한국입양정책에 관한 연구

Abstract

The purpose of this study is to examine the problems of adoption in Korea through its policy and to inquire into the problems of Korean adoption policy. In Korea overseas adoption began as countermeasure for war orphans since the Korean Yar in 1950.Since then, Korea has continued Overseas adoption up to now at which Korea has acquired national power including economic power internationally. Especially the number of overseas adoptee has increased rapidly during the 1980's. This situation can not exclude the truth that domestic adoption in Korea has been in a slump due to cultural tradition in which blood ties has been thought much of. But more important thing is that the Korean government has promoted overseas adoption without other child welfare policies. In this critical standpoint, this study is an attempt to inspect the the developmental process and its character of adoption policy in Korea and to examine the problems of Korean adoption policy. The findings of the study are as follows: First, overseas adoption in Korea has been continued with certain political intention rather than child welfare, The major problems of overseas adoption policy are pointed out as adoption mediate agency' commercialism, concealment on adoption -adoption statistics, adoption policy-as well as the intention of overseas adoption policy. Second, domestic adoption has been focused quantitiative outcome rather than child welfare. The major problems of domestic adoption policy are pointed out as quantitiative-oriented adoption, non-professional agencies the imperfection of adoption law and negative social understanding on adoption. In conclusion, the problem of Korean adoption policy reveal that adoption policy has carried out without a prospect of child welfare.;본 논문은 한국의 입양문제를 국가의 정책과 관련하여 한국입양정책의 전개과정 및 그 특성을 살펴보고, 이를 통해 입양정책의 문제점을 밝히는 것에 그 주요 목적이 있다. 한국에서 해외입양은 한국전쟁으로 인해 생겨난 전쟁고아에 대한 대책에서 시작된 이래 약 40년이 지나 국제적으로 경제력 및 국력이 부상되고 있는 오늘날까지도 지속되고 있다. 특히 1980년대에 들어와서는 오히려 급격한 증가 추세를 보이고 있다. 이러한 현상은 혈연중심의 문화적 전통이 아직도 강하게 남아 있어 국내입양이 저조해 왔다는 점을 그 한 원인으로 들 수 있다. 그러나 더욱 중요한 문제는 기아수의 증가와 함께, 국가가 요보호 아동을 국내에서 보호하려는 적극적인 노력 없이 해외입양을 지속하여 왔다는 사실에 있다. 이러한 점에서 볼 때 한국의 입양문제는 정책적 차원에서 제기되어야 할 문제이다. 이와 같은 문제의식 아래 본 논문은 입양법을 기준으로 한 시기구분에 의해 한국입양정책의 전개과정 및 각 시기에 나타나는 입양정책의 특성을 살펴보고 이를 통하여 한국입양정책의 문제점을 규명해 보고자 한다. 본 논문의 연구방법은 국회 속기록 및 정부간행물, 입양정책 자료 등을 중심으로 한 문헌연구 및 내용분석이며, 입양정책에 관한 자료의 접근이 용이하지 못한데서 오는 제약점을 입양관계자들과의 면담을 통해 보완하려고 노력하였다. 본 논문을 통하여 밝혀진 중요한 사실은 다음과 같다. 첫째, 해외입양은 아동복지적 측면보다는 국가의 다른 정책 - 외화획득 및 이민, 인구, 외교정책 등 - 적 의도를 지니고 지속되어 왔다. 해외입양정책의 문제점을 이와 같은 해외입양에 대한 정책의도와 함께, 입양알선기관의 영리성, 입양통계의 은폐성 등으로 지적된다. 둘째, 국내입양은 아동복지적 측면보다는 수량적 성과를 중요시해 왔다. 국내입양정책의 문제점은 실적 위주의 입양, 비전문적 조직, 부족한 재정, 미비한 입양법 등이다. 또한 정책적으로 입양에 대한 부정적인 사회인식을 전환하려는 노력이 없었던 점도 이의 문제점으로 지적된다. 이러한 입양정책의 문제점은 한국입양정책이 장기적인 발전 전망이나 아동복지의 조망에 근거하지 못한 채 시행되어 왔다는 점을 나타내는 것이다. 따라서 앞으로의 입양정책은 아동복지적 차원에서 올바르게 실행되어야 하며, 이와 함께 무엇보다도 아동복지정책이 거시적 안목에서 추진되어야 한다고 본다.
