Abstract
This dissertation treats the general tendency of feminine crime in Korea. The statistical, approach to feminine crimes treated here from 1964 to 1970 is based on the report, "Crime Analysis" issued by Supreme Prosecutor's Office. The emphasis of this dissertation is the positivistic method. The positivistic method developed from British empiricism is that they view crimes as a social phenomenon where the causal law dominates, not as the metaphysical matter based on human free will. Positivists who claimed the societal character of crime divided external cause and internal cause in their pattern of causation and developed the two in various ways. As the result of their research, we could find the fact that the rate of the feminine crimes was very low due to woman's physical fragility and physiological limit, comparing with the man's crimes. But the situation has changed. Recently feminine crime became an important object of criminologists and it appears to be a serious social problem. Great streams of social change in this century were the Youth Culture and Woman's Liberation Movement. Woman' lib connotes very important significance. Democracy or liberalism as social odor allows a great deal of freedom of individual action, that is, the extension of actional sphere. But unfortunately this extension brings about the increase in conflicts. The extension of woman's rights means the social, economic, political, and educational enhancement of woman's position and participation, and pursue the relative equality with ran in society, But, as I mentioned above, the extension necessarily accompanies a great deal of conflicts in woman's action and thought. So the increase of feminine crime that ensues from the extension of woman's rights is an inevitable phenomenon. Feminine crime by external causes or by internal causes is on a continual increase. Towering from this idea, the author carried out a research into the woman's crime in Korea. The research resulted in the fact the crimes are increasing by four percent per year. And the malign character in them which is not usually found in other countries is noticeable. The character is masculine tendency and malignancy of technique and tactics. This is very peculiar to Korean crime. This cones out of the transitory process moving from Great-Familism to Small Familism. And this is also due to the extension of woman's social participation. So the social welfare system for woman is imperative and the political, economic, and social stabilization is also necessary. The whole construction of this dissertation is that the first chapter deals with the personal causes and environmental causes to abstract the : constitutional peculiarity of feminine crimes inductively, and other chapters show the masculinization of feminine crime, the present phenomenal indication, the causational illustration, and concluding appraisal.
