Abstract
This study analyzes sex discrimination in the workplace in Canada by examining the significant developments over the last three decades. It also provides suggestions for the Korean system. Canadian anti-discrimination legislation has developed alongside human rights statutes. In the context of employment, all of the judicial jurisdiction's human rights statutes prohibit discrimination on a variety grounds including "sex." Overall, the judicial system has been very progressive in its interpretation of discrimination. The Canadian system understands equality as "substantive equality" under the Canadian Charter of Rights and Freedoms. This has led to the introduction of a system of equity in order to realize equality in reality. The legal effectiveness of human rights legislations has been possible because of the nation's foundation, which has been built on multiculturalism, equality, and freedom. The judicial system including the Human Rights Tribunal has interpreted human rights legislation from an objective point of view. In Canada, the courts including the tribunal have placed greater concern on finding a fundamental remedy for the victims of a wrongdoing rather than on dispensing punishment or penalties on the perpetrator. By defining the concept of discrimination which is applied in the human rights statutes, Canada has been able to expand the scope of what constitutes prohibited discrimination in its human rights legislations. In Canada, prohibited discrimination is categorized as follows: direct discrimination, adverse effect discrimination, and systemic discrimination. Direct discrimination can be intentional (that is, based on evil motives), unconscious, or stereotyped. It occurs when an employer adopts a policy, rule or practice on its face differently on prohibited grounds. Adverse effect discrimination occurs when an employer adopts a policy, rule or practice for genuine business reasons, seemingly neutral and applied equally to all individuals, yet it has the effect of discrimination against an individual or a group based on prohibited grounds. The remedy for the victim's damages for these two types of discrimination is based on individual complaint-based litigation. Systemic discrimination defines results from the simple operation of established procedures of recruitment, hiring, and promotion, none of which is necessarily designed to promote discrimination. Systemic discrimination includes direct and adverse effect discrimination, and it is a much more widespread concept. A complaint of systemic discrimination is different from one based on individual complaint-based law. It requires the establishing of patterns of discrimination and the showing of disproportionate impact on certain protected groups. Systemic discrimination theory provides the legal theory for employment equity and affirmative action measures to remedy a case in a proactive way. In addition, Canada adopts employment equity for resolving systemic discrimination. This is because the best way to combat discrimination is through prevention rather than by addressing the complaint with litigation. In Canada, employment equity is subject to affirmative action or special employment measures (as defined in human rights legislation) and employment equity system (as defined in the Employment Equity Act). Based on this examination, this study suggests that Korea consider several measures in order to improve gender equality in the context of employment: 1) create and adopt a "Fundamental Human Rights Act"; 2) establish a "Human Rights Court" (within the judicial system) with remedial power over human rights cases; and 3) create and adopt an "Employment Equity Act." First, a "Fundamental Human Rights Act" should be created. It should provide a concept of discrimination that defines direct and adverse effect discrimination, and systemic discrimination; define the methods of justification defence on discrimination with a more explicit test; define the burden of proof more clearly such as prima facie case; provide for the establishment of a "Human Rights Court" in order to provide more effective remedies to realize equality; and give the Human Rights Commission legitimate power as a "party" to human rights proceedings. Second, a "Human Rights Court" should be given the power to remediate human rights cases. Furthermore, such a court should be given the authority to order the affirmative action or employment equity measure for remedying the systemic discrimination. Third, to help eliminate systemic discrimination in the workplace, what is needed is an "Employment Equity Act" that ensures equal opportunities in employment and removes employment barriers of systemic discrimination, which also requires the "accommodation of differences" for the disadvantaged groups. Different from individual complaint-based laws, this new employment equity act must address discrimination in a proactive way by imposing positive and proactive obligations on employers to provide equal opportunities without prejudice or stereotype and to maintain equity in the workplace.;캐나다는 고용상 차별법리를 ‘헌법’과 ‘인권법’이 추구하는 법목적적인 관점과 사회의 공동선이 추구하는 매우 적극적이고 과학적인 방식으로 접근․발전시켜 왔다. 이러한 관점들은 그동안 차별 법리와 관련하여 도약의 발판을 제공했던 캐나다의 주요 판례에 잘 드러나 있다. 본 연구는 성을 이유로 한 고용상 차별과 정당성 항변 및 구제방식을 캐나다 제도를 중심으로 논의한다. 성을 이유로 한 고용상 차별에 대응하는 캐나다의 제도와 법리를 면밀히 검토함으로써 차별에 대한 다양한 이론적 근거를 찾고자 하는 것이다. 캐나다 인권법제에서 정의되는 차별에는 직접차별, 불리한 결과적 차별, 그리고 구조적 차별이 있다. 직접차별은 고용규정 또는 고용행위가 선의, 배려 또는 무의식적으로 행해진 것이라 하더라도 외관상 차등대우의 대상이 되는 경우에 인정된다. 불리한 결과적 차별은 고용규정 또는 고용행위가 진정한 사업상의 이유로 외관상 중립적으로 행해진 것이라 하더라도 특정인 또는 특정 집단에게 불리한 결과를 야기하는 경우까지 차별의 범위를 확장한다. 뿐만 아니라 그러한 차별이 구조적인 것에서 발생하고, 장래에도 동일 또는 유사한 차별적인 패턴을 형성하는 구조적 차별 역시 인권법에서 보호하는 차별로 본다. 그런데 직접차별 및 불리한 결과적 차별은 과거의 침해에 대한 구제로서, 외관상 차등대우와 진정한 사업상의 이유로 채택된 중립적인 기준이라는 각각의 특징을 전제로 구별되는 것이었다. 또한 주장된 차별이 직접차별인지 또는 불리한 결과적 차별인지의 여부에 따라 정당성 항변방식과 구제방식에서도 다른 접근법을 적용하였고, 그 결과 법적효과 역시 다르게 나타났다. 직접차별과 불리한 결과적 차별의 양분된 구도에 따른 접근법은 메이오린 판결이 있기까지 계속되었다. 1999년 대법원은 메이오린 판결에서 직접차별과 불리한 결과적 차별의 차별 판단을 통합된 접근법으로 변경하였다. 이로써 “직접차별과 불리한 결과적 차별”은 정당성 항변방식과 구제방식에서 통합된 접근법을 따르게 되었다. 하지만 기존의 차별의 인정범위는 인권위원회 또는 인권심판소가 주장된 차별의 입증에서 여전히 주요한 판단근거로 작용한다. “직접차별과 불리한 결과적 차별”의 통합된 접근법은 차별행위에 대한 항변방식과 구제방식 등에서의 통합을 의미하는 것이기 때문이다. 한편, 구조적 차별은 장래의 침해에 대한 구제로서 직접차별 및 불리한 결과적 차별과는 다른 구분된 접근법을 따른다. 1987년 국가철도공사 사건에서 연방 대법원은 ‘구조적 차별’을 인권법에서 보호하는 차별의 범주에 포함되는 것으로 선언하면서 인권법상 인정되는 차별의 범주에 구조적 차별이 포함되기 시작했다. 구조적 차별의 인정범위는 캐나다 차별 법리의 적용에 있어 중요한 지위를 차지한다. 직접차별과 불리한 결과적 차별의 경우 차별 피해당사자에 대한 과거의 침해를 구제하고, 차별적인 것으로 판단된 해당 규정은 효력을 잃거나 변경된다. 이때 구제방식은 구제신청에 기초한 피해당사자의 과거 침해의 구제모델에 한정함으로써 개별 피해당사자에 대한 과거의 침해를 소급적이고 소극적으로 구제하는 방식으로 접근한다. 그러므로 국가철도공사 사건에서 구조적 차별의 구제방법으로 명령되었던 적극적 고용조치와 같이 장래를 향한 불특정 다수에 대한 구제방식은 구조적 차별로 인정되는 경우에만 유효할 수 있다. 구조적 차별은 인권법상 적극적 고용조치 명령의 법적 근거가 될 수 있을 뿐만 아니라, 고용형평법상의 준거가 된다. 반면, 직접차별과 불리한 결과적 차별 개념과는 다른 몇 가지 판단요소가 요구된다. 첫째, 고용제도상의 행정적인 구조의 반영, 조직(기업)문화, 그리고 보호되는 집단의 해당 분야에서의 과소대표 여부이다. 둘째, 그것이 장래에도 지속·반복적인 패턴을 형성하는지 여부이다. 그러나 구조적 차별로 정의될 수 있는 모든 차별양상이 적극적 고용조치 명령이나 또는 강행법으로서 고용형평법의 적용 대상이 되는 것은 아니다. 하지만 차별이 구조적인 양상을 포함하는 경우에는 인권법상 구제신청에 기초한 구제로서 적극적 고용조치 명령의 대상이 될 수 있고, 고용형평법이 적용되는 관할내의 특정 규모 이상의 사업장은 고용형평법상 규제에 기초한 고용형평제도의 적용대상이 될 수 있다는 점에서 구조적 차별법리는 중요한 의미를 가진다. 따라서 직접차별 및 불리한 결과적 차별과 구조적 차별의 인정범위의 구분된 획정은 캐나다의 차별 판단과 구제에서 필수적으로 요청되는 부분이다.
