Case study : the bidding process of Korea high-speed rail project in terms of international negotiation

Abstract

본 사례연구는 한국고속철도 사업의 차량공급 계약자 선정을 위한 국제입찰을 사례로 하여 국제입찰을 국제협상의 한 차원인 단기협상으로서의 검토를 시도하였다. 고속철도 관련 신문기사와 철도관련 정기간행물을 비롯하여 한국고속철도건설 공단 담당자의 인터뷰와 문서를 통해 자료를 수집했다. 국제협상에서 협상참가자들의 정치경제적 배경이 협상결과에 영향주므로 국제입찰에서도 입찰참가자들의 국내경제 및 국제정치적 배경을 조사하였다. 이 국제입찰이 경매로서 나타내는 특징과 단기 국제협상으로서 나타내는 특성을 나누어 검토하였다. 입찰과정의 역학관계를 서술하고, 국제협상 분석에 사용되는 국제분쟁처리그룹의 기준으로 입찰 참여자들의 이해관계, 옵션, 전략과 전술, 정당성 기준, 대안, 서약, 의사소통을 사용하여 이번 입찰을 분석하였다. 이는 국제협상은 국제입찰을 포함하므로 국제협상분석도구로써 국제입찰의 분석이 가능하다는 점을 의미한다. 뇌물공여가 프랑스의 전략에 포함된다는 분석과 관련하여 필자는 프랑스가 한국 관련 정치인들에게 뇌물을 공여하고 입찰에서 승리했다는 의혹에 관한 검찰의 최종 조사결과가 나와서 미흡한 정보가 보완될 때까지 어떠한 분석결과도 신뢰할 수 없음을 밝힌다. ; This thesis attempts to examine that international auctions are components of international negotiations through the Korean case of an international auction for selecting rolling stock for the Korea High Speed Rail (KHSR) Project. I gathered in depth information on the bidding process from related articles found in newspapers, periodicals on railways, documents and from an actual interview with a Korea High Speed Rail Corporation (KHSRC) official. The economic and political environment surrounding participants of international negotiations influences the negotiation outcome. As a result, background information of the auction such as the domestic economy s situation and the international political situation were carefully researched. The characteristics of the auction are examined and divided into those of auction itself, and those of a short-term international negotiation. Dynamics of the auction process is described and analyzed with criteria defined by the CMG (Conflict Management Group) which is used to analyze negotiations such as the parties and their interests, options, strategies or tactics, criteria of legitimacy, alternatives, commitment and communication. International negotiations include international auction so the auction can be analyzed in terms of international negotiation. Bribing seems to have been France s strategy which led to its success. I just qualified this study by suggesting that any conclusion that emerges from this study cannot be sustained without more information until result of the Korean prosecution s investigation for the allegation that France won the auction with bribing related Korean politicians is finalized.
