Abstract
본 논문은 北魏 時代(386-532), 161명의 門下侍中에 관한 구체적인 분석을 통해 門下侍中의 권한이 이 시대에 특히 강했던 원인은 무엇이며, 이것은 北魏의 정치적 특수성 내지는 南朝의 상황과는 어떠한 관련성 내지는 차이점을 갖는지 구명하고자 하였다. 또한, 문하시중의 性格 및 政治的인 機能의 변화상에 주목하여 이러한 변화의 시점과 계기, 그리고 변화상 등을 북위의 정치 상황과 연결해서 고찰하고자 하였다. 門下侍中은 본래 秦代 少府의 屬官으로 皇帝의 左右에서 近侍하면서 拾造補闕, 切問應對, 尙書奏事의 처리 등을 담당하던 근시관이었다. 이러한 문하시중은 이후 西晋 時代에 門下省이 하나의 省으로서 체제가 정비되면서 권한이 한층 강화되어 宰相의 지위에까지 올랐다. 북위시대의 문하시중은 道武帝 皇始 年間(396-398)에 尙書省을 비롯한 百官과 비슷한 시기에 설치된 문하성의 장관으로서 太和 15년(491) 이전에는 定員이 없는 加官이었다. 이들 시중은 가관이었기 때문에 他官에 의한 兼職 比率이 상대적으로 높았으며, 민족 구성의 측면을 보면, 鮮卑族이 다수를 차지하고 있다. 하지만, 태화 개혁을 기점으로 漢人 출신의 비율이 높아지면서 이러한 경향은 다소 감소하였다. 뿐만 아니라, 문하시중의 출신 가문을 살펴보면, 士族 출신이 전체의 약 74.7%를 차지하고 있으며, 小姓이나 寒素 출신의 비율은 尙書令이나 中書監令의 경우와 비교하면 상대적으로 높은 수치이다. 문하시중에는 대체로 황제의 측근이나 儒學者 계층이 중용되는 것이 일반적이었다. 물론 북위 시대에도 예외는 아니지만, 당시에는 外戚이나 宗親의 시중 선임이 前代보다는 상대적으로 적었다. 이것은 선비족 고유의 兄弟相續 制度나 외척의 발호를 억제하기 위해 皇后를 살해했던 제도에 의해서도 설명이 가능하다. 북위 문하시중의 직장관 권한은 황제를 좌우에서 보좌하는 것 이외에 황제의 下問에 대한 應對나 出納詔命, 尙書奏事의 管掌 등으로 크게 나누어 지는데, 당시에는 선비족 기원의 內官職 역시 위와 같은 직능을 담당하고 있었다. 북족고유의 내관직은 주로 出納詔命이나 顧問應對, 그리고 官僚의 監察 등의 업무에 종사하고 있었는데, 이들의 이러한 성격으로 미루어 본다면, 북위에도 문하성과 유사한 좌우근시의 관직이 이미 존재하고 있었음을 알수 있다. 시중은 顧問應對의 직무를 수행했는데, 이것은 황제의 일상적인 하문이나 국정 전반에 걸친 고문에 응대하는 것으로서, 북위 초기에는 이 직능을 文才가 뛰어난 中書省의 관원들도 중복적으로 수행하였다. 시중은 詔命의 出納에도 관여하였는데, 이들은 조칙의 공포 이전 參議의 과정에서 조서의 법적 타당성 여부를 논의한 후 이것을 황제의 비준을 거쳐 공포하도록 하달하였다. 그리고 시중의 직권 중에는 관료에 대한 감찰권이 있다. 이 관료 감찰권은 본래 御使臺의 권한이지만, 天興 4년(402) 이후 어사대의 권한이 內朝에 귀속되면서 문하시중도 감찰권의 일부를 행사하였다. 특히, 이 권한은 북족계 내관직의 관원들에게서도 역시 찾아볼 수 있다. 시중은 황제의 의지를 전달하는 使者의 역할을 담당하기도 하였다. 이들은 외국에 사신으로 파견되거나 지방에 勅使의 자격으로 파견되었는데, 이런 경우에는 주로 本官 侍中보다는 겸임이나 임시로 임명된 상태에서 파견되는 것이 일반적이었다. 尙書奏事를 사전에 심의하는 권한은 문하시중 고유의 권한으로, 조서의 기초가 되는 상서주사에 관해 문하시중은 황제의 裁可 이전에 論駁을 행하였고, 이 과정에서 尙書省의 전횡을 간접적으로 견제하기도 하였다. 또한, 시중은 加官인 경우가 다수를 차지하였기 때문에 상서직을 겸임하면서 상서성의 행정적인 업무에도 관여하였다 그런데, 북위 전기에는 상서직을 본관으로 하면서 시중직을 가하는 경우가 대부분이었기 때문에 奏事에 대한 駁奏 또한 별다른 실효를 거두지는 못했으며, 이 과정에서의 시중의 영향력 또한 크지 못했다. 太和 17년(493)을 기점으로 단행된 孝文帝의 태화 개혁은 북위시대의 성격을 전후기로 구분짓는 기준이 되었는데, 문하성 및 시중도 이 개혁에 의해서 성격 및 기능상의 변화를 보인다. 먼저 태화 개혁을 기점으로 문하성 관원들과 유사한 기능을 수행했던 북족계 내관직이 폐지되면서 이들의 정치적 역할의 대부분을 문하시중을 비롯한 관원들이 총괄하게 되었다. 또한, 태화 15년(491)에는 시중의 정원이 4명으로 정해졌는데, 이것은 종래에는 가관이던 시중직이 비로소 황제를 실질적으로 보좌할 수 있는 實官으로 변모했음을 보여주는 것이라 하겠다. 그리고 문하시중의 경우 文才를 겸비한 상당수의 한인이 등용되면서 시중을 포함한 문하성 내부의 인적 구성에도 변화를 보였다. 북위 시대의 문하시중은 輔政을 담당하면서 그들의 정치적인 권한을 강화하여 宰相의 지위에까지 오르게 되는데, 이러한 상황은 시중의 정원이 정해지는 태화 개혁 이후, 특히, 孝明帝 正光 年間(520-525)에 두드러지는 경향을 보인다. 물론 북위 시대의 輔政者가 문하시중과 반드시 일치하는 것은 아니었지만, 당시의 보정이 문하에서 시중에 의해서 이루어졌다는 것은 당시 문하시중의 정치적 위상이 그만큼 높았음을 보여주는 것이 된다. 태화 개혁을 기점으로 문하시중의 정원이 정해지기는 했지만, 후기에도 시중의 兼職 事例는 빈번하게 발견된다. 하지만, 여기서 주목해야 할 것은, 후기에는 本官 侍中의 비율이 증가한다는 점과 시중의 겸직 사례 자체가 감소한다는 것이다. 시중의 가관적인 성격 때문에 전기에는 尙書奏事에 대한 駁奏나 행정 업무에 대한 관여 자체가 그다지 큰 의미를 갖지는 못했지만, 시중직을 본관으로 하면서 他官을 겸임하는 사례의 증가는 사실상 시중직의 실질적인 권한의 확대를 의미한다. 또한 시중의 겸임 사례 자체의 감소는 종래 시중의 散官的인 측면이 배제되었음을 보여주는 것이다. 본관 시중의 비율이 증가하면서 상서주사에 대한 문하시중의 駁奏 또한 전기와는 달리 강도높게 행해져서 황제의 주사 재가 여부가 사실상 시중의 駁奏에 의해서 결정되었다. 뿐만 아니라, 황제가 人事權을 행사하는 경우에도 문하시중의 覆奏가 필요할 정도로 시중의 권한이 강화되었다. 그러자 황제는 시중의 독단을 방지하기 위해 중요 사안인 경우 상서성과의 합의를 명령하기도 하였다. 문하에서 輔政이 이루어지면서 시중은 상서주사에 관한 論駁에 이어 중서성의 草制權의 일부까지를 이관한다. 草制는 본래 중서 고유의 권한이었으나, 문하의 권한이 강화되면서 시중과 給事黃門侍郎이 중서, 문하의 업무를 총괄하게 되고, 이어 초제가 문하에서 행해지게 되었다.;The govermental organization of the Northem Wei(北魏) dynasty was a combination of nomatic and Chinese systems. The government organization of the Toba-wei(拓跋 魏) was existed in between those of the Wei(魏) and Chin(晉) dynasties and those of the SUi(隋) and T'arig(唐) dynasties. My primary purpose is to show the functions, organizations and variations of the Men Hsia Sheng(門下省) and Men Hsia Shih Chung(門下省) of the Northern Wei dynasty. And what I want to discover is that why the power of the Men Hsia Shih Chung strengthens after the T'ai-ho Revolution(太和 改革), also I would like to clarify that reason. In order to understand Sih Chung(侍中) of the Northern Wei dynasty, this study dealt with the following matters ; the origin of the Men Hsia Sheng, its organization, the authority and capacity of the Men Hsia Shih Chung and the function changes and characteristics of the Men Hsia Shih Chung after T'ai-ho Revolution. Originally, Men Hsia Shih Chung was the government clerk of the So-bu(少府) in the Zin(秦) dynasty, and the secretary of the emperor. The organization of Men Hsia Sheng included Men Hsia Shih Chung, Huang Min Shl Lang(黃門侍郞), Men Hsia Rok Sha(門下錄事), Men Hsia Ryung Sha(門下令史), etc.. The main organizations under Men Hsia Sheng were about the same as those of Wei and Chin dynasty. A Men Hsia Shih Chung was in charge of the whole office. He was responsible for the drafting of imperial orders and mandates, and thus had access to national and military classified informations. The Men Hsia Sheng had been established by T'ai-tsu(太祖) and lasted through out the whole dynasty. From now on, I'll show the member of the Men Hsia Shih Chung. In the first term of Northern Wei dynasty, Shih Chung was almost an honorary post and an additional job. In addition, the ratio of the royal clansmen and the Maternal relatives, compared with that of the southern dynasties, is less. Among all the Shih Chungs, the man of noble birth is in the proportion of 74.7%, and the man of humble origin is in the proportion of 25.3%. The Toba-race(拓跋族) takes up the majority numbers, while the Chinese are minorities. The learned and virtuous hold an important position. Mostly, they're close to the emperor. There is a special bureaucracy on Northern Wei dynasty, which is the eunuch of Toba-race(拓跋系 內官). The officials of the eunuch had belonged to the Inner Court(內朝). Also, this position was not found in the Wei and Chin dynasties. It seems to have been established by Northern Wei dynasty. The eunuch of Toba-race was similar to Men Hsia Sheng's in its organization and function. Its officials were mainly in charge of inspecting and acting in an advisory capacity. In addition, they occasionally delivered the royal edict(詔命). So, some scholars understand that the Men Hsia Shih Chung succeeded to the eunuch of Toba-race. Through the function between the eunuch and Men Hsia Sheng was the same in some respects, the eunuch of Toba-race didn't report to the throne as the Men Hsia Sheng. Through the eunuch of Toba-race, we knew that the Inner Court had existed since in the first term of the Northern Wei dynasty. But in the process of reforming the government organization, emperor Hsiao-wen(孝文帝 471-499) abolished this position. From now on, I'll explain of the principal functions of the Men Hsia Shih Chung in detail. : First, Men Hsia Shih Chung not only assisted the king night and day in the palace, but also acted in an advisory capacity on the various fields of state affairs. Also, Shih Chung called for a new trial when the memorial which was submitted by Shang She Sheng(尙書省) was madequate. In addition, Shih chung took charge of delivering a royal edict from the king to the administrative machinery. He often inspected the bureaucrat-as his power was expanded, the function of inspection was added-but, the duty originally belonged to the Censorate(Oˇsa-dae 御使臺). And Shih Chung often went on a mission to the foreign country or the provinces. According to this function, we knew that Shih Chung was the man of representing the king's Will. In the 23th year of T'ai-ho of Hsiao-Wen a special degree was promulated for the establishment of a definite secretariat body which was very much an imitation of that in the southern dynasty. From the result of T'ai-ho Revolution, the function and the power of Shih Chung changed compared with the former period on Northern Wei dynasty. From now on, I'll give an example about the changed situation. The most powerful department in the first term of Northern Wei dynasty was the Shang She Sheng of which function and titles were exactly same as those of the southern dynasties. But the authority of the old system was gradually being shifted to the new. that is Men Hsia Sheng. In the first term of Northern Wei dynasty, Shh Chung had become merely consultants without real power. But, the power of Shih Chung was much expanded in the later term of Northern Wei dynasty, so all imperial orders were through him. Originally, the position of Shih chung is an' additional job. So in the first of Northern Wei dynasty, Shih Chung was not only an honorary position but didn't exist a quorum. But, on the T'ai-ho Revolution, four people were assigned for Shih Chung. As a result, Shih Chung was not simply honorary post, any more it carried out its influence over state affairs. Furthermore, in those days, the distribution of the principal of Shh Chung was stronger than before. In those days, Shh Chung strongly applied for a new trial on the memorial which was reported by the officials of Shang She Sheng. Also, Shih Chung even wrote out a royal edict. Primarily, the function of writing out a royal d c t is Zhong She Sheng(中書省)'s responsibility. But as the power of Shih Chung was strengthened, that duty was transfered to the Men Hsia Sheng. So, writing out a royal edict is only the incidental function of Shih Chung. After the T'ai-ho Revolution, Shih Chung mainly took charge of the fu-zheng(輔政). The fu-zheng was the meaning of the political process that the full or a part of the sovereign power moves from the king to any subjects who were entrusted the reins of government by the former or present emperor or the empress dowager. So, Shih Chung, who was in charge of the fu-zheng, was the premier(帝相). On the base of this situation, he extended his power upto threatening the king to what extent. This very characteristic of Shih Chung on Northern Wei dynasty was different from the Shih chung on the southern dynasties. Through the analysis, I was able to reach a conclusion that the Shih Chung had had stronger authority than those of preceding and following dynasties. Additionally, the Shih Chung on Northern Wei dynasty was a complex bureaucracy, mixed by nomadic and Chinese systems. Also, this bureaucracy called 'Shih Chung was a mirror of the characteristics of the Northern Wei dynasty. The Shih Chung grew its power into threatening the king of the Northern Wei dynasty. This was made possible through Men Hsia Shih Chung being appointed to the premier. I did my best to grasp the characteristics and the function of Shih Chung on Northern Wei dynasty in various respects. But it seems that I have a poor grip of the point. For example, I didn't trace the relation of Shih Chung with the king and after bureaucracies sufficiently. I'm not quite satisfied with the matters related to the comparative study of the southern dynasties. So, I hold this problem over till next time.
