dc.description.abstractIt has been recognized worldwide that access to justice is part of human rights. Alongside with the infused of international human rights law specifically ratification of the United Nations Convention on the Rights of Persons with Disabilities (UN CRPD) that recognizes and distinct access to justice as rights on article 13. The ratification of the UN CRPD worldwide also becoming the international human rights law that widely accepted from states parties through ratification. In Asia, inherently the legal mobilization from disability rights movement that has been arising in the three countries is taken as the comparative case studies, Indonesia, the Republic of Korea, and Japan. This mobilization likely leads to the enhance of access to justice for persons with disabilities within each country. Numerous civil society groups in the countries have established initiatives, built networks, and utilized the law as part of the legal mobilization. It has also been noted that the inclusion in the movement and the use of intersectionality has played an important role as base of strategic litigation and its strength. The comparative case study suggests that there is significant improvement in relation for access to justice for disabled community in the Republic of Korea caused by not only the international human rights regime on disability rights but consistency and strength of disability rights movement together with civil society groups.;정의에 대한 접근이 인권의 일부라는 것은 세계적으로 인정되었다. 제13조에 정의에 대한 접근을 권리로 인정하고 구별하는 유엔 장애인 권리협약(UN CRPD)의 구체적인 비준과 함께 국제인권법의 영향을 받았다. 전 세계적으로 UN CRPD의 비준은 또한 비준을 통해 국가들로부터 널리 받아들여지는 국제 인권법이 되었다. 아시아에서는 본질적으로 인도네시아, 한국, 일본 3개국에서 발생하고 있는 장애인 권리 운동에 따른 법적 동원을 비교 사례를 연구로 삼고 있다. 이러한 동원은 각 국가 내에 장애인의 사법 접근성 향상으로 이어질 가능성이 높다. 그 나라들의 수많은 시민 사회 단체들은 주도권을 확립하고, 네트워크를 구축하고, 법을 법적 동원의 일부로 활용했다. 또한 운동에 포함되고 교차성을 사용하는 것은 전략적 소송과 그 힘의 기반으로서 중요한 역할을 했다는 점에 주목했다. 비교사례 연구는 장애권에 대한 국제적 인권체제뿐만 아니라 시민사회단체와 함께 장애권 운동의 일관성과 강도에 의해 발생하는 대한민국 장애인 공동체의 정의접근에 대한 관계에서 유의미한 개선이 있음을 시사한다.-
