Abstract
의·생명과학 기술의 발달에 힘입어 인간의 수명이 늘어남에 따라 늙어감과 죽어감의 과정도 관리 가능한 영역으로 인식하게 되었다. 의학은 삶의 마지막 시기에 노인이 경험하게 되는 신체적, 정서적 쇠퇴 현상들을 자연스러운 삶의 한 과정으로 인식하기보다는, 의학적 기준에 따라 노인들을 환자로 분류하고 노쇠에 따른 현상들을 노인성 질환으로 명명하면서, 노인의 삶의 마지막 시기 돌봄을 의료화하였다. 이러한 삶의 마지막 시기 돌봄 문화 속에서 어떻게 죽어야 인간답게 죽는 것인가에 대한 사회적 논의가 시작되었다. 삶의 마지막 시기 인간다운 돌봄과 환자의 자기 결정권에 관한 지속적인 사회적 논의를 통해 ‘호스피스·완화의료 및 임종과정에 있는 환자의 연명의료 결정에 관한 법률’이 제정되었다. 그러나 이 법은 노인 삶의 마지막 시기 돌봄 계획을 포괄하기에는 제한점이 있다. 이 법은 삶의 마지막 시기를 ‘좋은 죽음’의 관점에서 바라보고 죽음에 관한 논의에 집중하였기 때문에 다양한 형태로 전개되는 노인 삶의 마지막 시기 중에서도 말기 및 임종기 상황의 연명의료중단과 호스피스 내용만을 다루었다. 그러나 말기 및 임종기로 접어들기 전인 절대의존기 시기에 노쇠 및 만성질환의 악화로 인해 혼자서는 기본적인 생활조차 불가능한 절대적인 의존 속에서도 노인에게는 분명한 자의식과 인간으로서 존엄하고 싶은 기본적인 욕구가 여전히 존재한다. 따라서 말기 및 임종기에 집중되어 있는 좋은 죽음에 관한 논의들을 노인 삶의 마지막 시기 여정을 따라 절대의존기로 확장하여 다가오는 좋은 죽음을 대비하는 한편, 여전히 지속되는 삶을 위해서 이 시기의 노인 삶에 대한 특성들에 대한 이해와 이를 지원하는 돌봄 문제들을 다뤄야 한다. 이러한 연구 배경 하에서 본 연구는 노인의 돌봄 경험과 관련 제도들을 삶의 마지막 시기 돌봄 장소에 따라 살펴봄으로써 한국 사회 노인 삶의 마지막 시기 돌봄 현황을 상세히 파악하고자 하였다. 노인 삶의 마지막 시기 제도를 분석한 결과 의료적 돌봄과 사회적 돌봄 제도의 이원화와 돌봄의 시설화 및 외주화가 특징으로 밝혀졌다. 이러한 제도 하에서 노인은 삶의 마지막 시기 돌봄 장소에서 의존기의 삶에 대한 적절한 돌봄 필요들을 충족하지 못하고 있으며, 더 근본적으로는 인간의 존엄성을 존중받지 못하며 삶의 마지막 시기를 무의미한 시간으로 인식하고 있는 것을 발견하였다. 본 연구를 통해 노인 삶의 마지막 시기가 여전히 지속되는 인간다운 삶으로 인식되지 못한 주요 이유가 노인의 의사결정에 근거한 돌봄 선택의 부재라는 점을 도출하였다. 지금까지 한국사회에서 노인은 다양한 원인으로 인한 의사결정능력의 취약성으로 인해 의사결정의 주체로 인정되지 못하고, 자신의 돌봄 결정에 관련된 의사결정 과정에서 배제되어 왔다. 본 연구는 또한 돌봄 의사결정 과정이 노인의 자율성에 근거할 수 있도록 하기 위해서, 삶의 마지막 시기를 재구성하고 노인의 의존기 삶의 특성을 반영하여 노인의 의사결정역량을 증진할 수 있는 방안을 모색하였다. 즉, 노인 삶의 마지막 시기를 노인의 신체적 상실로 인한 의존상태에 따라 절대의존기, 말기, 그리고 임종기로 나누어 구분하여 각 시점에 따른 돌봄 필요들과 의사결정의 이슈들을 살펴볼 수 있게 하였다. 이러한 돌봄 필요에 근거해 노인들이 적극적으로 자신의 삶의 마지막 시기를 인간답게 살아가기 위한 의사결정지원책으로 사전돌봄계획과정에 대해 살펴보았다. 사전돌봄계획과정은 노인의 자기 결정권이 존중되고 그들의 부족한 의사결정능력을 보충해 줄 수 있는 의사결정지원 방안이다. 이는 노인 삶의 마지막 시기를 좋은 죽음을 대비하는 동시에, 여전히 인간다운 삶을 유지할 수 있는 절차적 과정으로 활용될 수 있기 때문에 중요한 의의가 있다. 또한 사전돌봄계획과정과 함께 노인과 돌봄 주체들의 의사결정역량을 향상시키기 위해 생명교육과 죽음교육의 필요성을 제안함으로써 삶의 마지막 시기 돌봄에 관한 사회적 인식변화를 촉구하였다.;The purpose of this study is to investigate what practices and procedures are needed to cultivate greater autonomy for the elderly as they make decisions with regard to end-of-life care. As human life expectancy has increased through advances in biomedical technology, aging and dying have come to be seen as a process to be managed and manipulated, rather than natural events in the progression of a human life. In particular, the easy availability of medicine has prevented the elderly from accepting the diminution of their physical and mental faculties as an essential outcome of their senescence. An over-dependence on medicine also has led to the identification of the elderly as “patients” and has contributed to putting many of them in a chronic medicalized state for the latter parts of their lives. Moreover, excessive medical care in the acute care setting has complicated legal and ethical issues, such as when a family must decide whether to withdraw life-extending treatment from one of its members. In such instances, the duty of a society to uphold human dignity even in death becomes especially pressing. It was in light of this ongoing social debate over how to provide high-quality care for at the end of life, while respecting patients’ right to self-determination, that “The Act on Hospice, Palliative Care, and Withdrawal of Life-Sustaining Treatment in the Dying Process” was enacted. However, because this law focused only on life-sustaining treatment and hospice at the terminal stage of life, it failed to address the need to provide overall care for the various infirmities and chronic illnesses that become more prevalent with age. With these issues in the background, I undertook a preliminary review of the current state of end-of-life care in Korea, studying the situation from the viewpoint of the elderly who have had direct experiences with such care, through hospice and other specialized palliative care services. The results were, first, that the medical and social systems of end-of-life care are not unified in Korea and, second, that profound changes in conventional Korean family structures have led to the institutionalization and outsourcing of care that was customarily delivered by one’s family members. From my preliminary review, I found that the needs of the elderly, with respect to end-of-life care, are not being properly met, in large part because they are not recognized as having any agency in such matters. The elderly are excluded from decisions about the kind of care they are to receive, and how they are to receive it, because of social perceptions about their diminished cognitive abilities. In other words, when it comes to end-of-life care, the elderly are afforded very little self-determination and find themselves constrained by both personal and social circumstances. It is not overstating the point to say that, in the very places where they should be receiving the highest level of care, the elderly have trouble being seen as individuals and eventually come to regard their existence with considerable desperation and futility. As mentioned at the outset, this study seeks to examine ways in which the elderly can assume a more prominent role in the decisions about the care they receive so that they enjoy dignity and respect at the end of their lives. To that end, in my paper, I will first chart the relevant time period for end-of-life care into three stages: the fully-dependent stage, the terminal stage, and the dying stage, according to the degree of dependency on others as physical capabilities are gradually lost. Second, based on an individual’s particular needs with regard to care, I will describe how advance-care planning can be implemented to allow the elderly to participate in decisions regarding end-of-life care. Through advance-care planning, the elderly can be self-determined, while also receiving the necessary assistance to guide them through what are often difficult choices and deliberations. Lastly, in addition to advance-care planning, I will underscore the importance of bioethics education and death education as the elderly, their families, caregivers, and health professionals work to improve the quality of end-of-life care in Korea.
