Abstract
산업화와 국제화의 이면에서 철저한 자본의 논리와 사회적, 기술적, 법률적 결함의 야합이 대규모의 국제적 재해를 양산하고 있으나, 이러한 재해의 국제적 성격 규명과 이에 대한 국제적 규제, 그리고 재해 피해자의 권리구제 모두가 매우 미흡하게 이루어지고 있는 것이 현실이다. 이러한 상황에서 기존의 국제 기구들의 인권구제 역량의 한계까지 드러나면서 피해자들은 보다 효율적이고 신속한 권리 구제방법을 모색하게 되었다. 그 대표적인 것으로는 본 논문 제 2 장에서는 Harold Hongju Koh 교수의 원칙주의 적 접근법에 근거하여 주로 미국 법원을 중심으로 활발히 전개되고 있는 초 국내적 공법소송 “Transnational Public LAW litigation”에 대하여 고찰하고 있다. 초 국내적 공법소송이란 개인이나 정부가 국제법의 위반에 이의를 제기하며 국내법원에 그 구제를 구하는 소송을 말한다. 제 3 장에서는 대표적인 초 국내적 공법소송의 예로서 1984년 인도에서 발생한 Bhopal 재해의 피해자들이 제기했던 Bhopal 소송을 소개하고 그에 대한 비판적 분석을 시도하고 있다. 다국적기업을 통한 유해물질의 국가간 이전으로 야기된 Bhopal 재해는 국제적 재해의 성격과 그 피해의 심각성을 극명하게 보여주는 사례이다. 그리고 인도정부에 의하여 미국 법원에 제기되었던 소송이 ‘불편의 법정’ 이라는 이유로 인도로 이송되고, 결국은 직접 피해자들은 철저히 소외된 채 불만족스러운 법정화해로 종결된 복잡다단한 소송과정은 초 국내적 공법소송의 내용과 한계를 잘 드러내주고 있다. 또한 Bhopal 재해의 희생자들이 결과적으로 거의 아무런 구제도 얻지 못하고 현재까지도 극심한 고통에 시달리고 있다는 사실은 이러한 종류의 재해가 유발하는 피해에 대한 실질적인 구제가 얼마나 어려운가를 웅변해 주고 있다. 그러므로 국제적 재해의 발생시 피해자 구제의 실질을 담보하기 위해서는 최소한의 국제적 기준과 원칙이 필요하다는 결론에 도달하게 된다. 제 4 장에서는 국제위법행위를 행한 국가에게 수반되는 국가책임에서 확립된 피해자 구제의 기초적인 틀을 살펴보고, 현존하는 국제인권 규범들의 주요 구제기구 들에서의 적용실태를 면밀히 검토한다. 그리고 이러한 과정을 통해 구체적이고 실질적인 기준들을 추출하여 중대한 인권 침해의 발생시 피해자의 구제가 갖추어야 할 최소한의 기준을 제시하고자 한다. ; In situations where gross violations of human rights has waken place, the issue of where to draw the line in deciding to provide remedy or the issue of accepting the method of remedy for the victims is a matter of value rather than a matter of law. However, value itself cannot be determined apart from facts and law, Therefore, the concept of human right can be compared to a triangle with 3 sides called ‘fact’, ‘law’, and ‘value’. The sound and the tone varies according to what stick one uses to hit what problem is that in the actual process of discussing a remedy of human rights, numerous people bang on the instrument with thick sticks. Unless one has an exceptionally good ear, one cannot distinguish the best sound. One needs a musical score even in playing such a simple instrument as a triangle. In the same way, we need at least a few fundamental principles that can harmonize law, reality, and value in order to achieve a remedy of human rights. Amidst rapid industrialization and industrialization, numerous international disasters are occurring due legal defects. Nevertheless, international analysis of such catastrophes, international control, international remedy of victims’ rights is insufficient. In these circumstances, the role of international organizations as a remedy center of human right is very limited and victims are looking for more effective and speedy means of remedy of human rights. Chapter 2 of this thesis depicts the transnational public law litigation active in American courts as an example of such efforts. In discussing representative transnational public law litigation, chapter 3 analyzes Bhopal lawsuit filed by victims of Bhopal disaster which occurred in India in 1984. The Bhopal disaster, which resulted from the international transfer on toxic materials by a multinational corporation, clearly demonstrates the nature of disasters. The suit filed by the Indian government on behalf of the victims in a U.S. court was taken back to Indian because of “forum non convenient”. Consequently, the parties reached dissatisfactory court reconciliation with the actual victims thoroughly isolated from the complicated legal process. This case clearly displays the content and the limitations of transnational public law litigation. The fact that the victims of the Bhopal disaster ended up receiving of damage caused by such catastrophes and the difficulty of brining actual remedy in these situations. Therefore, in order to guarantee remedy for victims of international disasters, we conclude that minimum amount of international standard and principles are necessary. Chapter 4 discusses the fundamental framework of remedy for victims based on state responsibility felf by nations which have committed internationally wrongful act. I have also examined the extent that existing international human rights norms have been applied by major international organizations. Through this process, I have sought to distinguish specific and practical standards and propose a minimum standard of remedy for victims of gross violations of human rights.
