디지털 성범죄 피해 지원 활동가의 피해 지원 경험과 여성주의 의식화에 관한 연구

Abstract

The purpose of this study was to examine the reflection of feministic agenda on digital sexual crime institutionalization process. The agenda about digital sexual violence crime of women’s movement in 2015 was based on its gender based violence properties. However, the institutionalization focusing on the digital technological and online feature of a new kind of crime enforced the law of ‘Punishment of the offender’ and ‘Support for Crime victims’. Feminists criticized that the standpoint of policy tend to exclude victim’s gender based sexual violence experience. Following on this tendency, Discussion of substantial experience and questioning on the activist’s field between feministic agenda and supporting institutionalization have not been carried out. This study aimed to analyze the experience of activist’s frustration and practices of digital sexual violence crime advocacy organization. This study explored the significance of feminist consciousness and practice on digital sexual violence crimes by highlighting the experiences of activists that have not been noticed so far. Studying the frustration and helplessness they have experienced in the field where the feminist perspective has not been understood, and the practice of coping with it, we could see the meaning of the activities in which the feminist consciousness was reconstructed. Activist experience is under the influence of social relations, but there has been no attempt to understand what social and institutional background it was composed of. Accordingly, the experiences of activists could be meaningful as reconstructing the feminist consciousness through frustration, coping, exhaustion, and recovery in the field where the feminist perspective was not understood.;2015년 국내 언론사의 취재를 통해 인터넷 사이트 ‘소라넷’이 사회적 관심을 받기 시작하면서 디지털 성범죄에 대한 정부의 국가적 대응을 비판하는 여성들의 목소리가 높아졌다. 디지털 성범죄가 피해자 인권을 심각하게 침해하는 성폭력 범죄라는 여성들의 문제의식에 따라 정부는 2017년‘디지털 성범죄 피해 방지 종합 대책‘을 마련했고 2018년‘디지털성범죄피해자지원센터’를 개소했다. 한편, 제도화에도 불구하고 피해자의 경험을 주변화하여 젠더 폭력의 연속선에서의 피해의 경험을 반영하지 않는 구조적 문제가 드러났다. 따라서, 본 연구는 활동가들의 경험을 바탕으로 디지털 성범죄 예방 및 대응에 관한 사회 제도적 한계와 제도화 과정에서의 의식화 맥락을 분석한다. 디지털 성범죄 피해 지원 활동가는 여성의 관점에서 디지털 성범죄 언어화를 시도한다. 피해자 중심의 지원을 위해 개인적, 집단적 삶의 양식의 변화를 추구하는 이들의 문제 제기와 노력은 반성폭력 운동의 차원에서 여성주의적 실천의 하나로 볼 수 있다. 성폭력을 여성의 관점에서 명명하고 피해 경험을 재구성한 것과 같이, 활동가들은 개별화된 피해 경험들을 구조적 폭력의 맥락으로 인식하고 대응한다. 활동과정에서 백래시, 제도적 한계에 대처하며 여성주의 의식화를 겪는 것이다. 이에 본 연구는 디지털 성범죄 피해 지원 활동가들의 경험을 중심으로 여성주의 관점이 비가시화되는 사회·제도적 배경을 파악하고 이에 대응하고 문제화하는 활동가들의 경험을 의식화의 측면에서 살펴보았다. 활동가들은 피해자 요구를 다루지 못하는 피상적인 제도의 문제를 드러내고 문제 의식을 형성하며 삶의 변화를 이루고 있었다. 여성이 처한 사회적 조건과 상황이 사회의 성적 이념, 질서와 어떻게 결합하여 피해가 발생하는지를 파악하고 이를 디지털 성범죄로 밝히는 노력과 실천은 여성주의 제도화와 논의의 장을 넓히는 의식화의 과정이다. 이에 사회, 제도적으로 디지털 성범죄 피해 지원 활동가들의 경험에 주목하고 이를 여성주의적 실천의 하나로 이해하는 노력이 필요하다고 주장하였다.
