언론보도가 형사입법에 미치는 영향 연구

Abstract

형법(刑法)은 범죄와 형벌을 규정한 법으로서 어떤 행위가 범죄이고 이에 대한 법적 효과로서 어떤 형벌이 부과되는가를 규정한다. 이 같은 국가형벌권을 바탕으로 사회질서를 유지하고 법익을 보호하며 자유를 보장하는 기능을 한다. 따라서 법 제정과 적용 단계에서 엄격한 헌법상의 원리 및 형사법원리가 적용되어야 한다. 그러나 우리의 법 현실을 보면, 과도한 형사입법 내지 지나친 엄벌화 경향이 형사법 전반에 왜곡현상을 가져오고 있다. 이러한 입법 경향의 원인은 다양하겠지만, 형사입법에 수많은 요인이 형사법 제·개정에 영향을 미치며 포퓰리즘 입법으로 변질되고 있기 때문으로 보인다. 특히 언론보도를 통해 형성된 여론은 법률의 제·개정에 충분한 검토와 수렴절차를 배제시키며 이 같은 일련의 현상들은 국가의 입법권을 무력화하고 법치주의의 근간을 흔들게 된다. 언론보도로 형성된 여론은 법의 제·개정에 큰 영향을 주었는데 먼저, 각종 위헌 여부로 국회에서 통과되지 못했다가 2015년 초 발생한 어린이집 폭행사건을 통해 여론의 뜨거운 관심과 함께 국회 통과된 영유아 보육법 개정안과, 역시 입법예고 된 지 몇 년이 지나도록 국회에 머물러 있다가 2014년 세월호 사건을 계기로 국회를 통과한 김영란 법, 그리고 2000년 이후 꾸준히 우리 사회 큰 문제로 자리 잡고 있는 성범죄와 관련된 법안이 대표적이다. 이 세 가지 사안들의 공통점은 역시 언론보도를 통한 여론형성이 큰 역할을 한 것으로 보인다. 그 결과 법의 개정 이후에도 아동학대나 부정부패, 성범죄는 끊이지 않고 발생하고 오히려 법 적용에 혼란을 가중시켜 각종 부작용도 발생하는 상황이다. 법률이 시행도 되기 전에 각종 문제점이 지적되며 국민들의 공감대를 얻지 못한 법이 계속해서 양산된다면 입법부의 신뢰도가 무너지고 나아가 사법의 권위가 추락하는 현상까지 나타날 것이다. 입법에 있어서는 포퓰리즘 입법과 과도한 엄벌주의를 자제하고, 언론은 책임감 있는 자유를 견지해야 할 것이다.;Criminal law emphasizes crime and punishment. It maintains that order in society is dependent upon on a state’s authority to punish crime. Since the power of the state can violate individual freedoms and livelihoods, strict legal principles should apply to the enactment and revision of criminal law. It should be implemented by the legal legitimacy under the constitution. However, it is often the case that excessive criminal legislation and inordinate punitive trends are likely to distort criminal laws. These legislative trends result from a variety of factors, such as legislators’ representation of public opinion, NGO pressures, and public opinion. This research focuses on the effect of the media coverage on the legislative process in criminal matters. Media reports tend to provide provocative and inflammatory comments about crime, increasing public support for severe punishments. This leads to inconsistent legislation and legal application between cases because legislatures tend to reflect public opinion when they draft a bill. Therefore, the contents of bill can be different from the cases depends on individuals’ opinion. For example, Revision on “Child Care and Education Law” that includes “Childcare Center CCTV installation obligation”,the “Anti-corruption Law” (known as the “Kim Young-Ran law”), and sexual crimes show how mass media reports have a negative effect on criminal legislation by influencing public opinion. However, these laws could not significantly achieve their goals, such as prohibiting child abuse, corruptions, and sexual crimes. The punitive trends of criminal law legislation lead people to mistrust the authority and legitimacy of the judiciary. In that sense, legislations should avoid populistic punitive legislation and inconsistent legal applications. The mass media also needs to take a more balanced approach to reporting on crime and acknowledge its influence on public opinion and legislation.
