아내학대에 관한 이론적 고찰

Abstract

본 연구의 목적은 아내학대 문제에 관한 적절한 개입방안을 모색하기 위하여 아내학대 문제의 본질을 정확히 파악하고자 하는 것이다. 아내학대에 관한 기존의 개인심리적·가족체계적 접근방법은 사회구조적 차원을 경시한 경향이 있으며 아내학대 현상에 관한 모든 것을 설명해 주지 못하고 있다. 따라서 본 연구자는 가부장적 사회구조가 아내학대에 본질적 영향을 미치고 있다는 가설아래 사회구조를 가족제도·경제구조·법제도의 측면에서 고찰하여 보았다. 그 내용을 요약해 보면 먼저 가족제도의 측면에서 여성은 예로부터 가(家)와 가장(家長)에게 종속되어 소유물로 여겨져 왔으며 남편에게는 아내에 대한 징벌권이 주어져 왔다. 즉 모든 사회에서 지도와 처벌을 목적으로 하는 아내학대 행위가 오랫동안 허용되어 온 것이다. 경제구조의 측면 역시 이러한 가부장적 의식이 연장되어 남성에게 가족임금(family wage)을 허용한 이래 여성은 경제활동영역에서 소외되어 왔으며, 소수 참여자의 경우에 있어서도 불리한 근무조건의 하위직종만이 주어졌던 것이다. 그러므로 여성들은 생계를 위하여 남편의 수입에 의존하지 않을 수 없으며, 학대행위를 당한다 하여도 그 가정을 떠날 수가 없게 되는 것이다. 법제도 역시 전통적 인습·미풍양속 등을 운운하며 여전히 여성을 차별하고 있다. 법 조항 자체의 명백한 차별 뿐만 아니라, 이 법을 다루는 경찰이나 검사 등 현재 대부분 남성들로 구성된 법 관계자들의 남성우월의식 역시 학대받는 아내에게는 불리한 요인으로 작용하게 되는 것이다. 이와같이 아내학대는 복합적인 요인을 갖고 있는 문제이므로 개입방안에 있어서도 여러 차원의 다각적인 노력이 기울어져야 할 것이다. 즉 단기적 차원에서는 전화상담이나 간단한 법률부조사업, 대피소 운영 등이 행해져야 하며, 이와 동시에 장기적인 개입방안으로서 아내학대를 조장하는 사회적 제도의 변화를 추구하여야 한다. 이를 위하여는 첫째, 사회의 모든 부문에서 고정적인 성별역할이 제거되어야 하며, 둘째, 여성에게도 동등한 취업기회가 허용되어야 하고 주부의 재취업도 활발히 이루어져야 한다. 셋째, 여성을 차별하는 모든 법조항은 개정되어야 할 것이며 이를 다루는 관계자들의 태도도 변화하여야 한다. 이밖에도 현대에는 폭력적 범죄나 잔인한 행위등이 T.V, 영화, 비데오 등의 매스컴을 통해 공공연히 보여지고 있으며 어린이들은 이와같은 폭력적 행위에 특히 민감하다. 따라서 어린이의 학습을 위한 체벌의 허용이나 T.V, 잡지 등 매스컴을 통한 사회의 폭력적 분위기 등이 사라져야 할 것이다. 그러기 위해서 사회사업가들 사이에 이와같은 변화를 초래할 수 있는 효율적 전략수립의 노력이 뒤따르기를 기대한다.;The Purpose of this research are to grasp the wife-abuse situation correctly and to suggest some appropriate intervention plans. Previous approaches to wife-abuse are generally lacking of sociostructural factors and do not explain the situation thooughly. Thus, in this research social structures are examined from the perspectives of family, social and legal systems under the hypothesis that the male-dominated social structure constitutes one of the most important factors which cause wife-abuse. To summarize the content, in family system considered as a posession to her husband which makes it possible for him to punish her at his will in this context, wife-abuse has been permitted in most societies as an appropriate mean to guide and punish wives. In economic system, this male-dominance has been extended to permit him family wage and women have been isolated from economic activities. Even in some exceptional cases, it has been hard for women to afford themselves due to discriminated working conditions such as inferior jobs and low wages. This inevitably leads women to depend upon their husbands and stay with them in spite of severe abuses. In legal system, too, women are discriminated against under the name of traditional custom or ideal culture, there are clear discrimination not only in the laws themselves, but also in t h e attitudes and consciousness of the administrators of laws such as policemen, lawyers, etc. which acts against women who are abused by their husbands. As explained above, there are complicated factors which causes wife-abuse and thus, intervention plans should be pursued from various perspectives. Counselling through hotlines, women's shelter and legal assistance are useful for short-term intervention methods and changing socio-structural systems which cause wife-abuse should be pursued as long-term goals. For those purposes, First, fixed sex-role should be eliminated from every aspect of society, Second, equal job opportunities should be provided for women regardless of marriage, Third, all the laws which discriminated against women should be revised, and the attitudes of the administrators should be changed. In addition to that, rationalization as the use of physical force to children by the name of guidance, violant atmosphere of society projected in TV or magazines should be eliminated, too. Social workers need to make efforts to develop effective strategies which lead to changes of those factors.
