중국 한국 온라인 플랫폼 독과점규제 비교연구

Abstract

기술의 지속적인 발전은 '인터넷 경제 시대'에서 '인터넷 플랫폼 경제 시대'로 진입하게 했다. 온라인 플랫폼은 현대 기술의 주요 매개체가 되어 쇼핑, 커뮤니케이션, 재테크 등 모든 면에서 긍정적인 영향을 미치고 있다. 자원 할당을 최적화하고 만인의 혁신을 촉진하는 데 무시할 수 없는 역할을 한다. 그러나 온라인 플랫폼은 많은 편의를 제공함과 동시에 인터넷 플랫폼의 고유한 내부 속성으로 인해 일부 인터넷 플랫폼은 초기 이점을 사용하여 구축되었으며 점차 각 분야에서 독과점 상태가 되었다. 이는 필연적으로 소비자의 정당한 권리와 시장의 정상적인 건강 질서에 부정적인 영향을 미친다. 중국과 한국은 지난 몇년 동안 온라인 플랫폼의 독점에 관심을 갖기 시작했고 독점을 규제하기 위한 정책과 법안을 잇달아 발표했다. 양국 간에는 온라인 플랫폼 반독점 문제에서 비슷한 역사적 과정이 있고, 비슷한 문제도 있다. 그리고 경우에 따라서는 다른 특수한 문제도 있다. 본 연구에서는 중국과 한국의 온라인 플랫폼 반독점 규제 현황에서 출발하여 온라인 플랫폼의 의미, 반독점의 필요성과 그 기본 이론을 바탕으로 반독점 규제가 일찍 발전한 EU, 미국 등 선진국의 경험과 규제를 참고하여 한중 양국의 온라인 플랫폼 반독점 규제의 범위, 수단, 강도를 비교하고 반독점 규제의 문제점을 분석하다.;The continuous progress of science and technology makes us step from the "Internet economic era" to the current "Internet platform economic era". The online platform has become the main carrier of modern technology, which has played a positive role in shopping, communication, financial management and other aspects. It plays an important role in optimizing resource allocation and promoting mass innovation. However, while the online platform brings a lot of convenience, the unique inherent attributes of Internet platforms make some Internet platforms built with the help of first-mover advantages have been highly concentrated and gradually become monopolistic in their respective fields. This inevitably has a negative impact on the legitimate rights and interests of consumers and the normal and healthy order of the market. Both China and South Korea began to pay attention to the issue of online platform monopoly in the last two years, and successively introduced some policies and laws to regulate the issue of monopoly. The two countries have a similar history of antitrust issues on online platforms, as well as similar problems. And there are other special problems depending on the situation. This paper starts from the status quo of anti-monopoly regulation of online platforms in China and South Korea, based on the significance of online platforms, the necessity of anti-monopoly and its basic theories, and draws lessons from the experience and regulation of developed countries such as the European Union and the United States, where anti-monopoly regulation was developed earlier, to compare the scope, means and intensity of anti-monopoly regulation of online platforms in China and South Korea. Analyze the existing problems of anti-monopoly regulation.
