The Rule of Law

Abstract

In recent years the rule of law has been considered by many scholars and by the international community as an important component that influences the development process. For this reason, more reform projects to strengthen the rule of law and consolidate democracy are being carried out and supported with official development assistance and technical assistance by the international community, especially in the post-conflict states. Guatemala’s development can be accomplished if the rule of law is strengthened. This requires that the state takes specific measures and includes the necessary elements, such as women’s human rights and government effectiveness in projects it implements to strengthen the rule of law. This thesis hypothesizes that weak rule of law is correlated with government ineffectiveness which in turn contributes to violence against women, a violation of their human rights. In order to demonstrate it, the thesis examines the correlation that exists among the rule of law, government effectiveness, and women’s human rights. The data set that was analyzed consists of the Worldwide Governance Indicators –WGI- generated by the World Bank on the rule of law and government effectiveness. Another indicator that was used to measure women’s human rights consists of femicide rates in Guatemala, as these crimes are considered as the extreme manifestation of the violation of women’s human rights. This thesis analyzes the status of Guatemala with regard to the rule of law and the approach the government has taken for its improvement. It also presents to the reader the shortcomings in the rule of law reform project that was launched in the judicial branch to exemplify the gaps and loopholes. The Government of Guatemala initiated the process to strengthen the rule of law, through the judicial branch reform project, with the support of the World Bank. From this process it was expected to bring forth improvements in the access to justice for all the members in society and therefore strengthen the rule of law. But the rule of law has not improved in Guatemala. Contrary to it, Guatemala is going through a challenging period, where criminality, especially violence against women, has been on a constant rise. The objective of the study has been to examine the issues that need to be addressed and targeted adequately in order to strengthen the rule of law and safeguard women’s human rights, providing a better environment for development. Because what is at stake is the lives of more than half of the population: women.;법의 지배는 많은 경제학자들과 국제사회에서 최근에 과테말라처럼 새로운 과도기와 충돌하고 있는 국가들의 발전에 영향을 미치는 중요한 요소로 인식되었다. 과테말라는 1996년 평화 협정에 조인했는데, 이는 36년 동안의 무력충돌을 종식시키는 것이었다. 이러한 상황은 과테말라가 법의 지배를 강화하는 구체적 방법을 경험하고 실행하도록 세계화 현상과 결합되었다. 실행된 구체적인 정책 가운데 하나는 사법부의 개혁으로, 이것은 사회의 모든 구성원들에게 공평한 정의의 향상을 약속하는 것이었다. 이 과제는 평화협정 의무에 포함되었기 때문에 국가가 수행해야 하는 책임이었다. 과거에 범해진 비효율성과 자의적 행위 때문에 사회는 전체적으로 영향을 받았지만 특히 구체적으로 토착사회와 여성의 경우 더 심한 타격을 입었다. 본고에서는 법의 지배와 정부 효율성, 여성 인권 – 여성 인권에 대한 본 연구를 위해 과테말라의 여성살해율을 이용하였다 - 에 관하여 세계은행에서 제시한 세계통치지표를 고찰, 분석한다. 경험적 데이터는 여성인권과 정부 효율성에 있어서 법의 지배의 중요성을 예증하고 명료하게 설명 해 줄 수 있을 것이다. 이 요소들은 서로 얽혀 있으며 정부관료에 의해 제공되는 공무의 질을 향상시키기 위해서 특수한 측정을 필요로 한다. 과테말라 사법 개혁 ID IBRD-44010은 기존의 연구에서 발견된 결과인 법의 지배와 정부의 효율성, 여성 인권 사이에 존재하는 상관관계를 예증하기 위해서 연구 분석될 것이다. 본 연구의 목적은 법의 지배가 많은 영역을 포함한다는 것을 증명하는 것으로, 이에 여성인권도 포함된다. 따라서 본 연구는 법의 지배 강화의 필요성을 뒷받침한다. 사법부뿐만이 아닌 다른 모든 영역에서도, 더 전체론적인 접근을 해야 한다. 이는 진보와 참여를 증명할 더 나은 측정수단을 포함하며, 공무원에 의한 여성인권의 인식과 내재화, 인구의 과반수인 여성의 권리를 인식하고 재 우선화하는 시스템으로 전환해야 한다. 여성인권은 이미 제기된 과제에 포함되고 다루어져야 할 중요한 요소이다. 과테말라가 WGI에서 매우 낮게 평가되는 것은 대부분 지난 몇 년 간 법의 지배가 후퇴하여 결과적으로 여성살해와 여성에 대한 폭력이 증가했기 때문이다. 여성인권은 사법개혁과 여타의 개혁안에서 우선화되고 목표화되어야 한다. 여성에 대한 폭력이 지속되고 처벌되지 않고, 여성인권이 국가에 의해 무시되는 한, 발전은 정체될 것이다.
