Abstract
In the late 20th century, intellectual property emerged as a new source of global wealth and power. Naturally, intellectual property rights have increasingly been recognized as valuable assets to be protected in the global society. In the globalized society, especially, multinational companies investing in various countires are keen on protecting trademarks. China has been very notorious as a big infringer of trademarks. It is said that counterfeiting accounts for as much as 8% of China s GDP. Recently, however, China is also joining the world s trend of protecting trademarks with its effort to join the World Trade Organization (WTO). Since the late 70 s, China has engaged actively in activities of related international organizations, such as World Intellectual Property Organization (WIPO), and ratified several international treaties such as Paris Convention and Berne Convention. It has also enacted and revised trademark laws in line with international norms. As a result, China has quite a comprehensive legal system for trademark protection. However, China still has many loopholes in its trademark protection system. The problems include ambigous and insufficient Trademark Law, lack of enforcement resources, weak penalties, local protectionism and huge costs for trademark owners and so on. Moreover, recently, many conflicts have emerged between trademark owners and domain name holders but China does not have an effective way of dealing the problem yet. Therefore, multi-national companies possessing trademarks and doing business in China should be cautious and well prepared. Being vigilant against their Chinese business partners upon signing contracts could be a good start. The companies are also advised to get the assistance from trademark specialists in China. Furthermore, lobbying and improving the awareness of intellectual property rights by educational programs and campaigns in China are more active way of protecting trademarks in China, in the long run. ; 지난 세기에 이미 시작된 경제의 세계화, 국제화로 다국적 기업들은 그 어느 때보다 활발하게 전세계 시장을 향하여 뻗어나가고 있다. 특히, 중국 등 개발도상국으로의 투자가 급증하고 있다. 이러한 현상이 계속되면서, 그 어느 때보다 기업의 상표(Trademark)를 보호하는 것이 중요하게 되었다. 최근, WTO에 가입하는 등 중국은 시장 경제로의 이동을 그 어느 때보다 더 활발하게 전개하고 있다. 그러한 움직임 중의 하나가 상표권을 포함한 지적재산권 (Intellectual Property Rights)의 보호이다. 1970년대 말 이후, 중국은 Copyright Law, Patent Law, Trademark Law등을 차례로 제정하여 왔고, 이러한 법들은 실행하기 위한 법률들을 눈부신 속도로 발전시켜 왔다. 약 20여 년의 짧은 시간 동안 중국은 중국 내 지적 재산권에 관한 법체계를 TRIPS (Trade-related Aspects of Intellectual Property Rights) 등과 같은 국제적 합의나 규범에 벗어나지 않도록 갖추는데 성공했다고 평가받고 있으며, 이는 매우 주목할 만한 성과이다. 하지만, 아직도 중국은 세계 제 1의 불법 복제품을 생산하는 국가로 알려져 있으며, 이러한 불법 복제물은 원산지로 역수출까지 되고 있는 실정이어서 중국의 지적재산권의 효능을 의심스럽게 하고 있다. 본 글에서는 중국의 지적재산권 중에서도 상표권의 보호에 있어서 문제점을 지적재산권 법률의 헛점, 법률의 부적절한 실행, 그리고 지역 이기주의 등으로 지적하였다. 따라서, 향후에 중국 시장에 진출하려는 지적재산권 보유 기업들은 사전에 충분한 시장 조사를 마친 후, 지적재산권 보호 전문가 등을 고용하여 경계를 게을리 하지 않는 것이 바람직하며, 나아가서 중국인들의 의식을 바꾸어 놓을 수 있는 교육 과정이나 세미나 등을 널리 활용하는 것이 기업의 먼 미래에 도움이 될 것이다.
