不良住宅再開發事業에 있어서의 住民組合에 관한 硏究

Abstract

都市再開發事業은 事業對象으로 분류하여 都心地再開發事業과 不良住宅再開發事業으로 구분 시행되고 있다. 前者의 事業目的은 주로 都心에 한정되어 非住居用 建築物의 건립을 통해 都心機能의 回復에 있으며, 後者의 事業目的은 不良住宅地域의 住居環境 改善으로 住居機能 회복에 중점을 두고 있다. 「1983年 이후부터 널리 施行되고 있는 合同再開發 方式에 의한 <不良住宅再開發事業>은 住民組合이 施行主體가 되고 民間建設會社에 建設을 依賴하여 시행되는 방식을 의미한다. 不良住宅再開發事業에 있어서의 住民組合은 住民의 복리증진과 事業의 원활한 遂行을 目標로 하는 市當局의 代理的 役割者이며, 동시에 민주적인 住民參與의 組織體이다. 본래 不良住宅再開發事業이 갖는 地域的 與件을 고려하여 住民組合의 役割分析은 時系列分析(Time-Series Analysis)을 할 때 분명한 論理連繫를 보일 것이지만, 硏究其間의 제약으로 부득이 段階別 橫斷面分析(Cross-Sectional Analysis)방법을 택하였다. 本 硏究에서는 合同再開發 방식에서의 住民組合을 4段階의 施行體系로 구분하였는데, 제1단계는 組合結成段階를, 제2단계는 組合認可받은 段階를, 제3단계는 管理處分計劃을 作成하고 施工中인 住民組合을, 제4段階는 事業이 完了되어 竣工 및 解體의 과정에 있는 住民組合으로 나누었다. 이와같이 住民組合을 事業 進行 過程과 맞추어 4段階로 구분한 이유는 住民組合이 갖는 住民參與의 機能的 特性에 의한 것으로, 무엇보다도 住民參與의 正當性이 適法節次(due process of law)에 根據하고 있기 때문이다. 「本 論文 이러한 住民組合의 事業進行別 段階에 따라, 段階別로 1개 地區를 硏究對象地域으로 선정하고, 觀察調査 및 設問調査를 병행하여, 住民組合과 住民간의 갈등, 住民組合의 組織的 特性으로 인하여 事業進行 過程上 겪게되는 不良住宅再開發事業의 順機能 및 逆機能을 도출하려 하였다.」 設問調査를 통한 資料의 分析은 組織的 變數, 環境的 變數, 組織構成員的 變數로 나누어서 不良住宅再開發事業의 全過程에서 나타나는 特性과 事業 段階別 特性 및 변수들간의 交叉分析도 시도하였다. 不良住宅再開發事業의 진행 단계별 住民組合의 役割에 대한 橫斷面分析의 結果는 再開發事業을 수행하기 위해 住民組合이 갖는 代理的 役割者로서의 위치와 事業過程에서 組織構成員 간의 갈등으로 인한 逆機能 및 事業結果가 전반적인 都市空間體系에 미치는 波及效果를 反映하는 것이었다. 事業 段階別 住民組合과 組合員(住民)간의 갈등내용, 갈등의 정도, 事業過程중의 權利變動 比率의 증가 등은 사업자체의 成果가 住民의 번영보다는 場所의 物理的 施設 改善에만 치우쳐 있음을 나타내고 있으며 또한, 事業의 早速推進이나 事業으로 인한 逆效果는 등한시되고 있어서, 여기에 많은 問題點이 시사되고 있다. 組合員의 參與行態 및 住民意思 反映度를 分析한 結果는 事業 初期에 있어 住民組合의 代表性에 대한 住民들의 불만이 강하게 나타나고 있어 組織的 變數의 측면에서 住民組合의 民主的 役割者로서의 機能이 補完될 소이가 있음을 시사해 주고 있다.」;Urban renewal projects in Korea can be divided into two possible categories: (a) central business district renewal projects and (b) squatters renewal projects. The purpose of central business district renewal projects is to revitalize CBD of the city through the eatablishment of central business building with its major concern on urban areas. On the other hand, that of squatters renewal projects is to improve living conditions in designated areas. The squatters renewal based on the citizen union renewal initiatives which has been prevalent since 1983 is now administered by a citizen union. It should be noted that private construction companies undertake the role of constructions. The citizen union just described that plays a valuable role in squatters renewal projects is an agent which is responsible for the enhancement of the welfare of its citizen and should be democratic in its nature. In order to fulfill its responsibility successfully, the citizen union is expected to have systematic management strategies concrete objectives and to diagnose the structure of its citizen's consciousness. In this research, for the purpose of exploring the characteristics of administration of functions played by citizen union, in squatters renewal projects, cross-sectional analysis which is a time-space approach is employed. Utilizing the above method, I attempted to examine the position and importance of citizen union and to analyze its problems and to derive the dysfunctions characteristic of it's organizational nature. It is hoped that my study will play an important role as reference information that will facilitate a number of further renewal projects to be implemented.
