사이버안보의 중국 모델 연구

Abstract

본 연구의 목적은 사이버공간에서 중국 모델의 특성을 포착하는 것에 있다. 본 논문은 크게 세 가지 부분으로 구성된다. 첫째, 중국 사이버안보의 발전 현황을 밝힌다. 둘째, 중국 ‘국가 사이버공간 안전전략’과 ‘사이버안전법’의 중요 내용과 이를 통해 볼 수 있는 중국 모델의 특색을 분석한다. 셋째, 사이버안보의 중국 모델의 특성이 무엇인지와 미래의 발전 방향이 어떤지를 분석한다. 여러 해 동안 중국식 발전 방향과 모델에 대해 국제 사회는 줄곧 관심을 가져왔고, 최근에 들어와 서구 국가들이나 선진국의 표준적인 발전모델과는 다른 유형의 ‘중국 노선’ 또는 ‘중국 모델’과 같은 중국식 접근법에 대한 논의는 꾸준하게 지속되고 있다. 하지만 지금까지 ‘중국 모델’이라는 개념에 대해 심층적인 탐구와 학술적 연구가 그리 풍부하지 않은 것이 현실이다. 본 연구에서는 다양한 국제관계의 영역 중에서도 특히 사이버공간에서 전개되고 있는 안보 이슈가 중국의 거버넌스 체제에서 어떻게 구현되고 있는가를 살펴본다. 그럼으로써 사이버안보 영역에서도 ‘중국 모델’이 추진되고 있는지, 그렇다면 그 내용과 성격은 어떤 것인지를 탐색하고자 한다. 2016년 중국에서 ‘사이버안전법’과 ‘국가 사이버공간 안전전략’이 연이어 발표되었다. ‘1개의 법률과 1개의 전략’(一法一战略)은 서로 보완하며 중국이 이를 통해 법률과 제도적 차원에서 인터넷 안전을 보장하고자 한다. 이 두 가지는 중국이 ‘인터넷대국(网络大国)에서 점차 인터넷강국(网络强国)으로 전환하는’ 목표의 실현 과정에서 중요한 역할을 하고 있다. 그리고 제도와 이론 차원의 발전 원동력으로서 사이버공간 중국 모델의 형성과 발전을 계속해서 촉진하고 있다. 중국은 사이버안보 업무를 전개해왔으며 최근 전체적인 계획, 즉 상층설계(顶层设计)도 만들었다. 사이버안보와 관련된 법률과 전략들은 이와 같은 상층설계의 핵심 요소로 자리를 잡기 시작하고 있다. 이러한 점에서 지금까지 중국이 추진해 온 사이버안보 법률과 전략을 중심으로 중국적 특색을 쉽게 발견할 수 있다. 본 연구에서는 이러한 특색이 중국의 사이버안보 모델의 근간을 이룬다고 간주한다. ;The purpose of this study is to demonstrate the characteristics of China Model in Cyber space. This paper has been divided into three main sections: summary of the development of China’s cyber security; descriptions as well as analysis of Cybersecurity Law of the People’s Republic of China and its Cyberspace Security Strategy; analysis of main characteristics and future directions of China Model in Cyber space. For several years the international community has been paying sufficient attention to the development path and direction of China, called ‘China Model’ as well. Recently its growing technological strength has led to argument inside and outside China that it does have something special such as ‘China Model’ and ‘China Road’ which are different with the standard model of Western countries such as the United States or other developed countries. Actually, reports or serious academic research on the concept of ‘China Model’ were still minor at the present time. In this study, questions will be answered, such as how the issues happened in cyber space affect China’s governance system, does ‘China Model’ exist in cyber space, if it does then what its contents and characteristics are. Cybersecurity Law of the People’s Republic of China and Cyberspace Security Strategy have been successively promulgated. The two complement each other and guarantee the cyber security of China from legal and institutional dimension. In addition, they play an important role in the realization of the goal of evolving ‘from a major internet user to a network superpower’. At the same time, as the proven agent of development, they also continue to promote the formation and development of China Model in cyber space at the institutional and theoretical level. Now China has developed its system of cyber security and also designed a general plan. The laws and strategies related to cyber security are becoming a key element of this plan. From this point, it is easy to find out the Chinese characteristics centering on these laws and strategies that China has pursued so far. This study considers these features to be the basis of the China Model in cyber security.
