Abstract
In 2005, the World Health Assembly(WHA) agreed to adopt a new International Health Regulations(IHR) that would play a central role in responding to global threats on public health. The new IHR represents a monumental change in the Global Health Governance(GHG) by reflecting the complex issues of global health problems and conflicting interests of many stakeholders such as non-state actors. Focusing on the change of the IHR regimes, this thesis explicates the evolution of the international health governance and discuss its implications in international relations. The historical origin of the IHR and the GHG can be traced back to the International Sanitary Conference(ISC) that started in 1851. European countries had been troubled by communicable diseases like Cholera, so that they convened to the ISC which became the test-bed of the IHR in 1969. The early IHR had provided a framework to cope with international health risks over 30 years. It had provided limited health measures for member countries to fight over specific epidemics and diseases. As an international law, the IHR had requested each state authority to get ready against global health risks while improving their national capabilities and sharing information on communicable diseases by giving notice to the WHO. The new IHR revised in 2005 included a couple of innovative changes. Three differences between the older IHR and the new one are discussed in this thesis. First, the new IHR expands the scope of applicable diseases in the list of regulation. It replaced the short list of disease with more. Second, international cooperation against communicable diseases was extended to the local level beyond the national level. Regulatory obligations that each state should follow are expanded to inner regions of a country beyond border areas. Lastly, the new IHR strengthened the authority and commanding power of the WHO. State members are expected to take more burden in dealing with international communicable diseases. The revision of the IHR in 2005 was reflecting the accelerated trend of globalization in the 20th century. Globalization, economically as well as politically, has increased the level of interdependence within global village along with the development of technologies. This changes has made international public health risks more complex to solve and to manage. As such, international cooperation and collaboration are needed to handle a series of global health problems more efficiently. In order to achieve a satisfactory level of public health at the global level, these changes in the IHR can be regarded as a new paradigm in facing the challenging unstable and unpredictable threats in global public health. However, the story has not ended at all with these developments. The evolution of GHG should overcome a lot of unprecedented obstacles in the future. The case of Indonesia tells a story of this future agenda in the GHG. Indonesia, even after having agreed in the revision of the IHR in 2005, decided that they would withhold providing samples of avian influenza virus A(H5N1) to the WHO and other countries in 2007. This decision has made the cooperative mechanism around the IHR and the WHO less rosy as expected in 2005. The case, as discussed in this thesis, the current GHG has not satisfied all the member countries of those international regimes. The participation of many transnational corporations and NGOs also has made the working of the GHG more complicated beyond the inter-state negotiation processes. Along with these limitations, Indonesia decided not to cooperate to the global system that might have contributed only to the advanced countries and transnational corporations. As discussed in this thesis, the GHG may have to be understood as a global problem-solving mechanism that cannot be approached by individual countries. As global public health issues emerge and decline, diverse actors in the GHG participate in the agenda-setting and problem-solving mechanisms in order to reshape the mechanism for their advantages. The history of the GHG so far has been an effort to block those problems, but it seems that any successful results have not yet reached in global public health issues. The future of the GHG, as this thesis explained and diagnosed, should go further for much more unpredictable and complicated problems.;2005년, 국제보건위기의 중심틀로 자리잡았던 국제보건규칙(International Health Regulations: IHR)의 개정안이 세계보건총회(World Health Assembly: WHA)에서 통과되었다. 개정된 IHR은 새롭게 인식되는 국제보건문제들과 다양한 비국가행위자들의 등장을 반영하며 국제보건거버넌스(Global Health Governance: GHG)의 변화를 드러내고 있다. GHG의 변화에 대한 조명은 보건 분야의 지구적 문제에 대응하고자 하는 국제사회의 노력을 어떤 시각에서 살펴보아야 하는지를 제시해준다. IHR을 중심으로 하는 GHG의 기원은 1851년부터 시작된 국제위생회의(International Sanitary Conference: ISC)로 거슬러 올라간다. 19세기 중반 콜레라를 비롯한 탈국경성 전염병들로 인해 피해를 입던 유럽 국가들을 중심으로 시작된 ISC는 1969년 IHR의 기본 토대가 되었다. 기존의 IHR은 특정 전염병의 감시와 개별 국가들의 대응 체제 등을 제시하며 국제보건위협에 대한 틀을 제공했다. IHR은 특정 전염병들이 국제교통에 가하는 제한을 최소한으로 줄이기 위해 개별 국가들이 해당 질병들에 대해 취할 수 있는 위생 조치들이 명시했다. 국제법의 위치에서 IHR은 국가들에 전염병의 감시 및 대응 의무를 부과하였다. 개별 국가들은 특정 질병들이 자국에서 발병하는 경우 WHO에 반드시 해당 사실을 고지해야 했으며, 이는 모든 회원국들에게 알려졌다. 또한 항구 및 공항과 같이 국경을 출입할 수 있는 지역에서 기본적인 위생 시설을 갖춤으로써 대상 전염병들이 확산되는 것을 방지하고 대처할 수 있는 능력을 요구하였다. 이 시기의 국제적 협력에서는 국가가 주체적인 행위자였으며, 그 외의 행위자들은 큰 영향력을 미치지 못했다. 그러나 개정된 IHR은 1969년 최초로 등장하여 30년이 넘는 시간 동안 유지되어오던 과거의 IHR과 구분되는 혁신적인 변화를 포함하고 있다. 먼저, 2005년의 IHR은 보다 적극적인 입장에서 국제보건위기를 조명하면서 대상 질병을 광범위하게 확장하였다. 국제적 관심사로서의 공중보건위기(PHEIC)라는 새로운 개념을 도입하면서 고정된 질병 목록에서 벗어나 광범위한 국제보건위기를 다룰 수 있게 되었다. 또한, 새로운 IHR은 국가 차원에서 나아가 지역 수준에까지 영향력을 확대하였다. 항구와 공항 등 국경 지역에만 한정되어 있던 전염병 감시와 대응 체제를 지역 수준에까지 확대함으로써 국내에까지 국제보건문제를 확장하였다. 마지막으로, 개정안에서 WHO는 개별 국가들의 협력을 이끌어 낼 수 있도록 입지가 더욱 강화되었다. 개별 국가들은 전염병을 감시하고 방지하기 위해 준수해야 하는 의무가 늘어났으며, WHO를 중심으로 보다 긴밀한 협력이 요구되었다. 이러한 변화는 20세기에 가속화된 세계화의 큰 영향을 받았다. 세계화는 교통, 통신의 발달과 함께 국제사회의 상호의존을 증가시켰다. 이는 국제보건위기를 보다 복잡하고 관리하기 어려운 문제로 만들었다. 국제사회는 국제보건과 연관되어 발생하는 일련의 지구적 문제들을 해결하기 위해 협력은 선택의 문제가 아닌 필수적인 것임을 인식하였다. 그와 더불어 국제사회는 과거 국가를 중심으로 한 접근법이 아닌, 다양한 비국가 행위자들의 자원과 전문성을 이용한 새로운 접근법을 시도한 것이며 IHR 개정은 바로 이러한 노력을 보여주고 있다. 그러나 2007년에 발생한 인도네시아의 샘플거부사례는 IHR 2005년 안의 실효를 앞두고 발생하면서 새로운 지구적 거버넌스 한계를 보여준다는 비판을 받았다. 2005년 발생한 인플루엔자의 인간 감염은 과거 SARS의 기억으로 인해 국제사회를 긴장하게 만들었다. 인도네시아는 2007년 WHO의 샘플 공유 메커니즘에 불만을 품고 인플루엔자 샘플 중단을 선언하였다. 이는 현재의 국제보건협력이 자국의 이익을 우선시하는 국가 중심의 거버넌스에서 벗어나지 못했음을 보여주는 것이라는 GHG 비판의 근거로 제시되었다. 하지만, 오히려 인도네시아의 사례를 통해서 한층 GHG 내부의 복잡한 이해관계와 행위자들의 부상을 엿볼 수 있으며 GHG가 계속해서 위기에 대응하여 변화해 가고 있음을 알 수 있다. 세계화로 인한 지구적 문제의 대두가 IHR의 획기적인 개정으로 이어졌듯이, GHG는 위기에 대응하여 지속적으로 변화해왔다. 특정한 행위자가 주도가 된 문제 해결이 아니라, GHG 내의 행위자들이 문제를 어떻게 인식하고 해결 매커니즘을 형성하는가에 대해 주목할 필요가 있다. 결국 GHG 내부에서 지구적 위기에 직면할 때마다 행위자들 간의 영향력이 어떻게 변화하고 해결책을 형성하는지를 살펴보는 것이 중요하다.
