서로 다른 손해배상방식 하에서 특성이 다른 다개체간 계약 간의 비교

Abstract

본 연구의 목적은 손해배상방식 중 기대배상방식과 신뢰배상방식 하에서 서로 다른 특성을 가진 다개체간 계약 모델들이 사회 최적 수준과 비교했을 때 각각 어떤 수준의 결과값을 보여주는지에 대해 분석하고 그 효율성을 검토하는 것이다. 모델은 다개체 간 계약 중 한 명의 수약자와 서로 보완 관계에 있는 두 명의 약속자가 계약을 하는 형태를 기본으로 두고, 계약 이행에 실패한 경우 책임 소재가 다른 형태의 모델과 약속자 간의 관계가 대체 관계인 모델까지 세가지로 나누었다. 세가지 모델의 사회 최적 의존수준 r 값과 이행수준 x 값을 먼저 도출하고, 기대배상방식과 신뢰배상방식 하일 때 각각의 의존수준과 이행수준은 어떤 값인지 도출하고 이를 비교 분석하였다. 결과는 다음과 같다. 첫째, 기대배상방식과 신뢰배상 방식 하에서 세가지 모델 모두 사회 최적 의존수준보다 높은 의존수준 값을 가진다. 둘째, 기대배상방식 하에서 위험분담 모델과 대체 관계 모델인 경우에는 사회 최적 이행수준보다 낮은 이행수준 값을 가지지만 보완 관계인 경우에는 사회 최적 이행수준보다 높은 이행수준 값을 가진다. 셋째, 신뢰배상방식 하에서 세가지 모델 모두 사회 최적 이행수준보다 낮은 이행수준 값을 가진다.;The purpose of the study is to examine the different performance and the effectiveness of two agents contract models with different characteristics under the expectation damages and reliance damages compared with the social optimal levels. The model is based on the form of a contract composed of two sellers of a complementary relationship with one buyer. There is also a model that sellers’ liability for damages is different from the basic model. The last model shows that the seller's relationship is substitutional. The result is as follows. First, under the expectation damages and reliance damages, all three models have a value of higher reliance level than the level of social optimum. Second, the team risk-sharing model and the substitution model under the expectation damages have lower precaution level than the social optimal level, but only the complement model has a higher precaution level than the social optimum. Third, under the reliance damages, all three models have a lower precaution level than the socially optimal precaution level.
