中學校 社會科에서 必要한 法律知識과 그 改善策

Abstract

中 學校 敎育은 敎育法 第百一條 第一號에 依해서 中學生에게 中堅國民으로서 必要한 品性과 資質을 기르는데 그 目標를 두고 있는 것이다. 그러므로 모든 中 學校 敎科書는 敎育法 第百一條(中學校敎育目標)各號의 目標達成을 爲하여 最善의 內容과 體制를 갖추어야 할것이다. 特히 中 學校 社會科 敎科書야 말로 同條 第一號의 中堅國民으로서 資質과 品性을 기르는데 그主가 될것이며 特히 그중 法律敎育이야 말로 우리의 日常生活과 密接한 關係가 있으며 民主 法治 行政의 歷史가 日淺할뿐 아니라 急進的인 福祉行政國家化의 現實的要請과 우리나라의 오랜 歷史的 慣習 및 儒敎的 思想으로 부터오는 法輕視觀念 等 우리나라의 遵法精神薄弱 狀態를 考慮할때 單純하고 깨끗한 年令層에 있는 中 學生에게 主權者로서의 姿勢와 權利 義務에 對한 履行價値性과 遵法精神에 立脚한 우리生活에 密接하게 關係되는 最少限의 法律知識을 길러주어야 한다는 點에서 大端히 必要하다고 본다. 또한 法律敎育은 頭腦를 明哲하게 하고 合理的 判斷力과 理知力을 길러줄뿐 아니라 現行 우리나라의 敎育制度面에서 볼때 高等學校 課程은 技能 養成爲主인데다 大學入學 準備를 爲한 英語 數學爲主의 敎育實精이고 大學課程은 專門分野別로 되어 있어서 法科大學을 志望하지 않는 以上 永久히 法律敎育을 받지 못하는 結果가 되고 마는 點에서도 그 必要性이 크다고 하겠다. 그런데 現行 中 學校 社會科 敎科書를 分析 檢討해 볼때 각 敎科書마다 法律敎育에 對한 內容的 差異가 甚하여 꼭 이 單元, 이 問題에서는 이러 이러한 法(令)이 引用되거나 論及이 되어야 할텐데 全然取扱되지 않은 敎科書가 大部分인것을 發見할 수 있는 것이다. 뿐만아니라 우리 보다 先進國이라 할수 있는 日本의 中 學校 社會科 敎科書를 分析 檢討해 볼때, 그 속에 取扱되고 있는 法律이 憲法을 中心으로한 法律敎育의 基本的인 것은 勿論이고 勤勞關係法令, 社會保障關係法令 農村開發關係法令, 消費者 保護關係法令으로부터 國土開發計劃法에 이르기까지 實際 社會의 生活人으로서 必要한 細部的인 法領을 다루고 있는것을 比較하여 볼때 이러한 點에서 現行 中 學校 社會科 敎科書는 法律敎育 强化面으로 改善되어야 하는 것이다. 따라서 本論題에서는 이를 뒷받침하기 爲하여 第一章 緖論에서 硏究의 目的과 範圍, 方法 等을 敍述하고 第二章 法律敎育 必要性에서는 우리生活과 法律과의 關係와 우리 韓國國民의 傳來的인 法에 對한 態度를 論及하고 日常生活과 社會秩序의 紊亂이 主로 自己의 權利와 義務를 誠實하게 履行하지 않는데서 옴으로 權利, 義務를 보다 充實히 展行케 함으로서 協同하는 公民意識을 形成케 하고 現行 敎育制度에 비추어 中 學校 學生에 對한 法律敎育의 重要性에 論及하였으며 第三章 現行·中 學校 社會科 敎科書의 分析에 있어서는 現行 敎科書 五卷을 選定하여 이를 便宜上, 알파??A, B, C, D, E로 區分하여 各單元別과 法律重要事項別로 法律取扱 빈도(量的分析)와 取扱程度(說明의程度 一質的分析)를 分析하되 取扱程度의 良好에 따라, 甲, 乙, 丙으로 分類하고 假定値를 賦與하므로서 評點制에 依한 分析 比較方法을 取하였다. 第四章 外國中 學敎 社會科 敎科書의 分析에 있어서는 文獻上의 隘路때문에 美國의 것은 美國의 社會科 硏究誌를 中心으로 分析하고 日本의 것은 二卷을 選擇하여 單元別로 內容을 槪括的으로 分析함으로서 本論題 硏究에 基礎로 하였다. 第五章 改善策에서는 大法을 中心으로한 法律敎育을 各單元別로 强調하고 其他 實際 社會生活上 必要한 關係法令을 總括的으로 提示하여 敎科書를 編輯함에 있어 各單元에서 關係法令을 取扱할 수 있도록 함으로서 法律敎育의 改善을 企圖해 보았다. 끝으로 第六章에서는 結論으로서 如斯한 法律敎育强化로서의 現行 中 學校 社會科 敎育이 中堅國民으로서 보다 휼륭한 品性과 資質을 기르는데는 一線擔當 敎師와 敎科書編輯 擔當者의 共同努力이 없이는 成就될 수 없을 것이라는 것으로 끝을 맺었다.;Ⅰ. Introduction A. Objectives of the Study a) It is very important to know the legal knowledge for our social life, Because, there is no society without any regulations. b) The educational object of junior high school is to cultivate the backbone people of the nation, ( ref. The Educational Law : Article 100) c) Moreover, legal education makes them more rational, intellectuall and intelligent. d) So, it is necessary to strengthen the legal education, and to attempt reinforcement of lagal contents and frequency of legal reference in the junior high school social text books. B. Method of the Study a) Document analysis Basic reference meterials are 5 social studies test books, concerning legal books and several foreign social studies books. b) Interviews The professors' opinions and concerning national officers' opinions are backing up his theory. c) The analysis of the study is divided two marts, one is a quantitative analysis and the other is a qualitative analysis. Quantitative analysis means a quantity of legal quotations and legal mentioned items in them. Qualitative analysis means a degree of its explaining in legal mentioned items in them. C. Limits of the Study a) The study is limited to 5 social studies text books with use. b) The study is limited only for the improvement of its concerned legal contents, not a educational unit. 2. The Necessity of Legal Education A. About our social living with law The two are combined inseparably. So, it is most important to maintain the rule of the society, because man is a social animal. B. The traditional attitude about law in Korea Traditionally, Korean people are taking more serious consideration of morality, custom and religious rule than the law. Such temper has been much influenced by the confucianism. C. The formation of cooperation morale with enough comprehension for their rights and duty (responsibility) Generally, most trouble has been made by non erformance of their duty. So mutual understanding is the very key to solve the trouble. D. The formation of citizen senses with strengthening of legal education E. The necessity of legal education for a junior hieh school student A junior high school student will be one of the backbone people in future. The legal education for a junior high school student should be adapted in agehood and systematic point. 3. Analysis of 5 Social Studies Text Books with Use A. The supposing standard of analysis; a) For convenience, 5 text books are classified with A. B. C. D. E. b) For convenience, the degree of explaining is classified with Gap. Ul, Byong. "Gap" is supposed in case of enough explaining. "Ul" is supposed in case of some good state. "Byong" is supposed in case of only quotation. c) The supposing point of a nark method (in case of explaining degree) "Gap" is shared 5 poin in due to 5 pages, and added 2point in due to over 1 page. "Ul" is shared 2 point in due to 1 page, and added 2 point in due to over 1 page. "Byong" is shared 0.1 point in due to 1 line. This mark system is depend on that each page has 20 lines. The Comparison Study with Foreign social text book (about legal education) a) The analysis of Japanese social study text book (ref. pp.) b) The analysis of American social study text book (ref. pp.) 5. The Improving Is Meant far the Social Study Text Book of Junior High Schools in Korea It must strengthen legal education in social study text book. Every education unit has a many legal relations, but the text bsoks are almost omitted such as a needful legal relations.(ref. pp.) 6. Conclusion The mentioned improving of the legal education in junior high school will contribute to cultivating the backbone people in our nation in future. But, the effects of improved text books entirely depend on the struggle of teachers and concerned officers.
