해양국제법의 분류기호 전개방안에 관한 연구

Abstract

Present DDC 19，LC schedule, and KDC 3 are deemed entirely inadequate for modern concept of international law of the sea. Particularly， they are inadequate for special libraries of extraordinarily large collection in this subject to meet the requirement of modern literature and to satisfy the needs of users. The purpose of this study is to prepare an expansion of classification number of international law of the sea both in detail and in order in classification systems which can accommodate the great breadth and depth of knowledge， Due to limitation in LC and KDC on this subject, this study focuses on DDC 19, and two alternative provisions are prepared for DDC 19 (1) Expansion (Use of the existing class number 331.44-45 and 341.756) The features of expansion method is to: 1. Use existing class number 341.44，341.45，and 341.756. 2. Detailize the subdivisions of the territorial sea and the hish sea. 3. Make some subsections. The major merit of this method is that it doesn't make a confusion to a basic classification schedule, but is inadequate to build a new number to a new knowledge, and separates like materials, which results in unlike materials in between. (2) Phoenix schedule (Provision of completely new development of schedule) The characteristic features are as follows: 1. Recast items from the former 341.44 and 341.45 to recently vacated number 341.8 as base number, and make the same to the water transportation concepts within 341.756. 2. Detailize divisions of the territorial sea and hish sea. 3. Make new subdivisions easily. 4. Assign the numbers according to mnemonic of the D.D.C. 5. Easy to build new numbers by using empty digit. The merits of the second method can compensate the defects of the first method, i.e.，it will be easy to assign new digits to, the additional entries, and as the degree of the assigned digit is so big, the additional build of new entries will be freer than that of the first idea, and as the related data of international law of the sea will not be scattered, but collected together, it will be more profitable in arranging and using book stacks.;본 논문은 해양국제법의 분류기호 전개방안에 관한 연구이다. 현행 분류표로는 세분화 되는 신학물인 해양국제법분야의 주제를 모두 포용하기 어려우므로 이를 현실에 맞게 수정 전개하여 해양법을 연구하는 대학원생, 교수를 위한 대학의 법률도서관이나, 해양법회의에 참석하는 요원들을 위한 해양법연구소의 자료정리를 위한 시안제시가 목적이다. 연구방법은 KDC, DDC, LC의 3개 분류표를 중심으로 항목설정과 판의 변천에 따른 항목의 증가사항, 세분화, 번호배정등의 변천사항을 비교하였다. 그 결과 현행 분류표의 문제점으로 지적된 사항은 다음과 같다. 1. 설정된 항목수가 미비하다. 2. 이미 설정된 항목도 세분화되어 있지 않다. 3. 분류번호 및 분류표내의 위치가 자주 변하여 일관성이 없다. 이러한 문제점을 해결하기 위하여 새로운 전개방안이 필요하다. 새로운 전개방안은 DDC를 중심으로 전개되었다. 새로운 전개방안에는 두 가지 방법이 있는데 Ⅰ안은 소극적인 방법으로 분류표의 기존 틀을 그대로 살리는 방법이며 그 특징은 1. 341. 44~45, 341. 756에 분산된 해양법의 번호를 그대로 사용한다. 2. 영해와 공해의 두 세목을 세분화시킨다. 3. 새로운 항목은 추가 설정한다는 것이다. 이 방안의 장점은 기존 분류표에 혼란을 주지 않는다는 것이나 새로운 항목이 나타났을 때 적절한 번호배정이 어렵다는 한계점과 해양국제법의 자료가 분산된다는 단점을 지니고 있다. 이러한 단점을 보완하기 위한 적극적 방안으로 Ⅱ안이 제시되는 Ⅱ안은 해양국제법을 341. 44와 341. 756에서 끌어내서 국제법 분류표의 마지막에 341. 8이란 기본숫자(base number)를 배정하며 별도의 항목을 설정하여 전개하는 방법이다. Ⅱ안의 특징은 1．341. 44~341. 45의 난은 empty digit으로 비워두고 여기에 분류되던 것을 341. 8아래 분류하고 341. 756에 분산되던 해상수송의 개념도 341. 8아래로 합친다. 2. 영해와 공해의 두 항목을 세분화시킨다. 3. 새로운 항목을 추가 설정한다. 4. DDC의 조기성을 살려서 번호를 배정한다. 5. empty digit을 사용하여 새로운 항목의 번호배정을 용이하게 한다. Ⅱ안의 장점은 Ⅰ안의 단점을 보완할 수 있다. 즉 새로 추가 설정된 항목에 번호배정이 용이하며, 해양국제법에 배당된 번호의 비중이 크므로 새로운 항목의 추가 설정이 Ⅰ안보다 자유롭고, 해양법 관계자료가 분산되지 않고 한 곳에 모임으로서 서가배열 및 이용에 유리하다. 항목설정에서는 기존 분류표에 설정된 항목을 망라하고 부족한 항목설정은 제3차 UN해양법회의의 해양법 협약안과 국제법 관계문헌의 목차 및 전문가의 조언을 바탕으로 하였다. 각 항목의 순위 결정은 순위결정의 이론적 원칙을 근거로 주제의 상호관련도가 깊은것끼리 인접시켰다. 또한 조기성을 살려 일반형식구분과 지역구분을 사용했다. 해양국제법과 우리나라와 직접 관련되는 것은 독도 및 서해5도의 영유권 문제, 제7광구와 한·일·중국과의 3각관계, 200 해리 경제수역 선포로 인한 우리의 원양어업문제, 국제해협의 확대로 인한 우리의 제주해협, 대한해협의 문제, 공해문제, 심해저개발문제 등이다.
