dc.description.abstractThis study aims to examine the relations between the domestic regulation and the international trade in a position of the WTO Member. In Australia, all tobacco products must be plainly packed in accordance with the Tobacco Plain Packaging Act 2011 from the year of 2012. Accordingly, all tobacco companies including both international and local firms have to necessarily change into the plain packaging to sell tobacco products in Australia. As regards to this requirement, Ukraine, Honduras, Dominican Republic, Cuba, and Indonesia brought a case for the reasons of creating unnecessary barriers to trading activities as well as this is a breach of the WTO Agreements. In this trade dispute, it is expected to be actively debated on the TRIPS Agreement (Agreement on Trade-Related Aspects of Intellectual Property Rights), especially, regarding the trademarks and the Geographical Indications (GIs). Today, not only Australia, but also many other countries including South Korea, New Zealand, UK and, France are preparing similar regulations to reflect on their domestic legal system to improve and protect public health and carry out the obligations of the WHO FCTC (WHO Framework Convention on Tobacco Control). However, constructing and/or amending national laws to adopt this new regulation are being tackled at both domestic and international levels. Above all, it is inevitable to avoid a highly demanding discussion dealing with, inter alia, issues on the trademarks and the GIs, with conflicted views on the TRIPS Agreements. Therefore, this study, focusing on these two concerns, is designed to consider how to make a harmonious trade environment pertaining to the introduction of influential domestic regulations to the world trading system.;본 논문은 새롭게 도입되는 국내법이 국제무역환경 변화에 영향을 미칠 가능성이 있는 경우에 WTO 회원국으로서 어떻게 대처해 나가야 하는지에 대해 고민해 보기 위해 시작되었다. 호주는 담배포장간소화법령 2011 (Tobacco Plain Packaging Act 2011)을 제정하여 2012년 12월부터 호주 내에서 판매되는 모든 담배제품에 대해서 규격화된 포장을 의무화하고 있다. 따라서 국산담배뿐 아니라 수입담배 또한 이 규정 준수 및 판매를 위해서는 기존의 포장을 정해진 기준에 따라 모두 바꾸어야 한다. 이에 대해 우크라이나, 온두라스, 도미니카공화국, 쿠바, 인도네시아는 불필요한 무역장벽을 초래한다는 이유로 호주 정부를 WTO에 제소하였다. 이 분쟁은 WTO협정 관련 조항 중에서도 무역관련 지식재산권에 관한 협정(TRIPS협정) 위반 사항에 대한 활발한 논의가 예상된다. 특히 상표(Trademarks) 및 지리적 표시(GIs: Geographical Indications) 권리보호 관련 내용이 중점적으로 다뤄질 것으로 생각된다. 이제는 호주뿐만 아니라, 한국, 뉴질랜드, 영국, 프랑스 등 많은 국가가 공중 보건 보호 및 세계보건기구 담배규제기본협약 (WHO FCTC) 이행 목적 달성을 이유로 비슷한 법안을 도입하고 있다. 이러한 상황을 고려해 볼 때, 국내법 도입은 TRIPS 협정상 상표 및 지리적 표시 관련 조항과의 충돌이 불가피할 것이다. 이에 본 논문은 국내법 제정이 국제무역환경과 상충되는 경우에 이러한 상황을 적절히 인지하여 조화롭게 대처할 수 있는 방안을 생각해 보는 데에 의미가 있다.-
