리적 딜레마에 관한 연구의 필요성이 제기된다. 그러나, 사회사업실천에서의 윤리적 딜레마에 관한 체계적인 연구는 대단히 미진한 실정이다. 그리하여, 본 연구는 지식과 기술 일변도의 제한된 시각에서 벗어나 사회사업 실무에서 일어나는 윤리적 딜레마에 대해서 연구하고자 하였다. 그 일환으로 본 연구에서는 사례를 통하여 사회사업실무에서 사회복지사가 경험하는 복지대상자의 자기결정권과 비밀보장에 관한 윤리적 딜레마에 대하여 연구하였다. 윤리적 딜레마란 비중이 같은 대안중에서 만족할 만한 해결책을 찾을 수 없는 문제상황으로서 사회복지사가 직면하는 문제의 윤리적인 측면을 말한다. 사회사업전문직 윤리는 사회복지사에게 결정하기 어려운 애매모호한 상황에서 필요한 윤리적 기준을 제공하며, 궁극적인 사회 목표를 형성하는 기준을 설정하고, 갈등적인 가치 사이에서 선택을 하며, 우선순위를 결정하는 기능을 한다. 따라서, 사회사업 가치의 행동영역인 사회사업 윤리를 인식하고 올바르게 실행하는 것은 사회복지사의 중요한 의무이다. 여기에 윤리적 딜레마에 관한 본 연구가 갖는 의미가 있다. 본 연구는 사례 연구로서 서울, 인천 지역의 지역사회복지관, 정신의료재활기관, 입양기관, 전화상담기관, 사회복지전문요원, 일반·재활·정신 병원에서 일하는 사회복지사를 연구대상으로 하였다. 실무경력 3년이하의 일선 사회복지사가 사회사업실무에서 직접 경험한 사회복지사의 권위 대 복지대상자의 자기결정권과 비밀보장의 윤리적 딜레마에 관한 사례를 연구하였다. 사례는 질문지와 개별인터뷰를 통하여 구하였다. 질문지에는 응답자의 인구학적인 배경을 묻는 6 문항과 응답자의 질문지에 대한 개념적인 이해를 돕고자 질문지에서 사용된 각 용어에 대한 간단한 설명, 그리고 사례의 예를 제시하였다. 사회복지사가 윤리적 딜레마를 해결하고자 선택한 결정의 접근방법에 대해서는 F.Loweberg & R.Dolgoff 가 제시한 4개의 윤리결정 접근방법을 기본틀로 분석하였다. 개별인터뷰 과정에서 사회복지사가 직접 윤리적 결정을 내린 접근방법에 대하여 질문하였고, 질문에 대하여 응답한 접근방법을 선택하게 된 배경에 대해서 인터뷰하였다. 윤리적 결정 접근방법을 본 연구자가 질문, 확인하여 사회복지사의 의도를 왜곡하는 오류를 방지하고자 하였다. 사례연구를 통하여 개인적인 오판을 막기 위해서 supervision을 이용하는 사회복지사를 발견할 수 있었다. 실제로 사회복지사에게 주어진 윤리적 대안들을 평가하고 선택하는데 있어 사회복지사 자신의 개인적인 편견을 의식하는 것은 매우 중요한 것으로 판단된다. 사회복지사의 가족 배경이나 생활경험은 특정가치의 중요성에 대한 자신의 생각에 많은 영향을 미치게 된다. 자신의 윤리적 입장이 얼마나 객관적인가를 평가하는 계속적인 자기훈련과 자아인식이 반드시 필요하며, 타당성을 검증할 수 있는 제도적인 장치를 통한 자기검증이 필요함을 사례연구를 통해서 알 수 있었다. 이러한 이해를 바탕으로 본 연구자는 윤리적 딜레마를 해결하기 위한 대안으로써 사회복지사의 자아인식 및 자기성찰, 윤리적 측면의 직원 재교육 프로그램, 수퍼비젼 체계의 활용, 지지체계의 개발, 윤리 위원희의 설립을 제언하였으며, 이를 통하여 사회사업의 가치를 실현하고 사회적 재가와 자율성을 유지하고 복지대상자에게 효과적인 서비스를 제공하도록 하는 데 도움이 되고자 하였다.;The concern for social work ethics actually arised in 1950s and the numbers of social workers who experience th ethical dilemmas in social work practice that can't be solved by simple clinical and skillful methods have increased since 1970s. Especially, social workers have mamy difficulties in keeping their ethical values toward clients and society for such factors and tendency like the deficiency of resources - man, fund, skill, impractical treatment for social workers, and bureaucratization of social work management system and so on. However, social worker always has to make a ethical decision on each situation, so confront ethical dilemmas because of their conflicting duty as a profession. It is a necessary for social workers to take a careful ethical choice so that social work expertly function as a helping profession in spite of ethical dilemmas, for social work practice serve on clients who have moral and cultural values. Without the ethical groundwork of line social workers, the social work can't assert their professional aspects or commit real approval from clients and social sanctions. Also, in considering the fact that the are many social workers who recognize the relationship between the ethical responsibilities and professional stress, few systematic paper on ethics or ethical dilemmas has been performed in Korea. Thus, this paper has studied on ethical dilemmas that occurred in social work practice, getting out of limited view by the knowledge and skill. On that purpose, this paper investigated ethical dilemmas about client versus self-determination and confidentiality that social workers experienced in social work practice by cases study. A dilemmas is a problem situation or predicament which seems to defy a satisfactory solution. Professional dilemmas are the ethical predicaments which professional face in their practice. Strictly speaking, it would be more correct to speak of the ethical aspects of problem situations which professional face, rather than of ethical dilemmas. The ethics of social work profession provide social workers ethical standard on obscure occassions, establize a basis which constitute ultimate social objectives, and help them make a choice in alternatives having a function to decide proirity among them. Consequently, it is important obligation for social workers to make out ethics on out them Properly. This is the worthy meaning of studies on ethical dilemmas. I visited 20 social workers who worked in local social welfare center, mental rehabilitation center, adoption center, telephone consultant center, medical settings, and the sampling areas were Seoul, Inchun province. The research method was a questionnaire and individual interview, finally 6 cases were sampled. On the frame of the 4 ethical decision method proposed by F. Lowenberg & R.Dogloff, I analyzed the cases, As a result, one case was practiced by the humanistic ethics, two cases by the clinical pragmatism, three cases by a situational ethics and never done by the religious ethics despite beliving the God. It seems very critical for social worker to be aware of his on prejudices, preferences, and value system. Based on this paper, I've intended to take opinions for the ethical dilemmas decisions such as self-consciousness, supervision system and in service traning program for employees so that they can provide better and more effective service for the clients.
