Effectiveness of Domestic Violence Laws in Mongolia

Abstract

In recent years, domestic violence issues have received increased public attention in Mongolia along with the adoption of new domestic violence laws in 2016. However, cases of domestic violence in the country have remained high. This study focuses on the legislation and implementation of Mongolian Domestic Violence laws, specifically in the areas of prevention, protection, sanction, and consistency of law. This paper argues that domestic violence laws in Mongolia cannot combat domestic violence effectively due to limitations in the legal context and barriers faced in implementation. In terms of legislation, Mongolian domestic violence laws have omissions in its procedures of protection, sanction, and consistency of law. In terms of implementation, there are many challenges in terms of prevention and protection. The study suggests that the state should improve the contextual gaps in Mongolian domestic violence laws and raise awareness among the citizens to refer to the laws for the purposes of prevention and protection, not divorce and criminalization. ;최근 몇 년 동안 몽골에서는 가정폭력 문제가 2016년 새로운 가정폭력법 제정과 함께 대중의 높은 관심을 받고 있다.그러나국내 가정폭력의 발발은 여전히 높게 나타나는 실정이다. 본 연구는 몽골의 가정폭력법의 법제화 및 실행 방안을 중점으로,특히 예방, 보호,제제 및 법의 일관성에 대하여 조사하였다.본 연구는 몽골의 가정폭력법이 법률 문맥상 및 실행에 있어서의 한계로 인하여 가정폭력을 효과적으로 방지하지 못하고 있음을논하였다.가정폭력법의 법제화에 있어서는, 몽골의 가정폭력법이 보호,제제 및 법의 일관성 부분의 절차가 생략 되어 있었다.실행 방안에 있어서는,예방과 보호에 관한 부분이 문제가 되고 있었다. 본 연구를 통한 정책조언으로는, 정부는 이혼 또는 범죄화가아닌,가정폭력법과 법의 예방 및 보호 목적에 합한 시민의식 제고 사이의 맥락적 차이를 개선해야 함을 제안하였다.
