Unpunished Crime

Abstract

Despite ratifying a number of international human rights conventions and the strengthening of national legal tools to combat bride kidnapping, the practice remains a disease of Kyrgyzstan. Bride kidnapping is not only a severe violation of women’s and human’s rights, but also an impediment for the country’s overall development. What aggravates the situation is the fact that the practice is falsely perceived by some citizens as a tradition of Kyrgyz people. This study’s goal is twofold: First, it examines the nature of bride kidnapping, a long-lasting practice of abducting women with the purpose of marriage, which is widely practiced in Kyrgyzstan without being punished. Second, it identifies the reasons behind the impunity of bride kidnapping deeply embedded in the patriarchal Kyrgyz society. The study shows that bride kidnapping is a manifestation of the interplay between gender inequality and poverty in Kyrgyzstan. It argues that the continuity of the bride kidnapping is mainly due to the impunity of the crime, which is caused by the weak law enforcement and inadequate government’s approaches to gender inequality issues in general and bride kidnapping in particular.;신부 납치를 해결하기 위한 국제 인권 협약의 비준과 국가 법률 제도의 강화에도 불구하고, 이 관습은 키르기스스탄의 질병으로 남아있다. 신부 납치는 여성의 권리와 인권을 심각하게 침해할 뿐만 아니라, 국가의 전반적인 발전을 저해한다. 상황을 더욱 악화시키는 것은, 이 관습이 일부 시민들에게 키르기스스탄의 전통으로 잘못 인식되고 있다는 사실이다. 이 연구의 목표는 두 가지이다. 첫째, 키르기스스탄에서 결혼의 목적으로 여성을 납치하고 처벌없이 오랜 관습으로 널리 행해지고 있는 신부 납치의 성격을 조사하고자 한다. 둘째, 가부장적인 키르기스스탄 사회에 깊게 뿌리 박혀 있는 신부 납치가 면죄되는 이유들을 밝히고자 한다. 이 연구는 신부 납치가 키르기스스탄의 성 불평등과 빈곤의 상호작용으로 나타나는 것임을 보여준다. 신부 납치가 연속적으로 나타나는 주된 이유는 그것이 범죄로 처벌받지 않기 때문이며, 이는 법의 약한 집행과 전반적인 성 불평등 문제 및 신부 납치에 대한 정부의 불충분한 접근에 기인한다고 주장한다.
