Abstract
대부분의 생명윤리적 쟁점들에 대한 논의들은 자유주의의 틀(framework) 안에서 해석되고 적용되는 경향을 보여 왔다. 본 논문에서는 ‘자유주의적 개인주의(liberal individualism)에 기반을 둔 생명윤리적 접근법’을 ‘자유주의적 생명윤리 접근법’이라고 부를 것이다. 그리고 자유주의적 생명윤리에 대한 비판과 공동체주의 접근법을 고찰하고자 한다. 본 논문의 Ⅱ장에서는 서구뿐만 아니라 한국의 생명윤리 쟁점에 대한 담론 과정에서 흔히 볼 수 있는 자유주의적 이데올로기(ideology)가 생명윤리 영역에서 언제부터, 그리고 어떤 일련의 계기로 지배적인 접근법으로 자리 잡게 되었는지를 사회적·정치적 맥락과 이론적 측면에서 검토하였다. 특히 생명윤리학의 이론적 차원에서 자유주의적 개인주의 시각이 확산된 계기는 1979년 톰 비첨(Tom L. Beauchamp)과 제임스 췰드리스(James F. Childress)의 공저 『생명의료윤리의 원칙들(The Principles of Biomedical Ethics)』의 영향력으로 보았다. 필자는 비첨과 췰드리스의 네 가지 원칙들의 주요 개념들에 대한 정의(definition)와 논의의 범주가 개인에 한정되어 있다는 점에서 비첨과 췰드리스의 네 가지 원칙들이 ‘자유주의적 개인주의 원칙들’이라고 평가하였다. Ⅲ장에서는 생명윤리에 대한 올바른 전제를 설정하기 위해 자유주의와 공동체주의의 주요 전제로서 인간관과 국가관을 중심으로 살펴보았다. 자유주의적 생명윤리는 자유주의적 인간관을 전제하고 있으며, 이러한 인간관은 스스로 목적을 선택할 수 있는 자유롭고 독립적인 자아관을 지니고 있다. 자유주의적 인간관은 우리가 스스로 선택하지 않은 목적들을 부정하게 한다는 문제점을 갖고 있다. 바람직한 생명윤리가 견지해야 하는 올바른 전제로서의 인간관은 우리의 정체성이 구체적인 역사적 공동체의 상황 속에서 형성된다고 보는 인간관이다. 이러한 의미에서 공동체주의자들은 인간을 공동체로부터 독립된 개별적인 자아로 이해하지 않고 본질적으로는 사회적으로 구성되는 ‘구성적 자아(constitutive self)’로 이해하고 있다는 점에서 적절한 인간관을 제시한다고 본다. 그 다음으로 자유주의적 생명윤리는 자유주의적 국가관을 전제하고 있으며, 이러한 국가관의 핵심은 국가가 좋은 삶(good life)에 대한 특정 도덕적·종교적 문제들에 대해 중립을 지켜야 한다는 입장에 있다. 그래서 개개인이 스스로 어떤 삶이 가치 있는 삶인지에 대해 선택하도록 개인의 자율성을 존중할 것을 주장한다. 바람직한 생명윤리가 견지해야 하는 올바른 전제로서의 국가관은 다원주의를 포기하지 않으면서도, 반드시 보호되어야 할 권리나 인간 선들이 존재한다고 보는 국가관이 적절하다. 이런 점에서 필자는 국가의 중립성을 주장하는 자유주의적 국가관의 한계를 넘어서면서도 국가 완전주의(perfectionism)를 주장하는 공동체주의적 국가관에 대한 강제의 위험을 배제할 수 있는 대안 제시가 필요하다고 판단한다. 그래서 생명윤리의 국가관이 바람직한 방향으로 나아가기 위해서는 국가의 역할이나 기능으로서 개인선(individual good)과 공동선(common good)의 균형 추구가 목표로 설정된 국가관이 바람직하다고 판단한다. Ⅳ장에서는 생명윤리에 대한 새로운 접근법으로 공동체주의 접근법을 검토하였다. 바람직한 생명윤리적 접근법을 모색하기 위해 생명윤리적 쟁점들의 세 가지 특성들을 제시하였다. 그리고 이러한 생명윤리적 쟁점들에 대한 특성을 근거로 생명윤리의 목표는 다원주의 사회에서 이성적 불일치(reasonable disagreement)로 보이는 문제에 대해 우리 사회가 어디까지 허용 가능한지를 결정하는 것까지 포함해야 한다고 주장하였다. 그리고 생명윤리학의 새로운 과제는 새로운 과학기술의 발전을 반영할 수 있는 근본적이면서도 미래지향적인 물음들에 대한 연구 또한 수행하는 것이라고 주장하였다. 필자는 이러한 생명윤리의 목표를 달성하고 새로운 과제를 수행하기 위해서는 기존의 지배적인 자유주의적 생명윤리 접근법만이 유일한 적절한 접근법이 아니라는 입장을 밝혔다. 필자는 자유주의적 생명윤리에 대한 새로운 접근법으로 공동체주의적 시각을 도입함으로써 자유주의적 생명윤리 접근법이 지닌 한계를 보완할 필요가 있다고 주장하였다. Ⅴ 장에서는 공동체주의적 생명윤리 접근법의 적용을 검토하였다. 본 논문의 Ⅱ장에서 지적한 것처럼, 비첨과 췰드리스의 네 가지 원칙들은 자유주의적 개인주의 원칙이다. 필자는 구체적인 현실적인 삶 속에서 제기되는 복잡한 생명윤리적 문제들에 대해 비첨과 췰드리스의 네 가지 원칙들이 실질적인 지침의 역할을 수행하기 위해서는 원칙들에 대한 논의의 범주가 확대될 필요가 있다고 본다. 그러한 의미에서 자유주의적 개인주의로 해석된 원칙이라 할 수 있는 네 가지 원칙들을 공동체주의적으로 재해석하였다. 그리고 최근 한국 사회에서 제도화를 추진 중에 있는 연명의료(Life-Sustaining Treatment) 중단 및 유보의 문제를 공동체주의적 접근법에 따라 검토하였다. 결론으로 필자는 생명윤리에 대한 공동체주의적 접근법이 생명윤리적 문제에 대한 올바른 전제와 합리적인 출발점을 설정하는 데 기여함으로써 기존의 자유주의적 논의 방식과는 다른 근원적인 문제를 제기하거나 새로운 관점을 제시해 줄 수 있다고 본다.;Most of discussions on bioethical issues have been interpreted and applied within the framework of liberalism. This study will call the bioethical approach based on liberal individualism ‘liberal bioethical approach.’ In addition, it will explore criticisms on liberal bioethics and the communitarian approach. Chapter II examined in the social and political context and in the theoretical aspect when and how liberal ideology, which is observed commonly in the discourses of bioethical issues in Korea, had settled as a dominant approach in the bioethical domain. Particularly in the theoretical dimension of bioethics, this study found the turning point for the spread of liberal individualism in the influence of The Principles of Biomedical Ethics coauthored by Tom L. Beauchamp and James F. Childress in 1979. The author evaluated the four principles of Beauchamp and Childress as the principles of liberal individualism in that the definitions of the major concepts of the four principles of Beauchamp and Childress and the categories of discussion were confined to individuals. Chapter III examined the major premises of liberalism and communitarianism centering on the view of human and the view of state in order to set the right premises of bioethics. Liberal bioethics premises a liberal view of human, and in this view of human, a person is a free and independent self who is able to choose an end on his own initiative. The liberal view of human has the problem that it denies ends not chosen by ourselves. The view of human as a right premise to be held on by desirable bioethics is the view that our identity is formed in a situation of specific historical community. In this sense, communitarians do not understand humans as independent selves separated from community but as constitutive selves established socially by nature, and therefore, communitarianism is believed to suggest an appropriate view of human. What is more, liberal bioethics premises a liberal view of state, and the core of this view of state is that the state should maintain neutrality toward specific moral and religious issues on good life. It asserts that individuals’ autonomy should be respected so that each person can decide what a valuable life is. The view of state as a right premise to be held on by desirable bioethics is communitarianism, which does not give up pluralism yet believes the existence of rights and notions of human good to be protected. In this sense, the author believes it is necessary to suggest an alternative that excludes the risk of the enforcement of the communitarian view of state, which goes beyond the limitation of the liberal view of state asserting the neutrality of the state but, at the same time, advocates the perfectionism of state. Thus, in order for the bioethical view of state to proceed in a desirable direction, its goals need to pursue balance between individual good and common good as a role or function of the state. Chapter IV discussed the communitarian approach as a new approach to bioethics. In order to find a desirable bioethical approach, three characteristics of bioethical issues were presented. Based on these characteristics of bioethical issues, moreover, it was argued that bioethical goals should include legal or political decisions in the dimension of state on how permissible our society as a pluralist society should be to issues showing reasonable disagreement. What is more, it is asserted that a new task of bioethics is to look for answers to more fundamental and future-oriented questions reflecting the advance of new science and technology. The author professed the position that the existing dominant liberal bioethical approach is not the only adequate approach for achieving such goals of bioethics and performing its new tasks. A complementary effect may be expected by introducing a communitarian view as a new approach to liberal bioethics. Thus, it was emphasized that the liberal approach and communitarian approach to bioethics are in a complementary relationship with each other. Chapter V examined the application and tasks of the communitarian bioethical approach. As noted in Chapter II, the four principles of Beauchamp and Childress are principles of liberal individualism. In order for the four moral principles of Beauchamp and Childress to play a role as a practical guideline for complicated bioethical questions raised in the real life, it is necessary to expand the categories of discussion on the principles. In this sense, this study reinterpreted the four principles, which are considered the principles of liberal individualism, as communitarianism. Moreover, the issue of life-sustaining treatment, which is under the process of institutionalization in Korea, was discussed through the communitarian approach. In conclusion, the author believes that the communitarian approach to bioethics raises a fundamental question or suggests a new viewpoint distinguished from the existing way of liberal discussion by contributing to the setting of right premises and a rational starting point for bioethical issues.
