정신지체자 직업재활제도 형성에 관한 연구

Abstract

본 논문의 목적은 「장애자고용촉진법 (안)」을 검토하여 정신지체자의 직업재활 활성화 방안을 모색·제안하는데 있다. 이러한 목적을 위한 연구로서 70년의 직업재활 역사를 가진 미국, 30년의 역사를 가진 일본과 초창기에 들어선 우리나라의 직업재활제도 발달과정과 그 발달에 영향을 미친 중요한 배경들을 문헌을 중심으로 고찰하였다. 미국의 발달은 3단계로 구분하였다. 제 1단계는 시민직업재활법(Civilian Vocational Rehabilitat-ion Act)이 제정된 1920년부터 1942년까지로 구분하였다. 이 단계에서는 신체장애자 중심의 직업재활이 전개되었다. 제2단계는 이 법의 개정법(Barden-LaFollette Act)에서 정신지체자가 직업재활대상으로 인정된 1943년부터 1972년까지로 구분하였다. 이 단계는 정신지체자를 위한 전문가 양성이 활발하였고 다양한 서어비스 내용이 개발되었다. 제3단계는 미국의 현행 법인 재활법(Rehabilitation Act)이 제정된 1973년부터 현재까지로 구분하였다. 이 단계는 중증장애자 (the more severely handicapped)의 직업재활을 강조한 시기이다. 1972년까지 사용하였던 "직업"이라는 용어를 생략한 재활법으로 폭넓은 서어비스 내용이 포함되어 있다. 일본은 2단계로 구분하였다. 제1단계는 「신체장애자복지법」이 제정된 1949년부터 1975년까지로 구분하였다. 이 단계에서는 1960년 「신체장애자고용촉진법 」이 제정됨으로써 신체장애자 중심의 직업재활이 전개되었다. 제2단계는 「신체장애자고용촉진법」개정에서 정신지체자의 직업지도, 적응훈련등 일부내용은 신체장애자와 같은 대우를 받도록 조치된 1976년부터 현재까지로 구분하였다. 이 단계에서 가장 획기적인 사건은 1987년 신체장애자와 정신지체자가 모두 포함된 「장애자고용촉진등에 관한 법률」 (障害者の鹿用の促進等 開する法律)제정이다. 우리나라는 1981년 제정된 「심신장애자복지법」의 제11조 "고용촉진"조항에 의거하여 신체장애자 중심의 취업알선사업이 실시되었음으로 이시기를 1단계로 하였다. 1989년 장애자고용촉진법이 제정될 예정이다. 미국의 3단계, 일본의 2단계와 한국의 1단계의 내용을 요약비교하면, 1) 제도의 발달과정에 영향을 준 외적 배경은 다음과 같다. 미국의 신체장애자 직업재활에 영향을 미친 배경은 사회구조적 변화였으며 정신지체자의 경우는 부모와 전문가의 인식고조였다. 일본의 신체장애자 직업재활은 경제성장에 의하여 발달되었으며 정신지체자의 경우는 부모의 압력과 국제여론이었다. 우리나라의 신체장애자 직업재활에 영향을 준 배경은 국제여론과 장애자자신들의 욕구분출이었으며 정신지체자의 경우는 기틀을 마련치 못하였다. 2) 직업재활의 효과는 3나라 모두 장애자에 대한 관심이 제도화되었을 때 배가하였다. 따라서 금번 장애자고용촉진법(안)에서 정신지체자의 직업재활 내용이 제도적으로 명확성을 가져야한다는 결론을 얻었다. 3) 이를 위하여 다음과 같은 내용을 제안하였다. 첫째, 장애자단체와 부모회는 압력단체의 역할을 수행할 것을 제안하였다. 둘째, 장애자고용촉진법의 제명을 장애자직업재활법으로 개명하고, 셋째, 고용률적용에 있어서 신체장애자와 정신지체자의 적용범위를 명시하고, 넷째, 정신지체자를 위한 보호고용조항을 신설하고, 다섯째, 직업상담, 직업평가, 작업공학을 담당할 전문가의 비중을 높일 것을 제안하였다. 앞으로 이 제안에 대한 추가연구가 필요하다고 본다.;The objective of this thesis is to study employment promotion laws for the disabled in some countries and to suggest more activated way of vocational rehabiliation for the mentally retarded in our country. For this I studied some literatures on this subject to get the important backgrounds effected to the development processes of vocational rehabilitation in the United States of America with 70 years history, Japan with 30 years experiences and our country in the early stage of vocational rehabilitation. The American development process was devided in three stages at my option. The first stage was from the year of 1920, when Civilian Vocational Rehabilitation Act was enacted, to the year of 1942. For this time, vocational rehabilitation for the physically disabled was unfolding. The 2nd stage was from the year 1943, when Barden - LaFollette Act, a revision act of Civilian Vocational Rehabilitation Act, was enacted, t o the year 1972. In that time, the mentally retarded was regarded as a subject of vocational rehabilitation and various services were developed such as the training of professional personnels for the mentally retarded. The 3rd stage was from the year 1973 be enacted present Rehabilitation Act to the present time. For this years, they emphasised the importance of vocational rehabilitation for the more severely handicapped and included diversified services omitting the word "Vocational" from the name of act. And I devided Japanese development process in two. In, the first stage (1949-1975), they made Law for the Welfare of Physically Disabled Persons 1949, but mentally retarded was excluded from the object of Law Concerning the Promotion of Employment of Physically Handicapped 1960. In the 2nd stage (1976 - to the present), they inserted vocational guidance and adjust training etc. for the mentally retarded like as that for physically disabled in the amended Law Concerning the Promotion of Employment of Physically Handicapped 1976. For this period, the most important event was that they made Law for Employment Promotion, Etc. of the Disabled 1987 for the physically disabled and mentally retarded together. In our country job placement service started for the physically disabled mainly under the provision of Article 11 in the Welfare Law for the Mentally and Physically Handicapped Persons 1981. And Employment Promotion Law for the Disabled will be made this year 1989. To compare the contents of American 3 stages, 2 stages' Japan and our country with only 1 stage, 1) The following outside backgrounds were effected to the development process of vocational rehabilitation. In case of United States of America, the important background for the physically disabled was the change of social structure and that for the mentally retarded was a high understanding of professionals and parents with mentally retarded children.
